Govt. Pleader for the appellant State. Mr.<br \/>\nChirag Patel, learned advocate for respondent No.1, is absent when<br \/>\nthe matter is called out. On behalf of Mr. S.B. Vakil, Senior<br \/>\nAdvocate, it is submitted that he is now not appearing for respondent<br \/>\nNo.1.  None appears for respondent No.2.\n<\/p>\n<p>\tOn 04.09.08, it<br \/>\nwas pointed out by Mr. Chirag B. Patel,  learned advocate appearing<br \/>\nfor respondent No.1 that the present appeal has become infructuous as<br \/>\nArbitration Tribunal has started hearing the dispute referred to it<br \/>\nfor the very subject matter.  Thereupon, learned AGP sought time to<br \/>\ntake instructions from the concerned department and the matter was<br \/>\nadjourned for this purpose.\n<\/p>\n<p>\tToday, Ms. Tanuja<br \/>\nKachchhi, learned Asst. Govt. Pleader appearing for the appellant has<br \/>\nplaced before this Court xerox copy of a communication addressed to<br \/>\nthe Government Pleader&#8217;s Office by Executive Engineer, Irrigation<br \/>\nProject Division, Modasa to the effect that the entire matter is<br \/>\npending before the Arbitration Tribunal, Ahmedabad and the Reference<br \/>\nis being tried as TAR No. 36 of 1997 and there is no need to<br \/>\nprosecute the First Appeal further.
