Gupta, J. <\/p>\n<p>1. This order will govern the disposal of<br \/>\nI.A.7526\/02 filed under Order 39, Rules 1 &amp; 2 read with<br \/>\nSection 151 CPC by the plaintiff.\n<\/p>\n<p>2. Suit was filed, interalia, alleging that plaintiff<br \/>\nis the owner of property No. BM-30 (West), Shalimar Bagh,<br \/>\nDelhi and building plan for carrying additions and<br \/>\nalterations in property was sanctioned by the defendant on<br \/>\n20th July 1999. On 23rd July 1998 a notification was issued<br \/>\nby the Ministry of Urban Affairs &amp; Employment were by the<br \/>\nbuilding bye-laws 1983 were amended in the light of<br \/>\nrecommendations made by the Committee set up under the<br \/>\nChairmanship of Sh. V.K. Malhotra. Modifications made in said<br \/>\nbye-laws have been set out in Para 3 of the plaint. It is<br \/>\nalleged that the plaintiff started making additions and<br \/>\nalterations in property on the basis of relaxed building<br \/>\nbye-laws. Defendant issued show cause notice dated 1st<br \/>\nMarch 2002 alleging that plaintiff had made deviations<br \/>\nbeyond the sanctioned building plans by way of excess<br \/>\ncoverage at basement, ground floor, first floor and second<br \/>\nfloor. Plaintiff sent a reply dated 6th March 2002 to the<br \/>\nshow cause notice to AE (Bldg), Rohini Zone, MCD. Without<br \/>\nconsidering the reply the defendant issued demolition notice<br \/>\ndated 11th March 2002 under Section 343 of Delhi Municipal<br \/>\nCorporation Act (for short the &#8216;Act&#8217;) requiring the<br \/>\nplaintiff to demolish excess construction\/deviations<br \/>\nmentioned in said show cause notice within 6 days.<br \/>\nPlaintiff made representation on 22nd April 2002 against the<br \/>\nnotice dated 11th March 2002 stating that basement had been<br \/>\nclosed and alleged excess coverage was being demolished to<br \/>\nbring it to the level of sanctioned building plans and<br \/>\ndefendant was asked to drop proceedings. It is further<br \/>\nalleged that by the order dated 18th June 2002 under Section<br \/>\n345-A of the Act the defendant illegally ordered the sealing<br \/>\nof property and entire third floor, back portion (two bed<br \/>\nrooms) of second floor and first floor were sealed the same<br \/>\nday without giving opportunity to the plaintiff to make<br \/>\nrepresentation against that order. Defendant issued yet<br \/>\nanother notice dated 12th July 2002 under Section 435 of the<br \/>\nAct. After sealing of property the plaintiff sent yet<br \/>\nanother representation to the Additional Commissioner (HQ),<br \/>\nMCD asking for two months time to rectify the<br \/>\ndeviations\/unauthorised construction. Defendant without<br \/>\nconsidering the replies\/representations of the plaintiff<br \/>\ndemolished part of portion on third floor on 18th June 2002,<br \/>\n15th and 16th July 2002. Defendant has started demolition<br \/>\nwork of second floor from 22nd July 2002 without<br \/>\nregularising the construction. It was prayed that by decree<br \/>\nof permanent injunction the defendant be restrained from<br \/>\ntaking any action of demolition and\/or sealing of any<br \/>\nportion of suit property; by decree of declaration it be<br \/>\ndeclared that the order dated 18th June 2002 passed by<br \/>\ndefendant is null and void and construction in the property<br \/>\nbe ordered to be regularised.\n<\/p>\n<p>3. In said I.A. the plaintiff has claimed reliefs\n<\/p>\n<p>(a) and (b) as made in the plaint by way of ad interim<br \/>\ninjunction and de-sealing of property.\n<\/p>\n<p>4. Defendant contested the suit by filing written<br \/>\nstatement. It is admitted that plaintiff had applied for<br \/>\nsanction of building plan for additions\/alternations on the<br \/>\nfirst and second floors of property which was approved vide<br \/>\nFile No. 450\/B\/RZ\/99 dated 20th July 1999. It is alleged<br \/>\nthat upon receipt of a complaint from Vigilance Department<br \/>\nthe J.E.(Bldg.), Rohini Zone inspected the suit property and<br \/>\non finding unauthorised construction of basement,<br \/>\naddition\/excess coverage on ground, first and second floors<br \/>\nand unauthorised construction of third floor, a case was<br \/>\nbooked vide U\/C file No. 30\/B\/UC\/RZ\/02 dated 1st March, 2002.<br \/>\nShow cause notice dated 1st March 2002 was accordingly<br \/>\nserved on the plaintiff. On not receiving reply to show<br \/>\ncause notice within the stipulated period, demolition notice<br \/>\ndated 11th March, 2002 was issued to the plaintiff.<br \/>\nThereafter, demolition order was made on 21st March 2002 by<br \/>\nthe competent authority. It is further alleged that<br \/>\noperation of the Notification dated 23rd July 1998 has been<br \/>\nstayed by the Supreme Court by the order dated 11th December<br \/>\n2001 in WP(C) No. 725\/94. Unauthorised construction on the<br \/>\nthird floor of suit property cannot be considered for<br \/>\nregularisation in view of O.O.No. D\/577\/Addl.Commr.(E)\/2002<br \/>\ndated 31st January 2002. It is asserted that sealing order<br \/>\nwas made by the Deputy Commissioner, Rohini Zone after<br \/>\ncarefully considered the matter. It is stated that<br \/>\nalthough demolition order was passed in March 2002 the<br \/>\nactual action of demolition was started only in June 2002.<br \/>\nSealing of unauthorised portion of property was done so that<br \/>\nthere was no further misuse.\n<\/p>\n<p>5. In the short reply filed to the I.A. under<br \/>\ndisposal the defendant has reiterated the stand as taken in<br \/>\nthe written statement.\n<\/p>\n<p>6. Submission advanced by Ms. Anusuya Salwan for<br \/>\nplaintiff was mainly two-fold-(i) plaintiff&#8217;s reply dated<br \/>\n6th March 2002 was not considered while issuing demolition<br \/>\nnotice dated 11th March 2002 and (ii) relaxed bye-laws were<br \/>\nin force at the time the construction was carried out and<br \/>\nplaintiff was under a bonafide impression that alleged<br \/>\nexcess coverage and unauthorised construction beyond<br \/>\nsanctioned plan will be permitted to be compounded on<br \/>\npayment of fee. It was, however, pointed out by Ms. Mini<br \/>\nPushkarna for defendant that plaintiff had deliberately<br \/>\nsuppressed about the filing of appeal against the order of<br \/>\nsealing etc before the Appellate Tribunal, MCD on 15th July<br \/>\n2002 and non-grant of ex parte stay against demolition by<br \/>\nthe said authority. It was further pointed out that during<br \/>\nthe pendency of appeal before Appellate Tribunal the<br \/>\nplaintiff filed this suit, obtained ex-parte stay against<br \/>\ndemolition on 26th August 2002 and got the appeal dismissed<br \/>\nin default on 30th August 2002. Copies of grounds of<br \/>\nappeal, stay application and notice dated 31st July 2002<br \/>\nfiled by the defendant are placed on pages 34 to 44 on Part<br \/>\nIII file. As is manifest from sub paras (c) and (d) of Para<br \/>\n8 of the grounds of appeal, the plaintiff had impugned<br \/>\ntherein the aforesaid demolition notice as also order of<br \/>\nsealing of property made by the defendant. Further, in stay<br \/>\napplication the relief claimed was to suspend the order of<br \/>\ndemolition passed in respect of a part of suit property till<br \/>\nthe disposal of appeal. Said notice dated 31st July 2002<br \/>\nwould show that in appeal being No. 222\/ATMCD\/2002 notice was<br \/>\nissued to defendant for 24th September 2002. To be only<br \/>\nnoted that against the orders of demolition and sealing of<br \/>\nproperty, appeal lie before the Appellate Tribunal under the<br \/>\nAct. Obviously, having remained unsuccessful in obtaining<br \/>\nstay against demolition in said appeal, the plaintiff filed<br \/>\nthe present suit on 26 August 2002 before the date for<br \/>\nwhich the appeal was fixed for hearing and obtained ex-parte<br \/>\nstay against demolition on the application under disposal in<br \/>\nterms of the order dated 26 August 2002 without disclosing<br \/>\nthe factum of filing of said appeal, stay application and<br \/>\nnon-grant of stay against demolition by the Appellate<br \/>\nTribunal. Relief of injunction being discretionary in<br \/>\nnature cannot be granted to a person who comes to the court<br \/>\nwith unclean hands.
