The State of U.P.\n\nHon'ble Raj Mani Chauhan, J.\n<\/pre>\n<p>       Learned A.G.A. files counter affidavit, which is taken on record.\n<\/p>\n<p>       Heard the learned counsel for the applicants and learned A.G.A. for the<br \/>\nState as well as perused the documents available on the record.\n<\/p>\n<p>       The accused-applicants Girija Shankar Verma and Amarjeet Verma are<br \/>\ninvolved and detained in Case Crime No. 961 of 2009, under Sections 147,<br \/>\n304, 308, 323, 325, 504, 506 I.P.C., from Police Station Tarun, District<br \/>\nFaizabad and they have applied for bail.\n<\/p>\n<p>       The submission of the learned counsel for the accused applicants is that<br \/>\nthe co-accused Jang Bahadur Verma, Ram Karan Yadav and Kalawati Devi<br \/>\nhave already been ordered to be released on bail by another Bench of this<br \/>\nCourt, vide order dated 29.4.2010, passed in Criminal Misc. Case No. 1794<br \/>\n(B) of 2010, order dated 27.4.2010, passed in Criminal Misc. Case No. 3264<br \/>\n(B) of 2010 and the order dated 25.2.2010, passed in Criminal Misc. Case No.<br \/>\n1581(B) of 2010 respectively. The role of the present accused applicants is<br \/>\nsimilar to the role of co-accused Jang Bahadur Verma and Ram Karan Yadav,<br \/>\nwho have already been ordered to be released on bail. Therefore, accused<br \/>\napplicants also deserve to be released on bail.\n<\/p>\n<p>       Learned A.G.A. assisted by the learned counsel for the complainant<br \/>\nopposed the bail applicant of the accused applicants. Learned counsel for the<br \/>\ncomplainant argued that on the pointing out of the present accused applicants,<br \/>\nFawda and lathi were recovered by the Investigating Officer from their house.<br \/>\nTheir case stands on different footing. Therefore, they do not deserve to be<br \/>\nreleased on bail.\n<\/p>\n<p>       Considered the submissions of the learned counsel for the accused<br \/>\napplicants and the learned A.G.A. as well as learned counsel for the<br \/>\ncomplainant.\n<\/p>\n<p>       The prosecution allegation against the accused applicants and co-<br \/>\naccused Jang Bahadur Verma and Ram Karan Yadav is same who have already<br \/>\nbeen ordered to be released on bail.
