2. The petitioner hes ohallengeo his conviction
\nfor the offence under Seotloh l\ufb01\u00e9 of the Negotiable
\nInstruments Aot \ufb01\u00e9herelnafterr referred to as “the
\nAct”] and the sentence i\ufb01egeon and confirmed in the<\/p>\n
appeal before the Sessions Court.\n<\/p>\n
3. The faot$_rele\u00a7ant for the purpose of this<\/p>\n
appeal hreras under: V<\/p>\n
lg’ rThe_*reshohdent filed a complaint before the<\/p>\n
ff,  Trial Court alleging that in the month of October<\/p>\n
:h_ 1999, athehaaooused approached him for a loan of<\/p>\n
Rf\ufb01e;1}0@,000-00 for business purpose with an<\/p>\n
lbL ass\ufb01rahoe to repay the said loan within a short<\/p>\n
\ufb01eriod. The complainant i.e., the respondent herein<\/p>\n
advanced the hand loan of Rs.1,00,000–00 and in turn<\/p>\n
0 the petitioner i.e., the accused herein issued the<\/p>\n
cheque bearing No.914679, dated 10.04.2000 for the<\/p>\n
3<\/span><\/p>\n
said amount drawn on Karur Vysya Bank Ltd., Ayenue<\/p>\n
Road, Bangalore. The respondent presented the said<\/p>\n
cheque to the bank for encashment and the samejnas”.<\/p>\n
returned with an endorsement of _~’insufficient’=<\/p>\n
funds’. It is again on O9.10.2OQ0.jthe cheqne Rae<\/p>\n
presented for encahsment to_the banker and again it ‘,<\/p>\n
was returned with the sane ‘endcrse\ufb01enti dated\n<\/p>\n
10. 10.2000. Ultimately, ._ u,\\;”e.~3ponci\u00e9ht”‘V issued
\nnotice dated 24.10.2006 denanding the amount and he
\nsent the said,  host and also
\nunder certificate” of’ posting. ._ The said notice
\nreturned with an endorsenent by the postal officials
\nas ‘not ciainedi} the the petitioner did not comply<\/p>\n
with the dem\\a11d,x’ ._the”v.<:_::omplaint came to be filed<\/p>\n
_beforef the Trial_%\u00a7ourt for taking action under<\/p>\n
'dSection 133 of the Act.\n<\/p>\n
‘V:\ufb01’ pnreuance of the summons issued, the<\/p>\n
VW,_\u00a7etitionergappeared before the Trial Court for the<\/p>\n
‘v charge nnder Section 138 of the Act. The trial was<\/p>\n
d>,_held and the respondent was exmined as P.W.1 and in<\/p>\n
“the evidence he got marked documents Exs.P1 to 7.<\/p>\n
it The petitioner was examined as D.W.1 and document<\/p>\n
Ex.B1 was admitted in the evidence. The Trial Court

\nNo.615\/2003 and the said eppeal cane to be dismissed
\nby Judgment andtggrder\ufb01\ufb02datedLihi;Oli2d08 confirming
\nthe conviction and the \u00a7ehtence.,’Aggrieved by the
\nconcurrent”findind of conniction; the petitioner has<\/p>\n
approached this Court in reyiaion.\n<\/p>\n

‘ Rs.25,000-O0. They do not have anything to say with<\/p>\n
regard to the appreciation of the material placed on<\/p>\n
