Tiwary, APP<br \/>\n                                           *******<\/p>\n<p>05.   29.08.2011             Supplementary affidavit has been filed on<\/p>\n<p>                   behalf of the petitioner.\n<\/p>\n<\/p>\n<p>                             Heard learned counsel for the petitioner<\/p>\n<p>                   and learned Additional Public Prosecutor for the<\/p>\n<p>                   State.\n<\/p>\n<\/p>\n<p>                             The petitioner, apprehends his arrest in<\/p>\n<p>                   connection with Complaint Case No. 4(C)\/1999,<\/p>\n<p>                   Trial No. 1286\/99, pending in the court of Judicial<\/p>\n<p>                   Magistrate, Rachna Raj, Patna, is one of the two<\/p>\n<p>                   named accused in this twelve years old complaint<\/p>\n<p>                   case with allegation of purchasing a car by diverting<\/p>\n<p>                   the fund allotted for other purposes.<\/p>\n<p>                             Submission is that the car is still under<\/p>\n<p>                   custody of the board. Moreover, for last several years<\/p>\n<p>                   further proceeding of the court below remained<\/p>\n<p>                   stayed vide order dated 28.02.2000 passed in Cr.<\/p>\n<p>                   Misc. No. 33502\/1999, through which quashing of<\/p>\n<p>                   the complaint case was sought but ultimately vide<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          order dated 25.06.2010, due to absence of the<\/p>\n<p>          petitioner an another (both the accuseds). It was<\/p>\n<p>          dismissed with certain observations made therein.<\/p>\n<p>                     Considering the facts and circumstances of<\/p>\n<p>          the case, especially much delay already caused, in<\/p>\n<p>          the event of his arrest or surrender within a period<\/p>\n<p>          of four weeks, let the above-named petitioner be<\/p>\n<p>          enlarged on bail on furnishing bail bond of sum of<\/p>\n<p>          Rs. 10,000\/- (ten thousand only) with two sureties<\/p>\n<p>          of the like amount each to the satisfaction of<\/p>\n<p>          Judicial   Magistrate,     Rachna    Raj,   Patna,   in<\/p>\n<p>          connection with Complaint Case No. 4(C)\/99, Trial<\/p>\n<p>          No. 1286\/99, subject to condition under section<\/p>\n<p>          438(2) of the Code of Criminal Procedure, and<\/p>\n<p>          additional condition to attend the court regularly at<\/p>\n<p>          least for three years or till disposal of the case,<\/p>\n<p>          whichever is earlier and in the event of failure on two<\/p>\n<p>          consecutive     dates,     without   any    reasonable<\/p>\n<p>          explanation, the privilege granted shall be deemed to<\/p>\n<p>          be cancelled.\n<\/p>\n<\/p>\n<pre>Rajeev\/                         ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nehaluddin vs The State Of Bihar on 29 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.17956 of 2011 Nehaluddin Versus The State Of Bihar &#8212;&#8212;&#8212;&#8212; For the petitioner : Mr. Rasid Izhar, Adv.
