WRIT No. 68 of 2002\n\n                                    INDER MAL KOTHARI &amp; ORS\n                                           V\/S\n                                             STATE &amp; ORS\n\n       Mr. MS SINGHVI, for the appellant \/ petitioner\n\n       Mr. DILIP KAWADIA, for the respondent\n\n       Date of Order : 11.2.2010\n\n\n                             HON'BLE SHRI A.M.SAPRE,J.\n                         HON'BLE SHRI DINESH MAHESHWARI,J.\n\n                                            ORDER\n<\/pre>\n<p>                                            &#8212;&#8211;\n<\/p>\n<\/p>\n<pre>             This        is    an     appeal        filed     by    the       writ\n\npetitioners         of        Writ    Petition        No.    303\/2002        under\n\nSection      18   of     the     Rajasthan          High    Court     Ordinance\n\n<\/pre>\n<p>against the judgment\/order dt. 23.1.2002 passed by the<\/p>\n<p>learned Single Judge in the said writ.<\/p>\n<p>(2)          By impugned order, the learned Single Judge<\/p>\n<p>was     pleased     to    dismiss       the     writ       petition     of    the<\/p>\n<p>appellants.\n<\/p>\n<p>(3)          Having heard learned counsel for the parties<\/p>\n<p>at length, and on perusal of the record of the case,<\/p>\n<p>we    have   formed      an    opinion       that     this   appeal     can     be<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>disposed    of    finally         without       adverting        to    the     facts<\/p>\n<p>involved in the writ petition out of which this writ<\/p>\n<p>appeal     arises.          Indeed     it        would    be     now     for    the<\/p>\n<p>appropriate      Court       to    decide        the     issue    involved        in<\/p>\n<p>appeal     on    the    merits       in     accordance           with    law     as<\/p>\n<p>observed infra.\n<\/p>\n<p>(4)         Learned counsel for the parties brought to<\/p>\n<p>our   notice     that       pursuant       to    the     interim       order    dt.<\/p>\n<p>09.12.2009 passed in this appeal, the Secretary, Urban<\/p>\n<p>Improvement      Trust,       Udaipur       has    passed        an    order    dt.<\/p>\n<p>11.2.2005 Annexure R\/1 on the representation of the<\/p>\n<p>appellants which was made to him. In the light of this<\/p>\n<p>subsequent event which has come into existence after<\/p>\n<p>passing of the impugned order which undisputedly has a<\/p>\n<p>bearing over the controversy involved in appeal, we<\/p>\n<p>consider it just and proper to grant liberty to the<\/p>\n<p>appellants       to     challenge          the     order       dt.      11.2.2005<\/p>\n<p>(Annex.      R\/1)       passed       by          the     Secretary,          Urban<\/p>\n<p>Improvement Trust, Udaipur in appropriate proceedings<\/p>\n<p>as may be permissible in law.                          This Court being an<\/p>\n<p>appellate court, would not be in a position to examine<\/p>\n<p>its   legality        for    the     first        time    in     this     appeal.<\/p>\n<p>Moreover, granting liberty would not in any way cause<\/p>\n<p>prejudice to any of the parties.\n<\/p>\n<p>(5)         In case if any such remedy is resorted to by<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>the appellants then, the same would be decided by the<\/p>\n<p>competent court in accordance with law uninfluenced by<\/p>\n<p>any   of   the   observations\/findings            recorded   by   the<\/p>\n<p>learned    Single      Judge   in       the    impugned   order   dt.<\/p>\n<p>23.1.2002 passed in the writ petition out of which<\/p>\n<p>writ appeal arises.\n<\/p>\n<p>(6)        In    the   light   of       the   foregoing   discussion,<\/p>\n<p>this special appeal is finally disposed of.<\/p>\n<p>           No costs.\n<\/p>\n<p>  ( DINESH MAHESHWARI ),J.
