Sheosagar, District Rohtas.\n                                                                               ---------- Petitioner\n                                                       Versus\n                    The State Of Bihar\n                                                                        -------- Opposite Party\n                                                    --------------\n<\/pre>\n<p>02\/-   12\/09\/2011                       Heard learned counsel for the petitioner and learned<\/p>\n<p>                         Additional Public Prosecutor for the State.<\/p>\n<p>                                        The petitioner apprehends his arrest in connection<\/p>\n<p>                         with a case registered for the offence punishable under Sections<\/p>\n<p>                         341, 323\/34 of the Indian Penal Code and Section \u00be (x) SC\/ST<\/p>\n<p>                         Act, is one of the two named accused in this case of simple assault<\/p>\n<p>                         and abuse.\n<\/p>\n<p>                                        Submission is that this case has been filed in<\/p>\n<p>                         retaliation of earlier filed case being Sheosagar P.S. Case No. 69<\/p>\n<p>                         of 2011. Moreover, the case appears squarely covered under a<\/p>\n<p>                         decision of Hon&#8217;ble Apex Court in a case of &#8220;Jorgia Pentiah Vs.<\/p>\n<p>                         State of Andhra Pradesh reported in 2009 (1) BCCR 153<\/p>\n<p>                         (SC)&#8221;.\n<\/p>\n<p>                                        Considering the facts and circumstances of the case,<\/p>\n<p>                         in the event of his arrest\/surrender before the court below within<\/p>\n<p>                         four weeks, let the above named petitioner be enlarged on bail on<\/p>\n<p>                         furnishing bail-bond of Rs. 10,000\/- (ten thousand only) with two<\/p>\n<p>                         sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                         Judicial Magistrate, Rohtas at Sasaram, in connection with<\/p>\n<p>                         Sheosagar P.S.
