     The appellant  is a  Sainideclared\t us  of\t the  other
\nbackward classin the State ofHaryanaa notification dated
\n5.2.1991.   This notification  inter, providesthat persons
\nbelonging   to the Saini caste and residing in the  state of
\nHaryanawill  be considered  asforming  a  part otherback
\nclassesin the state ofHaryana.\n<\/p>\n
     Two advertisement bearing\tNo.1 of\t 1995and  No.7 of
\n1995 were  issued by  the    Subordinate  Service  Selection
\nBoard, haryanafor recruitment of candidates to\tvarious
\nposts.One of the posts so advertised was  that of lectures
\nin political   science. under Advertisement No.1 of 1995 15
\nposts of lecturers  in political science  were advertised of
\nwhich  one   was  reserved   for  backward   classes.  Under
\nAdvertisement No.7  of 1995,   inter  alia,  48 posts  of
\nlectures in  political sciencewere advertisedout of which
\n10 were reserved for backward classes.Out of these 10, six
\nwere reserved for backward  classes inthe “A”category and
\nfour were reserved for backwardclassesin the ‘B’ category.
\nAfter the  Advertisement  1 of 1995 andbefore Advertisement
\n7 of 1995, instructionwere issued  bythe Chief Secretary,
\nGovernment of Haryana to all heads of departments  and other
\nauthorities stating   that  thereservation    for  backward
\nclasseswas   enhancedfrom 10%  to 27%\tandthat amongst
\nbackward classes,  it was  decided tocreatetwo\tblocks,
\nBlock ‘A’  and 11% would be reserved for backward classes in
\nBlock ‘B’  and 16%  of seats would be reserved for  backward
\nclassesin Block `A’ and 11% would be reserved for  backward
\nclassesin  Block ‘B’  There was also  a reservation  of 10%
\nfor ex-servicemen   and 3%  for\t physicallyhandicapped.
\nCastes forming part  of Block’A’ andcastes formingpart
\nof Block  ‘B’ were enumerated.Saini caste wasin Block ‘B’
\nthat is why the\t advertisement7\t of 1995  divided the ten
\nseats for   backward   classesinto six\tseatsfor backward
\nclass candidates  in Block  ‘A’and  4 seats   for  backward
\nclass candidates  in Block  ‘B’ Afterthese  instructions,
\ntherefore, theappellant formed a partof Block ‘B’ amongst
\nbackward classes.\n<\/p>\n
     The appellant  applied for the  post  oflecturer  in
\npolitical   science. Both   theadvertisementswere clubbed
\ntogether in  selectionof candidates Advertisement No.7 of
\n1995 stated  that the  post which  were\t  advertised  under
\nAdvertisement No.7  of 1995  were in  additionto the posts
\nadvertised under  Advertisement\t 1 of1995 need\tnot apply
\nagain. Their  previous application would be considered.Thus
\napplication   under   both these  advertisementwere clubbed
\ntogether, candidates   were  interviewed and selected taking
\ninto   account theapplicationsunder both  these
\nadvertisements.The  appellant was  not of  the\tcandidates
\nselected   in the  backward class category.  Inthe order of
\nmerit, he  was at  serial No.  5 in  Block ‘B’of  selected
\nbackward classcandidates. Hewas\t  gives\t an appointment
\nletter dated  4.4.196. Pursuant to his\t appointment, the
\nappellant jointed  his post on\t18.4.1996.However,  he
\nreceived a  registered letter  dated 11.6.1996 statingthat
\nthere had  beenan   error  in issuinghim   an appointment
\nletter and  theappointment  letter   was  being\t withdrawn.
\nAccording to  the respondent  there wasan error in granting
\nan appointmentto the appellant\tbecause theone\tpost of
\nbackward  class\t  candidatewhich was  advertised  by
\nAdvertisement 1 of 1995\t was erroneously considered bythem
\nas forming a part of Block ‘B’ while  it should have formed
\na partof Block\t‘A’ Hence  the appointment  given  to the
\nappellant  was withdrawn.  The appellant has challengedthis
\nfinding. He hasalso  urged that prior to his being selected
\nand appointed  he  washolding the  post\t oflecturer  in
\npolitical science  in Rajdevi  Multi-PurposeCollege for
\nWomenBehrian.  He resigned from\t his post in order to
\naccept the  appointment\t  offered  to him on his  selection
\npursuant to  the Advertisements 1 and 7 of 1995.  Now he is
\ndeprived   of both  these posts.  He  has alsostatedthat
\nhe is  a physically handicapped personand a  a sympathetic
\nview should be taken ofhis situation.\n<\/p>\n
     Under Advertisement 1 of 1995. 15 posts oflecturers in
\npolitical  science   were   advertised\t  while\t     under
\nAdvertisement 7 of 1995\t 48 posts of lecturersin political
\nsciencewere  advertised, making\t  of  total   of 63  posts.
\nSince applicants  of all these 63 posts were considered for
\nselection after the coming   into   force  ofinstructions
\ndated 20.7.1995,  we will  have\t to take  into account the
\nroster prepared\t under these instructions for reservation
\nof posts   forBlock  ‘A’  and Block’B’\tbackward  class
\ncandidates.  As per  the  roster  which\t forms a  part\tof
\ninstructions issued  on20th  of July,1995  the\tfollowing
\nroster points  are preserved  for   candidates belonging  to
\nBlock ‘B’.\n<\/p>\n
     Block “B’
\n     “9-18-27  (ESM)  -63-46-54(ESM)-63-\n<\/p>\n
     72-81 (ESM) -89(PH)-98″\n<\/p>\n
     Sixty three  postsof  lecturers in\t political  science
\nwere being  filled fifteen under Advertisement 1 of 1995 and
\nforty  eighty under advertisement 7 of 1995.  We will ignore
\nroster points  27 and  54 whichare for ex-servicemen.Thus
\nupto and  including   serial No.  63, five  roster point are
\nreserved is  atSerial No.5  inthe  merit list of backward
\nclass candidates   belonging  to Block ‘B’ Theappellant is
\nat  Serial   No.5  in  the  merit  list of  backward  class
\ncandidates belonging  to Block’B’ Therefore, the letter of
\nappointment  was   rightly  issued  tothe  appellant. The
\nrespondents were  required to consider the total of 63 posts
\nadvertised andgive roster   points  in accordance with the
\nroster which  forms a part of the instructions of 20th July,
\n1995. If  this is   how the appointments are examined, the
\nappellant has  been property  selected and   appointed. The
\ntermination ofthe appellant’s  service, therefore  is not
\njustified.\n<\/p>\n
     The appeal is accordingly allowed and the respondents
\nare directed   to  continue  the  appellant  in service\t in
\nservice. the  appellantshall  be accommodatedin the first
\navailable vacancy   fora backward class candidate belonging
\nto ‘B’category at  roster  point 63.There will, however,
