The State Government of Kerala introduced<br \/>\nthe Land  Reforms Bill,\t 1963 on  April 1,  1964. One of the<br \/>\nclauses relates\t to taking  away  exemption  of\t cashew\t nut<br \/>\nestate or its conversion from the purview of the Kerala Land<br \/>\nReforms Act,  1963 [for short, &#8216;the Act&#8217;]. The Bill was made<br \/>\nAct 35\tof 1969\t with effect  from January  1, 1970. Section<br \/>\n82(4) of  the Act declares that where after the commencement<br \/>\nof the\tAct, any  class of land specified in Schedule II has<br \/>\nbeen converted\tinto any  other class  of land\tspecified in<br \/>\nthat Schedule  or into\ta plantation,  the  extent  of\tland<br \/>\nliable to  surrendered by  a person  owning or\tholding such<br \/>\nland shall  be determined  without taking into consideration<br \/>\nsuch conversion. Section 84 (1) reads thus :\n<\/p>\n<blockquote><p>     &#8220;84. Certain  voluntary transfers\tto be<br \/>\n     null and  void.  &#8211;\t (1)  Notwithstanding<br \/>\n     anything contained\t in any\t law for  the<br \/>\n     time  being   in  force,  all  voluntary<br \/>\n     transfers effected\t after\tthe  date  of<br \/>\n     publication of  the Kerala\t Land Reforms<br \/>\n     Bill, 1963,  in the  Gazette,  otherwise<br \/>\n     than &#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t  (i) by way of partition; or<br \/>\n\t  x\t x\t x\t x\t  x\n<\/p><\/blockquote>\n<blockquote><p>\t  (iii) in favour of a person who was<br \/>\n\t  a tenant  of the holding before the<br \/>\n\t  27th July,  1960, and\t continued to<br \/>\n\t  be so till the date of transfer;\n<\/p><\/blockquote>\n<blockquote><p>\t  x\t x\tx\t  x\t   x<br \/>\n     by a  family or any member thereof or by<br \/>\n     an\t adult\tunmarried  person  owning  or<br \/>\n     holding land  in excess  of the  ceiling<br \/>\n     area or otherwise than by way of gift in<br \/>\n     favour of his son or daughter or the son<br \/>\n     or daughter  of his  pre-deceased son or<br \/>\n     daughter by any person owning or holding<br \/>\n     land in excess of the ceiling area shall<br \/>\n     be deemed\tto be transfers calculated to<br \/>\n     defeat the\t provisions of\tthis Act  and<br \/>\n     shall be invalid. &#8220;<\/p><\/blockquote>\n<p>\t\t\t (Emphasis supplied )<br \/>\n     The voluntary sale is not one of the exempted transfers<br \/>\nmentioned in Section 84(1). On the other hand, all voluntary<br \/>\ntransfers other\t than those excepted, should be deemed to be<br \/>\ntransfers calculated to defeat the provisions of the Act and<br \/>\nshould be  invalid. The\t question, therefore, is whether the<br \/>\nland purchased\tby the respondent was intended to defeat the<br \/>\npurposes of the Act and is invalid.\n<\/p>\n<p>     <a href=\"\/doc\/1986077\/\">This Court P.J. Thomas vs. Taluk Land Board and Others.<\/a><br \/>\n[(1993 )  Supp. (1)  SCC 300  ] considered  the question  of<br \/>\ntransfer and  conversion under\tSection 82(4)  and held that<br \/>\nthe conversion\tof cashew  estate also will not be saved and<br \/>\nit will\t come squarely\twithin the mischief of Section 84(1)<br \/>\nof Act.\t This is what the Court held : &#8220;The transfer falling<br \/>\nunder Section 84 cannot be equated to the conversion falling<br \/>\nunder Section  82(4). The  ceiling provisions  contained  in<br \/>\nSections 82  and 83  came into force on January 1, 1970. The<br \/>\ncomputation of the ceiling area has to be made in accordance<br \/>\nwith the  provisions contained\tunder Section 82 as it stood<br \/>\non January  1, 1970.  Under Section 82(4) where any class of<br \/>\nland specified\tin Schedule  II has  been converted  into  a<br \/>\nplantation after  the commencement of the Act, the extent of<br \/>\nthe land  liable to  be surrendered  by a  person owning  or<br \/>\nholding such  land has\tto be determined without taking into<br \/>\nconsideration such  conversion.\t Cashew\t estate\t is  a\tland<br \/>\nspecified in  Schedule II  as on April 1, 1964 as well as on<br \/>\nJanuary 1,  1970. Therefor,  the conversion of cashew estate<br \/>\nafter  April  1,  1964\tand  before  January  1,  1970\tinto<br \/>\nplantation would  squarely come\t under the  mischief of this<br \/>\nsub-section&#8221;.\n<\/p>\n<p>     The facts\tof this\t case stand on a higher footing than<br \/>\nthe facts  therein. In this case, section 84(1) specifically<br \/>\ndeclares such  voluntary transfers  to be  invalid. In other<br \/>\nwords, such transfers are void and of no effect. Admittedly,<br \/>\nthe transfer  was  effected  within  the  prohibited  period<br \/>\nnamely between April 1, 1964 and January 1, 1970. Therefore,<br \/>\nthe sale is a void sale. Thereby the respondents cannot save<br \/>\nthe cashew  land purchased  under the  void  sale  from\t the<br \/>\npurview of the Act.\n<\/p>\n<p>     Mr. Balakrishnan,\tlearned counsel\t for the respondent,<br \/>\nthen sought  to rely  on Section  85 (1) explanation (a) and<br \/>\ncontended that\tthe respondent having purchased the land was<br \/>\ntransferee under  the transfer and, therefore, his rights in<br \/>\nthe land  were not affected but the extent of land purchased<br \/>\ncan be\tcalculated for\tfixing the  extent  of\tland  to  be<br \/>\nsurrendered and\t the company should be directed to surrender<br \/>\nexcess land  excluding the  land under\tthe sale. We fail to<br \/>\nappreciate the\tcontention. The\t purpose of  Section  85(1),<br \/>\nclause (a)  to the  Explanation seems to be that such of the<br \/>\ntransfers effected within the prohibited period and saved by<br \/>\nsub-s. (1)  of Section 84 were treated to be valid transfers<br \/>\nand to\tthat  extent  they  cannot  have  any  effect  while<br \/>\ndirecting  surrender  of  the  excess  land.  But  voluntary<br \/>\ntransfers which\t are void,  cannot be saved in computing the<br \/>\nexcess land under Section 85 of the Act. Therefore, the High<br \/>\nCourt was  clearly in  error in\t its judgment dated June 27,<br \/>\n1989 in\t C.R.P. No.  879\/89 that  the lands  get exempted by<br \/>\nclause (a) to the Explanation to Section 85 (1) of the Act.\n<\/p>\n<p>     Mr. Balakrishnan  also seeks to place reliance on <a href=\"\/doc\/928175\/\">State<br \/>\nof Kerala vs. Philomina<\/a> etc. etc. &amp; Ors., [(1977 ) 1 SCR 273<br \/>\n]. The\tratio therein  was also\t considered and explained by<br \/>\nthis Court  in P.J.  Thomas&#8217;s case  (supra). We respectfully<br \/>\nagree with the reasoning in Thomas case.\n<\/p>\n<p>     The appeal is accordingly allowed.
