                        Judgment<\/p>\n
Koshy,J.\n<\/p>\n<\/p>\n
         The    appellant\/claimant    sustained   serious<\/p>\n
injuries while she was travelling in a bus driven by the<\/p>\n
second respondent.  She claimed a compensation of Rs.One<\/p>\n
lakh.   Only Rs.45,500\/- was awarded as compensation,<\/p>\n
though tribunal found that the accident occurred due to<\/p>\n
the negligence of the driver of the bus and the bus was<\/p>\n
insured by the third respondent insurance company.   As a<\/p>\n
result of the accident, claimant had lacerated wound on<\/p>\n
the forehead, lacerated wound on the left side of upper<\/p>\n
lip and fracture of both bones of the left lower limb.<\/p>\n
Ext.A5 certificate shows that as a result of the fracture<\/p>\n
of both bones of the left lower limb, she had 14%<\/p>\n
permanent disability.  Since the doctor was not examined<\/p>\n
for proving the same, the tribunal did not rely on the<\/p>\n
same, but, awarded only Rs.5,000\/- for disability and<\/p>\n

loss of earning power.       According to the claimant, she<\/p>\n
was a tailor by profession and even if that is not<\/p>\n
proved, service of a house wife to the family also cannot<\/p>\n
be considered as valueless.         The tribunal has fixed<\/p>\n
Rs.1,500\/- as the notional income.        It is not disputed<\/p>\n
that the appellant had fracture of both      fibula and tibia<\/p>\n
of left leg.      It will have swelling etc.  Even though 14%<\/p>\n
disability certified need not be accepted, the Tribunal<\/p>\n
would have at least fixed 7% disability.           Since the<\/p>\n
claimant was aged 31, 16 can be taken as the multiplier<\/p>\n
and compensation can be fixed as Rs.1500 x 12 x 16 x     7<\/p>\n
                                                        100<\/span><\/p>\n
= Rs.20,160\/-.      After deducting Rs.5,000\/- granted by the<\/p>\n
tribunal       additional  compensation   payable   will   be<\/p>\n
Rs.15,160\/-.        Even  though  it  was  argued  that   the<\/p>\n
compensation granted under other heads are very meagre,<\/p>\n
we are not inclined to enhance the same considering the<\/p>\n
injuries suffered by the claimant.      The above additional<\/p>\n
amount of Rs.15,160\/- shall be deposited by the third<\/p>\n
respondent insurance company with 7.5% interest from the<\/p>\n

date of application till its deposit.   On deposit of the<\/p>\n
amount, appellant is allowed to withdraw the same.<\/p>\n
