Learned standing counsel on the basis of<br \/>\nthe instructions received informed that the powers have<br \/>\nbeen delegated.\n<\/p>\n<p>Shri Khare contends that on merit the suspension order is<br \/>\nfounded on such an incident with regard to which Sub-<br \/>\nDivisional Magistrate has submitted a report on 03.12.2009<br \/>\nand which does not display any negligence on the part of the<br \/>\npetitioner. The said report is appended as annexure 6 to the<br \/>\nwrit petition. Shri Khare further contends that the impugned<br \/>\norder of suspension does not recite any other incident apart<br \/>\nfrom the same and, therefore, the impugned order is liable to<br \/>\nbe set aside.\n<\/p>\n<p>The impugned order recites that an incident between two<br \/>\nsects of the minority community had taken place on<br \/>\n28.12.2009 and 29.12.2009 and apart from that the<br \/>\npetitioner has failed to perform his duties diligently, as a<br \/>\nresult thereof, he was suspended.\n<\/p>\n<p>Learned standing counsel has produced the instructions and<br \/>\nthe report of the Superintendent of Police (City), Muzaffar<br \/>\nNagar, which indicates that there were other incidents<br \/>\n preceding the incident of the communal dispute, which has<br \/>\nalso been taken into account while proceeding to pass the<br \/>\nsuspension order.\n<\/p>\n<p>According to the said report, the petitioner has not been<br \/>\nperforming his duties diligently, as a result whereof, the law<br \/>\nand order situation in his area and within his jurisdiction has<br \/>\ndeteriorated.\n<\/p>\n<p>Shri Khare contends that the petitioner was not expected to<br \/>\nprevent any such incident, in the manner in which it has<br \/>\nbeen indicated in the report of the Sub-Divisional Magistrate,<br \/>\nwhich arose out of indiscriminate playing of local cricketers.\n<\/p>\n<p>Having heard learned counsel for the parties and keeping in<br \/>\nview the nature of submissions advanced, it is evident that<br \/>\nthe question as to whether the petitioner was a diligent<br \/>\nofficer and as to whether his negligence was grave enough<br \/>\nso as to cause the incident is subject matter of the inquiry<br \/>\nitself. In the event the petitioner is found negligent so as to<br \/>\nallow to such incidents to happen in his locality where he<br \/>\nwas posted then the same may warrant an appropriate<br \/>\naction to be taken.\n<\/p>\n<p>In this view of the matter, it cannot be said that the<br \/>\nsuspension order is founded on irrelevant material or is<br \/>\notherwise perverse.\n<\/p>\n<p>No ground for interference under Article 226 of the<br \/>\nConstitution of India is made out.
