        The appellants herein are the appellants<\/p>\n
in the writ petition, who wanted to increase the<\/p>\n
age of retirement from 58 to 60 years.<\/p>\n
        2. The appellants were in employment of<\/p>\n
Hindustan Organic Chemicals Limited, a public<\/p>\n
sector enterprise, having two units apart from<\/p>\n
the Head Office at Mumbai.             The appellants are<\/p>\n
working at Ambalamugal in Kerala State. Ext.P1 is<\/p>\n
the guidelines, which shows that Government had<\/p>\n
decided to increase the age of retirement Board<\/p>\n
level and below Board level employees in certain<\/p>\n
public sector undertakings, from 58 to 60 years.<\/p>\n
But, thereafter, it was decided to give up the<\/p>\n
proposal for enhancement of age, except in profit<\/p>\n
making companies.      The 2nd respondent company was<\/p>\n
one of the loss making companies and therefore,<\/p>\n
it was referred to the BIFR. Therefore, the 2nd<\/p>\n
respondent company cannot enhance the retirement<\/p>\n
age of its employees.        The BIFR has passed orders<\/p>\n

                        :: 2 ::\n<\/p>\n
\nreleasing  the   company      from   its   purview  of<\/p>\n
consideration. In February, 2008, the following<\/p>\n
decisions were taken:\n<\/p>\n
       “In the meantime, several sick CPSEs have<\/p>\n
    started making profit and these CPSEs have<\/p>\n
    requested   for   enhancement     of   age   of<\/p>\n
    retirement of its employees from 58 to 60<\/p>\n
    years. The matter has further been reviewed<\/p>\n
    by the Government and it has now been decided<\/p>\n
    that   the   Minister-in      Charge   of   the<\/p>\n
    administrative Ministry\/Department concerned<\/p>\n
    is  empowered  to  approve   the  proposals  of<\/p>\n
    CPSEs to enhance the age of retirement from<\/p>\n
    58 to 60 years, provided that —<\/p>\n<\/blockquote>\n
     (a)  The CPSE concerned should as per its<\/p>\n
          audited annual accounts have made net<\/p>\n
          profits   for    the    last   3   years<\/p>\n
          continuously   and     should   have   a<\/p>\n
          positive net worth during the last<\/p>\n
          three years.\n<\/p><\/blockquote>\n
     (b)  The CPSE has not availed any budgetary<\/p>\n
          support during the last 3 years and no<\/p>\n
          budgetary support will be availed by<\/p>\n
          the CPSE in future.\n<\/p><\/blockquote>\n
     (c)  The  proposals   are   approved  by  the<\/p>\n
          Board  of   Directors    of   the   CPSE<\/p>\n
          concerned and have the concurrence of<\/p>\n
          Financial  Advisor    of  the  concerned<\/p>\n
          administrative Ministry\/ Department.”<\/p><\/blockquote>\n
       3. That shows that 3 years accounts have<\/p>\n
to be looked into and thereafter the Board can<\/p>\n
decide  the   enhancement      of  the   age   to  60.<\/p>\n
Admittedly, 6 central Public Sector undertakings<\/p>\n

\nhave  decided   to  increase   the  age  of   its<\/p>\n
employees.     Even  after    the decision,   the<\/p>\n
Government has to consider the same.    Since the<\/p>\n
Board has not recommended enhancement of the age<\/p>\n
of employees of the 2nd respondent,    this court<\/p>\n
cannot declare that the appellants are entitled<\/p>\n
to retire only at the age of 60 years.     It is<\/p>\n
also submitted by the learned counsel for the<\/p>\n
company that the company is on loss even now.<\/p>\n
Learned counsel for the appellants submits that<\/p>\n
the unit at Ambalamugal is making profit and it<\/p>\n
should be separately treated.     Whether in one<\/p>\n
unit alone, can retirement age be increased, is<\/p>\n
to be decided by the Board. According to the<\/p>\n
counsel for the 2nd respondent company, this unit<\/p>\n
is running at loss.\n<\/p>\n
       4. It is contended by the appellants that<\/p>\n
the retirement age of Board level employees of<\/p>\n
the company has been enhanced, but the retirement<\/p>\n
age of   the below Board level employees of the<\/p>\n
company has not been enhanced. It is clarified by<\/p>\n
the counsel for the company that only 4 officers,<\/p>\n
i.e. Chairman and Managing Director, Director<\/p>\n
(Marketing)  Director    (Finance) and   Director<\/p>\n

                          :: 4 ::\n<\/p>\n
\nOperation & Finance are permitted to continue<\/p>\n
till they attain the age of 60 years.           They are<\/p>\n
approved by the Central Government but other<\/p>\n
members of the company including Chief Executive<\/p>\n
General Managers etc. are to retire at the age of<\/p>\n
58 years, as the retirement in the company was<\/p>\n
fixed at 58 years. This cannot be termed as<\/p>\n
violation of Article 14 of the Constitution.          In<\/p>\n
the above circumstances, we cannot issue a writ<\/p>\n
of mandamus.\n<\/p>\n
       5. However, the appellants will be free<\/p>\n
to file a representation to the company Board for<\/p>\n
a favourable consideration.<\/p>\n
       Writ appeal is disposed of as above.<\/p>\n
