By the said order, the learned<br \/>\nDistrict Judge has dismissed the said application at Exhibit 13<br \/>\nsubmitted by the present applicant.  The aforesaid Arbitration<br \/>\nPetition has been preferred by respondent No.1 herein on the ground<br \/>\nthat the applicant had entered into an agreement in connection with<br \/>\npurchase and sale of shares with the original opponent No.1 (present<br \/>\napplicant herein).  It is the case of the original applicant<br \/>\n(respondent No.1 herein) that a dispute arose between the parties on<br \/>\nthe subject of payment of transactions and delivery of shares and the<br \/>\nopponent No.1 herein referred grievances on his part by application<br \/>\nto the N.S.E.   The N.S.E. was pleased to appoint one of the<br \/>\narbitrators from the panel to adjudicate the dispute between the<br \/>\nparties i.e. opponent no.1 herein and the present applicant.   A sole<br \/>\narbitrator one Shri G. Venkataramani gave his award on 14.8.2000.<br \/>\nThe opponent No.1 herein thereafter gave an application to the<br \/>\nDistrict Court, Vadodara for setting aside the award on 21.11.2000.<br \/>\nThe said application was filed against the present applicant as well<br \/>\nas respondent No.2 herein.\n<\/p>\n<p>\tIn<br \/>\nthe aforesaid application before the District Court, the present<br \/>\napplicant filed an application at Exhibit 13 requesting the learned<br \/>\nDistrict Judge, Vadodara to decide the preliminary issue regarding<br \/>\nthe jurisdiction of the Court before deciding the main application.<br \/>\nThe learned District Judge rejected the said application by his order<br \/>\ndated 26.4.2001.  Being aggrieved by the said order, the applicant<br \/>\nherein has filed this revision application under Section 115 of the<br \/>\nCode of Civil Procedure.\n<\/p>\n<p>\tThe<br \/>\ncase of the present applicant before the District Court in the said<br \/>\napplication at Exhibit 13 was that the District Court at Vadodara has<br \/>\nno jurisdiction to decide the application of opponent No.1 herein and<br \/>\nthat said Arbitration Petition No.249 of 2000 was required to be<br \/>\nrejected in limine.  It is alleged in the application that both the<br \/>\nparties are having their business at Bombay and Vadodara Court has no<br \/>\njurisdiction to decide the application.  A copy of the application<br \/>\nExhibit 13 is annexed at page 4 in the present proceedings.  It is<br \/>\nalso averred in the said application that the arbitrator declared the<br \/>\naward after hearing both the sides and against that the original<br \/>\napplicant before the District Court had not filed any appeal or had<br \/>\ntaken up any proceedings for setting aside the said award.  It is the<br \/>\ncase of the present applicant in the said application Exhibit 13<br \/>\nthat since the award has been declared after following the procedure<br \/>\nunder Section 34 of the Arbitration Act, the said award cannot be set<br \/>\naside and such application is not maintainable before the District<br \/>\nCourt.   It is alleged that respondent No.1 ?  original applicant<br \/>\nwas required to prefer appeal before the Bombay High Court.  Under<br \/>\nthe circumstances, it was prayed that the said question of<br \/>\njurisdiction be decided as a preliminary issue as according to the<br \/>\npresent applicant, the District Court at Vadodara has no jurisdiction<br \/>\nto decide the application in question.\n<\/p>\n<p>\tThe<br \/>\nlearned District Judge, however, rejected the application on the<br \/>\nground that the decision on the said application will decide the fate<br \/>\nof the entire proceedings.   The District Court found that in order<br \/>\nto find out the jurisdiction, the Court will have to consider the<br \/>\nfacts of the case and will have to take into consideration the<br \/>\nevidence, documentary as well as oral, submitted by the parties.<br \/>\nThe District Court found that in order to arrive at a final decision<br \/>\nin the matter, the evidence is required to be considered.   The Court<br \/>\nfound that instead of deciding the question by framing a preliminary<br \/>\nissue, it would be better to have a decision on all the points<br \/>\narising in the proceedings.  The learned Judge accordingly decided to<br \/>\nhear all the issues together including the question about<br \/>\nmaintainability.\n<\/p>\n<p>\tIt<br \/>\nis required to be noted that in its limited jurisdiction under<br \/>\nSection 115 of the Civil Procedure Code this Court would not like to<br \/>\ninterfere with such an interlocutory order as  the District Court has<br \/>\nkept the said issue pending and has decided to adjudicate all the<br \/>\npoints together.  Ultimately, the Court after considering the<br \/>\nevidence on record may decide whether such an application is<br \/>\nmaintainable or whether the Court has jurisdiction to decide such<br \/>\napplication.  Under the circumstances, instead of entertaining this<br \/>\nrevision application, the learned District Judge is directed to<br \/>\ndecide the main application expeditiously and may decide all the<br \/>\nissues together and may dispose of the same finally within a period<br \/>\nof six months from the date of receipt of writ of this Court.  It is<br \/>\nrequired to be noted that when the District Court has decided to hear<br \/>\nall the issues together, it cannot be said that he has committed any<br \/>\nerror of jurisdiction which calls for interference of this Court in<br \/>\nits limited jurisdiction under Section 115 of the Civil Procedure<br \/>\nCode.  Under the circumstances, subject to the direction issued to<br \/>\nthe District Court to decide the pending application within<br \/>\nstipulated time, this revision application is rejected.  Rule is<br \/>\ndischarged.
