clause (lo) of section 138 of Negotiable Instruments Act, was<\/p>\n
not complied.\n<\/p>\n
4. The learned jurisdictional Magistrate.-uaiftetil:’al<i-ngvit =<\/p>\n
cognizance secured presence of the accused i:\u00a7.;\u00a73\u00bbnled4_'_the._V it<\/p>\n
charge and submitted that borr_ow–ed_u<\/p>\n

\nproceedvings in  in which he was convicted<\/p>\n
on plea ofxg\u00ab.ui%lt,. ‘Vii-le4V’s_1J’bi:’:h’its that since the petitioner has<\/p>\n
.–v\u00ab.g_aireac-icy obtained”‘an__o_tcler against him, the present cheque<\/p>\n
whiichgw.avs<tal\u00a7en__as additional cheque along with the cheque<\/p>\n
in"qis-estion".fwasVunenforceabie. In short, the defence was<\/p>\n
Igthat 't'pg"'two4'cheques were obtained by the complainant for<\/p>\n
 eioxanitraniisactiori of Rs.40,000\/–. The accused had admitted<\/p>\n
—  oineicheque for Rs.60,000\/~ and did not oppose prosecution<\/p>\n
ttiereto, but he opposed the misuse of 2″” cheque. Since<\/p>\n

the 2″” cheque was also bounced he contends he was not<\/p>\n
liabie for prosecution in this case.\n<\/p>\n
5. To establish his case, the com.p.l_ai\u00bbn.an’t~dis<\/p>\n
examined as PW.1 and placed reliance _ <\/p>\n
The accused also examined himself as”E)’~.Avi.’1._ a~ind.__relied”‘oVn 3*’<\/p>\n
documents.\n<\/p>\n
6. The learned trial  con.si’der’iintgi’_=theweiridencell<\/p>\n
of both sides heid thatthe ctialrge’j’aVo”a.i._nst re’s’po’ndent was<\/p>\n
not proved in the mannei?.”knovi}n t_.Q:il’\u00a3-.’Ail.f\\\u20acV’l}?i’$ the petitioner<\/p>\n
had failed to. f_’.:;j\u00a7\u00a7)VdLlC\u00e9_ loooliais and supportive<\/p>\n
documents  the month of March 1998 the
\npetitioner.__had lentalirno:_un.tL”co.vered under both the cheques.<\/p>\n
in Ol;’;i’i’c’3l’_ wollm,-;A,”the learned trial Judge noticed that the<\/p>\n
boetweenmthe parties was of Rs.40,000\/– and<\/p>\n
 ivnite-::*est thereon the complainant had filled up<\/p>\n
chleque_f0’r.\u00a7si6O,OO0\/W. Accused had pieaded guilty but in<\/p>\n
 2’l”v..\u00abproceeding the charge of legal liability was not<\/p>\n
  estaciiished. In the resultant position the respondent has<\/p>\n

is that the learned Judge should have <\/p>\n
presumption u\/s 139 of Negotiable Instrument’s_:Act;.<\/p>\n
postulates that unless to the contrali\ufb01\/i’s’provecl’ <\/p>\n
presumed that a cheque was Vissueo’,_in'”discharge”of <\/p>\n
part of the debt or legal llablllt”yh..V.”‘~He vi1oL:ld”Vfu’;*th’er”submit
\nthat conviction of acc\u00e9used’Vt_:’joun”el.._plea ‘Vot”‘Vguiit in
\nC0802\/2805 was of noa’a%\\5a’il–‘iaVs’ issued two<\/p>\n
cheques.\n<\/p>\n
8. I1a.mi:..xu;ijVab–l’e’  ar\ufb01wy of these contentions
\nfor the %'{\u00e9aSOt_tA'[f}\u00e93t,_’li1_tl”I\u20actVll:i-ETSE.lOOk we may notice that the<\/p>\n
complainantinitiated two'”;3._rVos’ecutions in C.C.i\\lo.802\/2805<\/p>\n
and CC~l\\lo.77u2\/2VQO5″} in hoth the cases, the complainant<\/p>\n
 ti\u00e9d \u00abnot{wh”isper_aboutHthe liability of the accused relating to<\/p>\n
oz-her..r~case;’nth eaclh case the complainant refers to only one<\/p>\n
  prosec.utiov_n.* Liiecondly, it is to be seen that complainant<\/p>\n
 not  that he had lent additionally an amount of<\/p>\n
 to the respondenbaccused. His assertive<\/p>\n
 “‘~con_tention is he had lent a sum of Rs.60,GOG\/– in respect of<\/p>\n
at Q,\u00bb<\/p>\n

which he issued the cheque. Same averment is made in<\/p>\n
both the complaints. If the complainant had ient am”o_unt<\/p>\n

\npreponde-ranc’e  It is necessary that<\/p>\n

[despite the evidence of cornpiainant, it may give rise to two<\/p>\n

endorsement of the bank and the notice. He has <\/p>\n

transaction. The evidence read in its :en’t’irety_ <\/p>\n
one transaction and that tooV’\u00a7Q”h:.V’~RS:4’0,Q’00{V–rVK}V.,:  a ” it<\/p>\n
– situation, tn’ triai court wager.-2-<igr:t""i\u00bbn iioidiw ffijlaji: the<\/p>\n
evidence tendered by  in'ir.ret\u00a7%ti\u00bbttaE proved the<\/p>\n
transaction  and as the
\ncompiainant   Ventitied to interest at
\n23%   "ioir.i.Rs\u20ac'.60,ooo\/A. But the 2"\n<\/p>\n
cheque :a.\u00a7so–  rs.6O,OOO\/A was heid to be<\/p>\n
not supported’ by a’n_v4Vifiat.e:r*iai evidence. Such a view finds<\/p>\n
