NO. 27708  OF 2003\n\n                                  ---------------------\n\n\n               Dated this the 15th day of December, 2006\n\n\n                                    J U D G M E N T\n<\/pre>\n<p>        The writ petition is filed with the following prayers:-\n<\/p>\n<blockquote><p>             &#8220;(a)   To   issue   a   writ   of   mandamus   commanding   the<\/p>\n<p>             respondents   not   to   recover   any   amount   alleged   to   be<\/p>\n<p>             concession   of   house   rent   granted   to   the   petitioner,   from<\/p>\n<p>             his salary.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             (b) To issue a direction to the 1st   respondent   to consider<\/p>\n<p>             and pass appropriate orders on Exhibit P1 representation.&#8221;<\/p>\n<\/blockquote>\n<p>        The   main   contention   of   the   petitioner   is   that   while   passing   Ext.P2,<\/p>\n<p>Ext.P1 was not considered.  There is no counter affidavit despite an interim<\/p>\n<p>order ever since 29.8.03.  There will be a direction to the 1st respondent to<\/p>\n<p>consider Ext.P1, with notice to the petitioner, and pass appropriate orders<\/p>\n<p>thereon in accordance with law untrammelled by the stand taken in Ext.P2,<\/p>\n<p>within   a   period   of  four   months   from   the   date   of   receipt   of   a   copy  of  this<\/p>\n<p>judgment.     The   interim   order   passed   by   this   Court   will   continue   till   such<\/p>\n<p>time.
