PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.HS Srimali, for the petitioner.<br \/>\nMr.Arun Bhansali, for the respondent.\n<\/p>\n<p>                          &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>       Heard learned counsel for the parties.\n<\/p>\n<p>       The petitioner, who was defendant in the suit<br \/>\nfor     eviction,    faced    an      ex-parte        decree      on<br \/>\n13.4.2005. He submitted an application under Order<br \/>\n9 Rule 13 CPC in the trial court on 11.7.2005<br \/>\nwhich was rejected by the trial court on 7.8.2006.<br \/>\nThen the petitioner preferred writ petition before<br \/>\nthis High Court on 26.4.2007, though the order was<br \/>\nappealable. This Court passed a detailed order on<br \/>\n7.8.2007,    yet    the   petitioner     did    not    choose     to<br \/>\nwithdraw the writ petition and ultimately, that<br \/>\nwrit    petition    was   withdrawn      on    18.1.2008       with<br \/>\nliberty to file appeal before the appellate court.<br \/>\nThen the petitioner preferred first appeal before<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>                                         SB Civil Writ Petition No.1590\/2009<br \/>\n                                           Sukhdev. vs. Vijay Chand Surana.\n<\/p>\n<p>the appellate court on 7.2.2008. This Court while<br \/>\nrejecting the petitioner&#8217;s writ petition granted<br \/>\nliberty to the petitioner to file the appeal as<br \/>\nthe order was appealable.\n<\/p>\n<p>      Though there cannot be question of bonafides<br \/>\nin challenging the order of the trial court passed<br \/>\non application filed under Order 9 Rule 13 CPC by<br \/>\nway    of    writ    petition,      yet      even    if    the    period<br \/>\nconsumed in prosecuting the matter in the Court of<br \/>\nlaw is taken into account under Section 14 of the<br \/>\nIndian Limitation Act, even then as per the trial<br \/>\ncourt, the petitioner failed to explain the delay<br \/>\nof eight months in filing the appeal and that was<br \/>\nthe period from 7.8.2006 to 26.4.2007, which was<br \/>\nthe period in which, no proceedings were pending<br \/>\nin    the    court    of    law    to    challenge      the    impugned<br \/>\norder.\n<\/p>\n<p>      The     trial        court    rightly         held      that     the<br \/>\npetitioner can be given benefit at the most of the<br \/>\nperiod which was consumed by him in prosecuting<br \/>\nthe matter in the court bonafide and that period<br \/>\nis    only    from    the    date       of   filing     of    the    writ<br \/>\npetition to the date of withdrawal of the writ<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>                                  SB Civil Writ Petition No.1590\/2009<br \/>\n                                    Sukhdev. vs. Vijay Chand Surana.\n<\/p>\n<p>petition   and   if   that   period     is    credited,       then<br \/>\nalso, the petitioner&#8217;s appeal is barred by time<br \/>\nhopelessly.\n<\/p>\n<p>      In view of the above reasons, I do not find<br \/>\nany     illegality      in       the      impugned         order.<br \/>\nConsequently,    this    writ      petition,        having       no<br \/>\nmerits, is hereby dismissed.\n<\/p>\n<p>                                       (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Sukhdev vs Vijay Chand Surana on 23 March, 2009 1 SB Civil Writ Petition No.1590\/2009 Sukhdev. vs. Vijay Chand Surana.
