The applicant is sentenced<br \/>\n\tto undergo S.I. for a period of 3 years for the offence punishable<br \/>\n\tunder Section 306 and S.I. for a period of 1 year for the offence<br \/>\n\tpunishable under Section 498A of the Indian Penal Code.\n<\/p>\n<p>Heard<br \/>\n\tMr.P. M. Lakhani, learned counsel for the applicant and Mr.H.L.Jani,<br \/>\n\tlearned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>Mr.Lakhani<br \/>\n\thas contended that the present applicant is released on bail by the<br \/>\n\ttrial Court. He has further submitted that conviction imposed by the<br \/>\n\tlearned trial Judge is within the period of 3 years. He has,<br \/>\n\ttherefore, contended that the application may kindly be allowed by<br \/>\n\treleasing the applicant on bail pending the appeal.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me as well as the<br \/>\n\tjudgment and order passed by the learned Sessions Judge, Jamnagar.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case, I am of the opinion that this is a fit<br \/>\n\tcase to grant bail to the applicant. Hence, the applicant is ordered<br \/>\n\tto be released on bail pending hearing and disposal of the main<br \/>\n\tappeal on his furnishing a personal bond of Rs.10,000\/- and a surety<br \/>\n\tof the like amount on usual terms and conditions.
