Justice V.GIRI\n\n Dated :15\/01\/2009\n\n O R D E R\n                  J.B.KOSHY, Ag.CJ &amp; V.GIRI, J.\n                  ===========================\n                   W.A.Nos.775 &amp; 797 of 2006\n               ===============================\n            Dated this the 15th day of January, 2009.\n\n                          J U D G M E N T\n<\/pre>\n<p>Koshy, Ag.CJ.\n<\/p>\n<p>      Appellants are the owners of vehicles.         The question<\/p>\n<p>involved in this case is whether their vehicle will come under<\/p>\n<p>Table III of Ext.P42 or under Table I.           According to the<\/p>\n<p>appellants, their vehicles&#8217; seating capacity is below 20 and it will<\/p>\n<p>come under Table III and not under Table I and they are liable to<\/p>\n<p>pay contribution of Rs.100\/- per month instead of Rs.700\/- per<\/p>\n<p>month to the Motor Transport Workers Welfare Fund.             The<\/p>\n<p>learned Single Judge directed them to approach the assessing<\/p>\n<p>authority and contest their case. At the time of admission, a<\/p>\n<p>Division Bench of this Court passed an interim order permitting<\/p>\n<p>the appellants to contribute to the Motor Transport Workers<\/p>\n<p>Welfare Fund as provided under Table III with a condition that<\/p>\n<p>appellants shall not alienate their vehicle. The above order is<\/p>\n<p>continuing.   We are of the view that since statutory appeal is<\/p>\n<p>provided under Section 8, no interference is required in the<\/p>\n<p>W.A.Nos.775 &amp; 797 of 2006<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>impugned judgment.       In the above circumstances, appellants<\/p>\n<p>may make a detailed representation before the assessing<\/p>\n<p>authority for passing a proper assessment and after the<\/p>\n<p>assessment, appellants will get an opportunity to file an appeal<\/p>\n<p>also.
