These\nhouses\twere sold to the second appellant with the  sanction\nof  the court.\tThe second appellant thereafter\t transferred\nthe houses to the first appellant reciting in the deed\tthat\nthe  latter was the real owner and that the sale  deed\tfrom\nthe  Official Liquidator was obtained benami for  him.\t The\nOfficial Liquidator moved the High Court at Allahabad for an\norder declaring the sale null and void and for an order\t re-\ntransferring the houses to the Bank.  A\n476\nsingle judge of the High Court held that the first appellant\nbeing  at  the material time a member of  the  committee  of\ninspection  and\t he  having  suppressed\t that  interest\t was\nprecluded from buying the property of the Bank and  directed\nthe  first appellant to convey the houses  to  the  Official\nLiquidator  of\tthe  Bank.  This order was  confirmed  by  a\nDivision  Bench of the High Court in appeal under cl. 10  of\nthe Letters Patent.  The High Court then certified the\tcase\nunder  Art.  133 (1) (a) of the Constitution ,or  appeal  to\nthis  Court.  It was urged at the hearing of the  appeal  on\nbehalf\tof  the\t Official Liquidator  that  the\t appeal\t was\nincompetent, for the High Court had no jurisdiction to grant\nthe  certificate under art. 133 (1) (a) of the\tConstitution\nwithout certifying that the appeal involved some substantial\nquestion of law.\nHeld,  that  under  Art. 133 (1)  of  the  Constitution\t the\nexpression 'Court immediately below' has not the same conno-\ntation\tas  the expression 'Court subordinate  to  the\tHigh\nCourt' and as the judgment of the Single judge was  affirmed\nin  appeal,  the appeal to the Supreme Court  could  not  be\nentertained with a certificate under Art. 133 (1) (a) unless\nit was certified that it involves some substantial  question\nof law.\nDeoki  Nandan  v. -State of U. The judgment of the Court was delivered<br \/>\nby<br \/>\nSHAH  J.-The Banaras Bank Ltd-hereinafter called &#8216;the  Bank&#8217;<br \/>\nwas  directed to be wound up by order of the Allahabad\tHigh<br \/>\nCourt.\t A  committee of inspection was appointed  under  s.<br \/>\n178-A  of  the Indian Companies Act, 1913 to  act  with\t the<br \/>\nOfficial Liquidator, and one of the members of the Committee<br \/>\nwas  Durga Prasad the first appellant in this  appeal.\t The<br \/>\nOfficial  Liquidator  advertised for sale two  houses  which<br \/>\nformed\tpart  of  the assets of the Bank.   Roshan  Lal\t the<br \/>\nsecond\tappellant made an offer to purchase the\t two  houses<br \/>\nfor  Rs. 18,000\/-.  This offer was accepted by the  Official<br \/>\nLiquidator and with the sanction of the Court the two houses<br \/>\nwere  sold  to\tRoshan Lal on August 2,\t 1941.\t Roshan\t Lal<br \/>\nthereafter  transferred the houses to Durga Prasad  reciting<br \/>\nin  the\t deed that the latter was &#8220;the real  owner&#8221;  of\t the<br \/>\nhouses\tand that the sale deed from the Official  Liquidator<br \/>\nwas obtained by him &#8220;benami&#8217; for Durga Prasad.\tOn coming to<br \/>\nlearn  about this conveyance, the Official Liquidator  moved<br \/>\nthe  High Court of Allahabad for an order that the  sale  be<br \/>\ndeclared null and void and that Durga Prasad be called\tupon<br \/>\nto  surrender the two houses and to retransfer the  same  to<br \/>\nthe  Bank.   The  High Court held that\tthe  sale  deed\t was<br \/>\nobtained by Durga Prasad who was the real purchaser, that he<br \/>\nhad suppressed his interest in the purchase, and that  being<br \/>\na  member of the committee for inspection, qua the  Bank  he<br \/>\noccupied  the position of a trustee and was on that  account<br \/>\nprecluded  from. buying the property of the Bank.  The\tHigh<br \/>\nCourt accordingly directed Durga Prasad to covey the  houses<br \/>\nto  the\t Official Liquidator of the Bank.   This  order\t was<br \/>\nconfirmed in appeal tinder cl. 10 of the Letters Patent by a<br \/>\nDivision Bench of the High Court.  The High Court,  however,<br \/>\ncertified the case under Art. 33 (1) of the<br \/>\n<span class=\"hidden_text\">478<\/span><br \/>\nConstitution  for  appeal  to this Court.   The\t High  Court<br \/>\nobserved :\n<\/p>\n<blockquote><p>\t      &#8220;It  is  not in dispute that the\tjudgment  of<br \/>\n\t      this  Court involves directly or indirectly  a<br \/>\n\t      claim  respecting property of a value  of\t not<br \/>\n\t      less  than  Rs. 20,006\/- and, in view  of\t the<br \/>\n\t      decision of this Court in Shri Deoki Nandan v.<br \/>\n\t      State of Uttar Pradesh (1), the applicants are<br \/>\n\t      entitled\tas of right to a  certificate  under<br \/>\n\t      Article 133 (1) of the Constitution without an<br \/>\n\t      additional  certificate  that the\t case  gives<br \/>\n\t      rise  to a substantial question of  law.\t The<br \/>\n\t      requisite certificate will accordingly issue.&#8221;\n<\/p><\/blockquote>\n<p>At  the hearing before this Court counsel for  the  Official<br \/>\nLiquidator submitted that the appeal is incompetent, for the<br \/>\nHigh  Court  had no jurisdiction to  grant  the\t certificate<br \/>\nunder\tArt.  133  (1)\t(a)  of\t the  Constitution   without<br \/>\ncertifying   that  the\tappeal\tinvolved  some\t substantial<br \/>\nquestion of law.  In our view this contention must succeed.<br \/>\nIn Deoki Nandan v. State of Uttar Pradesh the Allahabad High<br \/>\nCourt held.\n<\/p>\n<blockquote><p>\t      &#8220;The  words  &#8216;the\t Court\timmediately   below&#8217;<br \/>\n\t      within  the meaning of cl. (1) of Art. 133  of<br \/>\n\t      the  Constitution must be a court\t other\tthan<br \/>\n\t      the  High\t Court.\t A single judge\t of  a\tHigh<br \/>\n\t      Court  is not a court subordinate to the\tHigh<br \/>\n\t      Court.\n<\/p><\/blockquote>\n<blockquote><p>\t      An  appeal  against an order of  an  appellate<br \/>\n\t      Bench  of the High Court dismissing an  appeal<br \/>\n\t      from  an order of a single judge of the  Court<br \/>\n\t      on  its  original side  rejecting\t a  petition<br \/>\n\t      under  Art. 226 of the Constitution lies as  a<br \/>\n\t      matter  of  right under Art. 133\t(1)  of\t the<br \/>\n\t      Constitution,  if the claim is in\t respect  of<br \/>\n\t      property of a value in excess of Rs.  20,000\/-<br \/>\n\t      and it is not<br \/>\n\t      (1)   A.1 R. 1959 All, 15.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">\t\t\t\t   479<\/span><\/p>\n<blockquote><p>\t      necessary\t that the case should give  rise  to<br \/>\n\t      a substantial question of law.&#8221;\n<\/p><\/blockquote>\n<p>But the expression &#8220;court immediately below&#8217; in Art. 133 (1)<br \/>\nhas  not  the  same connotation\t as  the  expression  &#8216;court<br \/>\nsubordinate to the High Court.&#8217; In Toolsey Persaud Bhuckt v.<br \/>\nBenayek\t Misser\t (1),  the Privy  Council  appears  to\thave<br \/>\nexpressed  the\tview  that a single judge of  a\t High  Court<br \/>\ntrying an original proceeding was a court immediately  below<br \/>\nthe  High Court hearing an appeal under the  Letters  Patent<br \/>\nfrom  his judgment and therefore an appeal under S.  696  of<br \/>\nthe  Code of Civil Procedure Act XIV of 1882 (of  which\t the<br \/>\nterms were in substance identical with the terms of Art. 133<br \/>\n(1)) could be certified for appeal to the Privy Council only<br \/>\nif a substantial question Of law was involved.\tThe judicial<br \/>\nCommittee observed<br \/>\n\t      &#8220;Their  Lordships\t think that no\tquestion  of<br \/>\n\t      law, either as to construction of documents or<br \/>\n\t      any other point, arises on the judgment of the<br \/>\n\t      High  Court,  and that  there  are  concurrent<br \/>\n\t      findings\tof the two Courts below on the\toral<br \/>\n\t      and  documentary, evidence submitted to  them.<br \/>\n\t      That  being SO, the present appeal  cannot  be<br \/>\n\t      entertained.\n<\/p>\n<p>In Probhawati Kunwar v. Panmal Lodha (2), the High Court  of<br \/>\nCalcutta held that an appeal to the Privy Council cannot  be<br \/>\ncertified  if  the  High Court confirms the  judgment  of  a<br \/>\nsingle\tjudge  trying  an  original  proceeding,  unless  it<br \/>\ninvolves  a substantial question of law.  In a\trecent\tcase<br \/>\n<a href=\"\/doc\/1679391\/\">Ladli  Prasad Jaisuul v. The Karnal Distillery Company\tLtd.<\/a><br \/>\n(3),  this Court held that a single Judge hearing  a  second<br \/>\nappeal under S. 100 of the Code of Civil Procedure, 1908  is<br \/>\nfor  purposes of Art. 133 (1) the Court immediately below  a<br \/>\nDivision  Bench of the High Court hearing an appeal  against<br \/>\nhis  judgment under the Letters Patent.\t It was observed  in<br \/>\nthat case that<br \/>\n(1) (1896) L.R. 28 I.A. 102.\n<\/p>\n<p>(2) (1941) 45 Cal, W..N. 1002.\n<\/p>\n<p>(3) [1964] Vol, I s.C.R. 270.\n<\/p>\n<p><span class=\"hidden_text\">480<\/span><\/p>\n<p>the  expression &#8216;Court immediately below&#8217; used in  Art.\t 133<br \/>\n(1)  (a) does not mean Court subordinate to the High  Court.<br \/>\n&#8220;A Court subordinate to the High Court is a Court subject to<br \/>\nthe  superintendence  of  the High Court,  whereas  a  Court<br \/>\nimmediately  below  is\tthe Court from\twhose  decision\t the<br \/>\nappeal\thas been filed.&#8221; In that case  the  Attorney-General<br \/>\nappearing  for the respondents conceded that a single  judge<br \/>\nof  a High Court trying a suit or proceeding as a  court  of<br \/>\noriginal jurisdiction was a court immediately below the High<br \/>\nCourt  hearing\tan  appeal  from  his  decision-and  it\t was<br \/>\nobserved  in the judgment of this Court that the  concession<br \/>\nwas properly made.\n<\/p>\n<p>In  the\t appeal before us, the judgment of  the\t High  Court<br \/>\naffirms the judgment of the single judge and the High  Court<br \/>\nhas  not certified that the decision appealed from  involves<br \/>\nany   substantial  question  of\t law.\tThe  appeal   cannot<br \/>\naccordingly  be\t entertained.\tCounsel\t for  the  appellant<br \/>\nrequested  that in any event special leave to  appeal  under<br \/>\nArt. 136 of the Constitution be granted. But  we are  of<br \/>\nthe view, having regard to all thecircumstances, that  this<br \/>\nis not a fit case for granting leave to appeal.<br \/>\nThe appealis  therefore\t dismissed.
