(Oral)\n<\/pre>\n<p>          On 25.11.2008, a Co-ordinate Bench of this Court passed the<\/p>\n<p>following order:-\n<\/p>\n<blockquote><p>                      &#8220;Present: Mr. C.M. Munjal, Advocate<br \/>\n                                for the petitioners.\n<\/p><\/blockquote>\n<blockquote><p>                                Mr. A.S. Brar, DAG, Punjab<br \/>\n                                for the State.\n<\/p><\/blockquote>\n<blockquote><p>                                Mr. G.S. Gill, Advocate<br \/>\n                                for the complainant.\n<\/p><\/blockquote>\n<blockquote><p>\n                                The petitioners have not been otherwise<\/p>\n<p>                      assigned any specific role, but are generally<\/p>\n<p>                      accused    of     having   thrown   brick-bats.   When<\/p>\n<p>                      questioned as to from where they got the brick-bats,<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-30112 of 2008                                      2<\/span><\/p>\n<p>                    State counsel points out that they demolished the<\/p>\n<p>                    wall   and   threw   brick-bats.   Counsel    for   the<\/p>\n<p>                    complainant points out that this is not the first time<\/p>\n<p>                    they have done so, but on earlier occasion also, they<\/p>\n<p>                    had taken similar sort of action for which an FIR was<\/p>\n<p>                    registered. Despite query, no further role has been<\/p>\n<p>                    assigned to the petitioners.<\/p>\n<\/blockquote>\n<blockquote><p>                              Adjourned to 23.1.2009.\n<\/p><\/blockquote>\n<blockquote><p>                              In the meanwhile, in the event of arrest of<\/p>\n<p>                    the petitioners, they shall be released on anticipatory<\/p>\n<p>                    bail to the satisfaction of the Arresting Officer,<\/p>\n<p>                    subject to the conditions contained in Section 438<\/p>\n<p>                    (2) Cr.P.C. They will join the investigation as and<\/p>\n<p>                    when required.\n<\/p><\/blockquote>\n<blockquote><p>                                                                      Sd\/-\n<\/p><\/blockquote>\n<blockquote><p>                                                            (Ranjit Singh)<br \/>\n                                                                    Judge<br \/>\n                    November 25, 2008&#8243;<\/p><\/blockquote>\n<p>          Mr. Munjal submits that offence under Section 307 IPC has<\/p>\n<p>been omitted during the course of investigation.<\/p>\n<p>          Mr. Mehardeep Singh, learned Assistant Advocate General,<\/p>\n<p>Punjab, on instructions from Balbir Singh, Head Constable, submits that<\/p>\n<p>petitioners have joined investigation and they are no longer required for<\/p>\n<p>custodial interrogation.\n<\/p>\n<p>          In view of order dated 25.11.2008 passed by a Co-ordinate<\/p>\n<p>Bench of this Court and statement made by          counsel for the State,<\/p>\n<p>interim pre-arrest bail granted to the petitioners is affirmed till the<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-30112 of 2008                                  3<\/span><\/p>\n<p>presentation of final report under Section 173 Cr.P.C.
