Goyernrnent   an order dated 13.8.2010<\/p>\n
 grant of permission for the stookyard
\n owners and those who have processing<\/p>\n
in -V plants’i!A”.”circu1ar dated 13.8.2010 was accordingly
\nin  the Director, Department of Mines and
\n‘   requiring the implementation of the order dated<\/p>\n
” “1”3.8.201o.\n<\/p>\n
2. Based on the order dated 13.8.2010 passed by<\/p>\n
the State Government, as also, the Circular dated<\/p>\n
3<\/span>
\n13.8.2010 passed by the Director, Department of Mines<\/p>\n
and Geology; the Deputy Director (Mines), Hospet,
\npassed an order dated 16.8.2010 canceling the<\/p>\n
stockyard permission granted to the <\/p>\n
Through the instant Writ petition, the <\/p>\n
assailed the cancellation order: dated <\/p>\n
solitary contention advanced  <\/p>\n
the petitioner is that  ‘dated’<\/p>\n
16.8.2010 adversely ,_affect’s ‘~.nti1e””s.civi1\u00e9’0rights of the
\npetitioner. It is accordingly the aforesaid
\norder could\u00a7.v1″1’otV:g1have  passedtiyirespondent no.3
\nwithout  justice. In this
\nbehalf   no notice whatsoever was<\/p>\n
iss1_\u00a71pe’dr.to the upetiti-oner informing him the basis for<\/p>\n
  stockyard permission. It is further<\/p>\n
 ~pointed”xIout’ii;;.that no opportunity was afforded to the<\/p>\n
petitioner’ to respond to any such determination at the<\/p>\n

  3. Mr. Kolle, learned Government Advocate,<\/p>\n
1%  2  appearing on behaif of the respondents does not dispute<\/p>\n
the factual position noticed herein above. He<\/p>\n
accordingly states that the impugned order dated<\/p>\n

16.8.2010 be treated as a show cause notice, with
\nliberty to the petitioner to respond to the same within a
\nperiod of two weeks from today. It is asserted that on<\/p>\n
receipt of the reply filed by the petitioner, the competent<\/p>\n
authority would pass an order in accordance ~\n<\/p>\n

\ncounsel for the respondents, wephe_re~by  <\/p>\n
impugned order dated  shall’ only<\/p>\n
as a show cause notice  Deputy: Director
