*._notice’d_ that certain facts are not mentioned in the<\/p>\n
 \ufb01led an application seeking permission to amend<\/p>\n
 plaint. The application was opposed by the<\/p>\n

WP No.65908 of 2009<\/p>\n
respondent. After hearing the arguments, the ff_’a__mi1y
\nCourt erred in rejecting the same. He further
\nthe proposed amendment with regard to
\nand cruelty by the responde”nt\/deferidanf’TI,
\nincorporated, the plaintiff  <\/p>\n
loss and injury.\n<\/p>\n
3. Perused theta’  The present
\npetitioner hasfiied pp against the
\nrespondent4’hi’i\u00absVEda1i’d.ii   in the impugned
\norder that   framed and trial has
\ncommenced,’  has not shown any<\/p>\n
circumstarmes’ of ‘such a”nature to permit her to amend<\/p>\n
  as priop’*’—-se’d. In View of the amended proviso<\/p>\n
 to 17 of the Code of Civil Procedure, the<\/p>\n
triaJ_riCourt held that there is no prima facie case<\/p>\n
i\ufb01rnade  for allowing the amendment application. The<\/p>\n
 Court, on appreciation of the material placed on<\/p>\n
C   Wreicord, came to the conclusion that there is no merit in<\/p>\n
WP No.65908 of 2009<\/p>\n
the amendment application and rejected I.A.No.1I._.~I__ see
\nno illegality or infirmity in the impugned order. T  ‘V
