District &amp; Addl. Sessions Judge, Fast<br \/>\nTrack Court No. 4, Rajkot in Regular Civil Appeal No. 54 of 1992<br \/>\nwhereby, the said appeal was dismissed and the judgment and decree<br \/>\ndated 11.06.1990 passed by the learned Judge of the Small Causes<br \/>\nCourt, Rajkot in Rent Suit No.75 of 1984 was confirmed.\n<\/p>\n<p>2.0\tThe<br \/>\nfacts in brief are that the respondent no. 1 [deceased], original<br \/>\nplaintiff, filed a suit being Rent Suit No.75 of 1984 against the<br \/>\npetitioners, original defendants, for the recovery of an amount of<br \/>\nRs.6550\/- towards the arrears of rent and to get vacant and peaceful<br \/>\npossession of the property bearing Bungalow No. 64 situated in<br \/>\nMalaviyanagar area of Rajkot City. The said suit was decreed in<br \/>\nfavour of the respondent, original plaintiff.\n<\/p>\n<p>2.1\tBeing<br \/>\naggrieved by the said order, the petitioners preferred an appeal<br \/>\nbefore the District Court. However, the appeal preferred by the<br \/>\npetitioners came to be rejected by the impugned judgment and order.<br \/>\nHence, this revision.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties. After appreciating the<br \/>\nentire oral as well as documentary evidence available on record, the<br \/>\nCourt below has come to the conclusion that the respondent, original<br \/>\nplaintiff, was in genuine need of the suit premises. In my opinion,<br \/>\nthe Court below has rightly decreed the suit in favour of the<br \/>\noriginal plaintiff as she was in bona fide need of the suit premise<br \/>\nand she would suffer greater hardship, if the same was not granted to<br \/>\nher.\n<\/p>\n<p>4.\tApart<br \/>\nfrom that it also appears from the record that the petitioner,<br \/>\noriginal defendants, had not made any attempts, much less any serious<br \/>\nattempts to say so, to search for any alternative premise for their<br \/>\naccommodation.\n<\/p>\n<p>5.\tThus,<br \/>\nlooking to the entire evidence on record and keeping in mind the fact<br \/>\nthat the original plaintiff was not keeping good-health, at the<br \/>\nrelevant point of time, I am of the view that the Court below was<br \/>\ncompletely justified in decreeing the suit in her favour. I am in<br \/>\ncomplete agreement with the concurrent findings recorded by both the<br \/>\nCourts below and hence, find no reasons to interfere in this<br \/>\nrevision.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the revision is dismissed. Time to vacate the<br \/>\nsuit premise is granted up to  31.08.2009 on condition<br \/>\nthat the petitioners will file an Undertaking before this Court,<br \/>\nwithin a period of three weeks from today, to the effect that they<br \/>\nwill vacate the suit premise before 31.08.2009 and that they will<br \/>\ncontinue to pay mesne profits regularly till the said date.
