As he was standing for  election  from  a\nconstituency other than the one in which he was an  elector,\nhe filed an attested copy of the relevant part of the  elec-\ntoral  roll relating to the constituency in which he was  an\nelector, along with the nomination paper. On an objection by\none  of the candidates, the Returning Officer rejected\tthe.\nappellant's nomination paper for non-compliance with Section\n33(5)  of  the Representation of the People Act,  1951.\t The\nappellant filed an Election Petition before the High  Court,\nwhich dismissed the same.\n    In\tthe  appeal filed before this Court,  the  appellant\ncontended  that since he had produced before  the  Returning\nOfficer\t an attested copy of the relevant part of the  elec-\ntoral  roll of the constituency in which he was an  elector,\nthe rejection of his nomination paper on the ground of\tnon-\ncompliance with Section 33(5) of the said Act was wrong\t and\nbad in law.\nDismissing the appear, this Court,\n    HELD:  The\tpublication of the integrated  roll  is\t not\nessential  for\tthe  revision of the electoral\troll  to  be\ncomplete  and  the electoral roll with the  amendments\tduly\npublished becomes the final electoral roll for the constitu-\nency. [103D]\n    In\tthe instant case, admittedly, the electoral roll  of\nthe  State Assembly was directed to be revised and  was,  in\nfact,  revised as on January 1, 1984 and  the  supplementary\nelectoral roll notifying the\n101\nchanges to be incorporated on the revision was published and\navailable before February 1985. [102F]\n    However, what the appellant produced before the  Return-\ning Officer was not an attested copy of the final  electoral\nroll  for the said constituency although the final roll\t was\navailable,  but only an attested copy of the electoral\troll\nas it stood on July 21, 1983. The production of such attest-\ned  copy  of the relevant part of the electoral roll  as  it\nstood before the final revision cannot amount to  compliance\nwith the provisions of sub-section (5) of Section 33 of\t the\nsaid  Act. His nomination was, therefore, rightly  rejected.\n[103F]\n<a href=\"\/doc\/1757866\/\">Ranjit\tSingh  v.  Pritam Singh &amp; Ors.,<\/a> [1966]\t3  SCR\t543,\nrelied on.\n    <a href=\"\/doc\/1066323\/\">Jagannath  Ramchandra  Nunekar v. Mehta for the Respondents.<br \/>\nThe Judgment of the Court was delivered by<br \/>\n    KANIA,  J.\tThis  is an appeal from the  judgment  of  a<br \/>\nlearned\t Single\t Judge of the Orissa High  Court  dismissing<br \/>\nElection  Petition No. 7 of 1985 filed by the  appellant  in<br \/>\nthat Court.\n<\/p>\n<p>    The\t facts\tof the case have been fully set out  in\t the<br \/>\nimpugned  judgment of the High Court and hence, little\tpur-<br \/>\npose  would  be served in setting them out  here  again.  It<br \/>\nshould be sufficient to note only the few facts required  to<br \/>\nbe set out to appreciate the controversy arising before us.<br \/>\n    The election in question was to the Legislative Assembly<br \/>\nof  the\t Orissa\t State from  74-Gopalpur  (SchedUled  Caste)<br \/>\nAssembly Constituency. This election was held in March 1985.<br \/>\nThe last date for filing the nomination papers was  February<br \/>\n8, 1985. The date of scrutiny was<br \/>\n<span class=\"hidden_text\">102<\/span><br \/>\nas  February  9, 1985. The last date for withdrawal  of\t the<br \/>\nnominations was February 11, 1985, February 10, 1985 being a<br \/>\nSunday.\t The appellant duly filed his nomination papers\t for<br \/>\nthe  seat and along with the other papers, he filed  an\t at-<br \/>\ntested\tcopy  of  the relevant part of\tthe  electoral\troll<br \/>\nrelating to 67 Sorada Assembly Constituency in which he\t was<br \/>\nan  elector. This was required because he was  standing\t for<br \/>\nelection from a constituency other than the one in which  he<br \/>\nwas  an elector. On an objection by one of  the\t candidates,<br \/>\nthe  said nomination paper was rejected\t for  non-compliance<br \/>\nwith section 33(5) of the Representation of the People\tAct,<br \/>\n1951  (hereinafter referred to as &#8220;the said Act&#8221;). The\tcon-<br \/>\ntention of the appellant is that he had produced before\t the<br \/>\nReturning  Officer an attested copy of the relevant part  of<br \/>\nthe  electoral roll of the constituency in which he  was  an<br \/>\nelector and hence, the rejection of his nomination paper  on<br \/>\nthe ground of non-compliance with section 33(5) of the\tsaid<br \/>\nAct was wrong and bad in law.\n<\/p>\n<p>    As we have already pointed out, it is common ground that<br \/>\nwhat  the appellant produced before the\t Re.turning  Officer<br \/>\nwas  an attested copy of the relevant part of the  electoral<br \/>\nroll  of  the constituency in&#8217; which he was an\telector\t and<br \/>\nthat  copy  admittedly was dated July 13, 1983. There  is  a<br \/>\nfinding\t that  the appellant had obtained the said  copy  on<br \/>\nJuly  19,  1983 although he sought to contend  that  he\t had<br \/>\nobtained it on July 19, 1984. The correctness of that  find-<br \/>\ning  has rightly not been assailed before us. Section 15  of<br \/>\nthe  Representation  of the People  Act,  1950\t(hereinafter<br \/>\nreferred  to as &#8220;the 2950 Act&#8221;) provides that for  any\tcon-<br \/>\nstituency  there shall be an electoral roll which  shall  be<br \/>\nprepared in accordance with the provisions of that Act under<br \/>\nthe directions and supervision of the Election Commission.<br \/>\n    It\tis the admitted position in the case before us\tthat<br \/>\nthe  electoral roll of the Orissa Legislative Assembly,\t was<br \/>\ndirected  to  be  revised and was, in fact,  revised  as  on<br \/>\nJanuary 1, 1984 and the supplementary electoral roll notify-<br \/>\ning  the  changes  to be incorporated on  the  revision\t was<br \/>\npublished and available before February 1985. Section 21  of<br \/>\nthe  1950  Act deals with the preparation  and\trevision  of<br \/>\nelectoral rolls. Sub-section (1) of that section states that<br \/>\nthe  electoral roll for each constituency shall be  prepared<br \/>\nin the prescribed manner by reference to the qualifying date<br \/>\nand  shall come into force immediately upon its\t publication<br \/>\naccording  to  law. Clause (a) of sub-section  (2)  of\tthat<br \/>\nsection\t provides unless otherwise directed by the  Election<br \/>\nCommission  the electoral roll shall be revised in the\tpre-<br \/>\nscribed manner with reference to the qualifying date  before<br \/>\neach  General Election to the House of the People or to\t the<br \/>\nLegislative Assembly of a State. The provisions<br \/>\n<span class=\"hidden_text\">103<\/span><br \/>\nof  Rule  22  of the Registration of  Electors\tRules,\t1960<br \/>\n(hereinafter  referred to as &#8220;the said Rules of 1960&#8221;)\tread<br \/>\nwith  the provisions of Rules 15 to 21-A thereof  show\tthat<br \/>\nwhen  the  electoral  roll has to be revised  the  names  of<br \/>\npersons\t inadvertently omitted have to be included  and\t the<br \/>\nnames  of dead electors and of persons who ceased to  be  or<br \/>\nare  not ordinarily resident in the constituency have to  be<br \/>\ndeleted\t from the electoral roll and so on. After this,\t the<br \/>\nofficer\t concerned  prepares the list of  amendments  to  be<br \/>\ncarried out to the electoral roll. Provisions are also\tmade<br \/>\nfor the correction of any clerical or printing errors in the<br \/>\nearlier roll. After the completion of this task, either\t the<br \/>\nentire\trevised\t electoral  roll is to be  prepared  or\t the<br \/>\namendments  in the existing electoral roll have to  be\tmade<br \/>\nand  incorporated in the electoral roll and published  sepa-<br \/>\nrately\talong with the original electoral roll.\t A  complete<br \/>\nelectoral roll is made available for inspection and a notice<br \/>\nto  that effect is displayed in Form No. 16. Rule  22(2)  of<br \/>\nthe  said Rules of 1960 lays that on such  publication,\t the<br \/>\nroll  together\twith  the list of amendments  shall  be\t the<br \/>\nelectoral  roll of the constituency. Subrule (3) of Rule  22<br \/>\nof the said Rules of 1960 shows that these amendments may be<br \/>\nincorporated and an integrated roll may be published subject<br \/>\nto any general or special directions issued by the  Election<br \/>\nCommission.  It is clear on the reading of these  provisions<br \/>\nthat the publication of the integrated roll is not essential<br \/>\nfor  the revision of the electoral roll to be  complete\t and<br \/>\nthe  electoral roll with the amendments duly  published\t be-<br \/>\ncomes the final electoral roll for the constituency. In\t the<br \/>\npresent\t case, it is clear that what the appellant  produced<br \/>\nbefore the Returning Officer was not an attested copy of the<br \/>\nfinal  electoral  roll\tfor the said  constituency  for\t the<br \/>\nelection in question although the final roll was  available.<br \/>\nWhat he produced was an attested copy of the electoral\troll<br \/>\nas  it\tstood on July 21, 1983 and the\tproduction  of\tsuch<br \/>\nattested copy of the relevant part of the electoral roll  as<br \/>\nit stood before the final revision cannot amount to  compli-<br \/>\nance with the provisions of sub-section (5) of section 33 of<br \/>\nthe said Act. His nomination was, therefore, rightly reject-<br \/>\ned.\n<\/p>\n<p>    We\tare supported in our views by the decision  of\tthis<br \/>\nCourt  in <a href=\"\/doc\/1757866\/\">Ranjit Singh v. Pritam Singh &amp; Ors.,<\/a> [1966] 3\t SCR\n<\/p>\n<p>543. It was held that:\n<\/p>\n<blockquote><p>\t      &#8220;When  S. 33(5) refers to a copy of the  rele-<br \/>\n\t      vant  parts of the electoral roll, it means  a<br \/>\n\t      part  as\tdefined in rule 5. A  complete\tcopy<br \/>\n\t      would carry the various amendments made in the<br \/>\n\t      roll  and enable the Returning Officer to\t see<br \/>\n\t      whether the name of the candidate continued in<br \/>\n\t      the  roll\t for  the  whole  of  the   relevant<br \/>\n\t      period.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">104<\/span><\/p>\n<p>    In\tthe aforesaid judgment, it has been held  that\twhen<br \/>\nsection 33(5) of the said Act refers to a copy of the  rele-<br \/>\nvant part of the electoral roll, it means a part as  defined<br \/>\nin Rule 5 of the said Rules of 1960. The complete copy would<br \/>\ncarry the various amendments made in the roll to enable\t the<br \/>\nReturning  Officer to see whether the name of the  candidate<br \/>\ncontinues in the roll.\n<\/p>\n<p>    Learned counsel for the appellant placed a strong  reli-<br \/>\nance  on the decision of this Court in <a href=\"\/doc\/1066323\/\">Jagannath  Ramchandra<br \/>\nNunekar\t v.  Gene Govind Kadam &amp; Ors.,<\/a>\t[1988]\t3  Judgments<br \/>\nToday 662. That judgment is, however, clearly  distinguisha-<br \/>\nble on facts. In that case, a certified copy of the relevant<br \/>\nentry  in the electoral roll was furnished to the  appellant<br \/>\non January 8, 1986 which was only one day before the date on<br \/>\nwhich he filed his nomination paper. The presumption  would,<br \/>\ntherefore, arise that such a certified copy would be of\t the<br \/>\nrelevant entry in the final electoral roll and that presump-<br \/>\ntion was justified on the actual facts. That decision has no<br \/>\napplication  to\t this  case where a certified  copy  of\t the<br \/>\nrelevant  part\tof the electoral roll was  applied  for\t and<br \/>\nobtained several months before the revision of the electoral<br \/>\nroll.  The  ratio of the judgment cited is,  therefore,\t not<br \/>\napplicable to the case before us.\n<\/p>\n<p>In the result, the appeal fails and is dismissed with costs.\n<\/p>\n<pre>N.P.V.\t\t\t\t      Appeal dismissed.\n<span class=\"hidden_text\">105<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India B.
