Indra Diwakar vs The State Of Madhya Pradesh on 16 July, 2010<\/div>\n<pre>                      Writ Petition No.2394\/2010\n16.7.2010\n      Shri     Sameer      Dhage,     learned    counsel       for   the\npetitioners.\n      It is submitted by the learned counsel for the petitioner\nthat typed copies of the hand-written documents have been\nfiled forming part of challan. The same be taken on record.\n      I.A. No. 2157\/10 is rendered redundant.\n      Heard on admission.\n      Being prosecuted for an offence under Section 341,\n294, 324, 506\/34 IPC and Section 3 (1) (x) Scheduled Caste\/\nScheduled Tribe Atrocities Act, the petitioners have filed this\npetition under Article 226 of the Constitution of India seeking\ndirection for the Magisterial inquiry in Crime No. 17\/09 in\nCrime No. 17\/2009 in Sessions Trial No. 1\/2010 pending\nbefore the Special Judge, Mandla on the ground that the\npetitioners have been falsely implicated.\n      The petitioners claim to be the owner of land bearing\nKhasra No. 180 (old No. 135) PH No. 51, admeasuring 9.81\nacres, situated at Village Bhenga Dungaria, district Mandla\non the basis of registered sale-deed dated 22.4.2004.\n      The said piece of land seems to be the centre of\ncontroversy. As because initially, as the facts stand, it\nbelonged to respondent No. 3, when the same was<\/pre>\n<p>purchased      in    auction   on   30.12.1975     (as   per    auction<br \/>\nproceedings) in Revenue Case No. 60 (A-79) 6A\/65) by one<br \/>\nShyambihari         S\/o Ambika soni from whom            subsequent<br \/>\npurchase was made by one Pushpa Shrivastava wife of late<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>Parmeshwardayal Shrivastava, who sold the same to the<br \/>\npetitioner on 22.4.2004.\n<\/p>\n<p>      During the holding of land in question by Pushpa<br \/>\nShrivastava, in the year 2003, i.e., on 23.6.2003, the<br \/>\nrespondent NO. 3 invoked Section 170 of M.P. Land<br \/>\nRevenue Code, 1959 for return of land. However, in the year<br \/>\n2007, on 7.6.2007, when the petitioner made efforts to<br \/>\noccupy the land, the same, led to filing of civil suit wherein<br \/>\ncertain    interim    orders    were    passed        in    favour      of   the<br \/>\npetitioners.\n<\/p>\n<p>      It appears from the documents on record that some<br \/>\nincident    took     place   on   1.11.2009      in        the   process      of<br \/>\npetitioners&#8217; asserting their right over the property in question,<br \/>\nwhich led to registering of an offence under Sections 341,<br \/>\n294, 324, 506, 34 IPC and 3 (i) (x) of Scheduled Caste &amp;<br \/>\nScheduled      Tribe    (Prevention     of   Atrocities)         Act,    1989.<br \/>\nSubsequently, the challan has been filed and as per the<br \/>\nsubmission by learned counsel for the petitioners, the<br \/>\ncharges are also framed by the trial courts.\n<\/p>\n<p>      In view of these facts the plea for having a Magisterial<br \/>\nenquiry cannot be acceded to, apparently for the reasons<br \/>\nthat, the petitioners are facing trial on the charge under<br \/>\nSections 341, 294, 324, 506, 34 IPC and 3 (i) (x) of<br \/>\nScheduled      Caste     &amp;     Scheduled     Tribe          (Prevention       of<br \/>\nAtrocities) Act, 1989.         Because if a Magisterial enquiry is<br \/>\nordered the same would prejudice the entire case pending<br \/>\nbefore the Additional Sessions Judge.\n<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>      Thus,       keeping     in    view   the   totality    of   facts,   no<br \/>\ninterference is warranted in view of the fact that the charges<br \/>\nunder Sections 341, 294, 324, 506, 34 IPC and 3 (i) (x) of<br \/>\nScheduled         Caste   &amp;        Scheduled     Tribe      (Prevention    of<br \/>\nAtrocities) Act, 1989 are framed and the petitioners are<br \/>\nfacing a trial.\n<\/p>\n<p>      In the result petition fails and is hereby dismissed.<br \/>\nHowever, no costs.\n<\/p>\n<p>                                                 (SANJAY YADAV)<br \/>\n                                                     JUDGE<\/p>\n<p>VT\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Smt.
