The present petition has been preferred by the original<br \/>\n     defendant in Title Suit No. 12 of 2005, whereby, it has been<br \/>\n     submitted by the original defendant that though the stay<br \/>\n     was not granted, as prayed for by the respondent (original<br \/>\n     plaintiff) by the trial court vide order dated October 7, 2005<br \/>\n     and though his appeal being Misc. Appeal No. 1 of 2006 is<br \/>\n     dismissed vide order dated July 21, 2007, the stay has been<br \/>\n     granted to the original plaintiff by self contradictory<br \/>\n     observations, made in the order, passed by the lower<br \/>\n     appellate court and hence this writ petition has been<br \/>\n     preferred under Article 227 of the Constitution of India by<br \/>\n     the original defendant.\n<\/p>\n<p>2.   Having heard learned counsel appearing for both the sides<br \/>\n     and looking to the facts and circumstances of the case:\n<\/p>\n<p>     (i)     It appears that the present petitioner is the original<br \/>\n             defendant in Title Suit No. 12 of 2005. The suit has<br \/>\n             been filed for declaration of title and confirmation of<br \/>\n             possession and also for grant of permanent injunction.\n<\/p>\n<p>     (ii)    It also appears from the facts of the case that the<br \/>\n             respondent, who is the original plaintiff, had also<br \/>\n             preferred stay application in his Title Suit. This stay<br \/>\n             application was dismissed by the trial court vide order<br \/>\n             dated October 7, 2005. Both the sides are claiming<br \/>\n             title over the properties and both want to make<br \/>\n             construction upon the same.\n<\/p>\n<p>     (iii)   It appears that being aggrieved and dissatisfied with<br \/>\n             the order, passed by the trial court upon the stay<br \/>\n             application, a Misc. Appeal bearing Misc. Appeal No. 1<br \/>\n             of 2006 was preferred by original plaintiff, before the<br \/>\n             5th Additional District Judge, Singhbhum East at<br \/>\n             Jamshedpur, who dismissed the appeal vide order<br \/>\n<span class=\"hidden_text\">                                           2.<\/span><br \/>\n                    dated July 21, 2007 (Annexure 2 to the memo of<br \/>\n                    present petition).\n<\/p>\n<p>             (iv)   It appears that the appellate order is in favour of the<br \/>\n                    present petitioner (original defendant) but in the last<br \/>\n                    paragraph i.e. paragraph no.12 of the order it has<br \/>\n                    been observed as under:\n<\/p>\n<p>                       &#8220;Therefore, I find and hold that there is no merit in this<br \/>\n                       appeal and it fails and accordingly, dismissed. Since both<br \/>\n                       sides are claiming their right, title and possession over the<br \/>\n                       suit land. Thus, under the fact and circumstances, both<br \/>\n                       parties are directed to maintain status-quo over the suit<br \/>\n                       land till the disposal of the T.S.no. 12\/05 for the ends of<br \/>\n                       justice.&#8221;\n<\/p>\n<p>      3.     Thus, it appears that the lower appellate court has<br \/>\n             confirmed the order, passed by the trial court and dismissed<br \/>\n             the appeal and simultaneously he has also granted stay in<br \/>\n             favour of the original plaintiff. Two things at a time is not<br \/>\n             possible and permissible. Either appeal should be allowed<br \/>\n             and the stay should be granted or appeal should be<br \/>\n             dismissed and the order of trial court should be confirmed.\n<\/p>\n<p>      4.     In these set of circumstances, I hereby remand the matter to<br \/>\n             5th    Additional     District     Judge,   Singhbhum       East    at<br \/>\n             Jamshedpur, for his fresh decision upon Misc. Appeal No. 1<br \/>\n             of 2006. It is not clear from the impugned order whether the<br \/>\n             appeal is partly allowed or fully dismissed, looking to<br \/>\n             paragraph     no.12     of   the    impugned    order,    as   quoted<br \/>\n             hereinabove.\n<\/p>\n<p>      5.     In view of these facts, the impugned order is hereby quashed<br \/>\n             and set aside with the aforesaid directions. The Misc. Appeal<br \/>\n             shall be decided by the lower appellate court as expeditiously<br \/>\n             as possible and practicable within a period of twelve weeks<br \/>\n             from the date of receipt of a copy of the order, passed by this<br \/>\n             Court. Fresh decision, will be taken by the lower appellate<br \/>\n             court, without being influenced by the earlier order, passed<br \/>\n             at Annexure-2 to the memo of present petition and it shall be<br \/>\n             decided on its own merits, looking to the facts and<br \/>\n             circumstances of the case and the evidence etc.\n<\/p>\n<p>      6.     The writ petition stands disposed of accordingly.\n<\/p>\n<p>                                                            (D.N.
