Justice J.M.JAMES\n\n Dated :09\/02\/2007\n\n O R D E R\n                             J.M.JAMES, J.\n\n                              -------------------\n\n                           Crl.A.791\/2003 (B)\n\n                              --------------------\n\n               Dated this  the 9th day of February, 2007\n\n\n                              JUDGMENT\n<\/pre>\n<p>                The   counsel   as   well   as   the   complainant   were<\/p>\n<p>absent   before   the   Court   below,   when   the   complaint,<\/p>\n<p>preferred   under   Section   138   of   the   Negotiable<\/p>\n<p>Instruments   Act,   in   short   &#8216;the   Act&#8217;,   was   taken   up.<\/p>\n<p>Therefore,   the     accused   was   acquitted.     After   obtaining<\/p>\n<p>special leave,  the complainant had filed this appeal.<\/p>\n<p>         2.     The   only   ground   urged   by   the   learned  counsel<\/p>\n<p>for   the   appellant   is   that   the   clerk   of   the   advocate   had<\/p>\n<p>noted the date wrongly and, therefore, neither the counsel<\/p>\n<p>nor   the   complainant   could   be   present   on   the   appointed<\/p>\n<p>date.\n<\/p>\n<\/p>\n<p>         3.     After considering the materials on record,  I am<\/p>\n<p>of   the   opinion   that   an   opportunity   be   given   to   both   the<\/p>\n<p>parties   to   establish   their   contentions,   on   adducing<\/p>\n<p>evidence.   To enable the same,   I am inclined to set aside<\/p>\n<p>the impugned order.\n<\/p>\n<p>\nCrl.A.791\/2003<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>        4.    In   view   of   the   above   facts   situation,     I   set<\/p>\n<p>aside   the   impugned   order   dated   13.2.2003   and   restore<\/p>\n<p>C.C.No.144\/2002  to the file of the Judicial Magistrate of<\/p>\n<p>First   Class-V   (Special   Court   for   Mark   list   Cases),<\/p>\n<p>Thiruvananthapuram.               The   learned   Magistrate   is<\/p>\n<p>directed   to   dispose   of   the   same,   within   three   months<\/p>\n<p>from the date of appearance of the parties.<\/p>\n<p>        5.
