At that time, the<br \/>\npetitioner was only one year old  and, therefore, he was not eligible<br \/>\nto be appointed. After attaining the age of majority, the petitioner<br \/>\napproached the appellants in 1997  for being appointment. These facts<br \/>\nipso facto show that the<br \/>\nright of appointment under Compassionate Scheme is considered as a<br \/>\nvested right, which he has not. It is by way of such providence,<br \/>\nwhich is given to the family for immediate need, and in this regard,<br \/>\nreliance  may be placed  on a decision of the Hon&#8217;ble Supreme Court<br \/>\nin the case of Santosh Kumar Dubey Vs State of Uttar Pradesh and<br \/>\nothers, reported in 2009 (6) SCC p.481, in which, the Supreme Court<br \/>\nhas held as under:-\n<\/p>\n<p> 11.\tThe<br \/>\nvery concept of giving a compassionate appointment is to tide over<br \/>\nthe financial difficulties that are faced by the family of the<br \/>\ndeceased due to the death of the earning member of the family. There<br \/>\nis immediate loss of earning for which the family suffers financial<br \/>\nhardship. The benefit is given so that the family can tide over such<br \/>\nfinancial constraints.\n<\/p>\n<p>12.\tThe<br \/>\nrequest for appointment on compassionate grounds should be reasonable<br \/>\nand proximate to the time of the death of the bread earner of the<br \/>\nfamily, inasmuch as the very purpose of giving such benefit is to<br \/>\nmake financial help available to the family to overcome sudden<br \/>\neconomic crisis occurring in the family<br \/>\nof the deceased who has died in harness. But this, however, cannot be<br \/>\nanother source of recruitment. This also cannot be treated as a<br \/>\nbonanza and also as a right to get an appointment in government<br \/>\nservice.\n<\/p>\n<p>\tIn<br \/>\nthe above view of the matter, we do not think  that the directions<br \/>\nissued by the learned Single Judge are required to be followed by the<br \/>\nState. The order of the learned Single Judge requires to be set aside<br \/>\nand it is accordingly set aside.
