Therefore, they have a legitimate right to participate,<br \/>\nvote and contest the election to the Board of Trustees as per Clause<br \/>\n9(1) of the Constitution of the said Trust.\n<\/p>\n<p>4.\tIt<br \/>\nis not in dispute that the applicants herein were not a party to the<br \/>\nproceedings before the first authority. They were also not party to<br \/>\nthe proceedings of First Appeal or in that case the Civil Application<br \/>\nin which the order under review came to be passed.\n<\/p>\n<p>5.\tIt<br \/>\nis apparent from the order under review dated 30.12.2010 that it was<br \/>\npassed on the basis of a consensus that was arrived at between the<br \/>\nparties during the course of hearing of the Civil Application.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above factual scenario, I do not find any reasons to<br \/>\nentertain this application. If the rights of the applicants are<br \/>\nreally affected, then it is open to them to challenge the order under<br \/>\nreview by filing appropriate proceedings before appropriate forum.<br \/>\nHence, this application is not entertained and is, accordingly,<br \/>\nrejected.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
