No.30992 of 2010\n                                      DHIRAJ KUMAR RAI\n                                               Versus\n                                       STATE OF BIHAR\n                                             -----------\n<\/pre>\n<p>3\/      20.01.2011              Heard learned counsel for the petitioner and learned<\/p>\n<p>                      counsel for the State.\n<\/p>\n<p>                                Misappropriation of Rs. 94,46,320\/- is the allegation<\/p>\n<p>                      which was paid to this petitioner for payment to employees and for<\/p>\n<p>                      other works. Spending of money after receiving receipts or<\/p>\n<p>                      vouchers is the explanation for the amount paid to this petitioner<\/p>\n<p>                      as complainant&#8217;s employee          with further submission that<\/p>\n<p>                      petitioner&#8217;s wages for 30 months remained with complainant<\/p>\n<p>                      which he was not paying. So, case was filed in the Labour Court,<\/p>\n<p>                      Siwan. For its realization, its notice was served on complainant,<\/p>\n<p>                      thereafter to justify non-payment of wages, this false case is<\/p>\n<p>                      lodged.\n<\/p>\n<p>                                Considering the facts and circumstance of the case,<\/p>\n<p>                      prayer of the petitioner is allowed.\n<\/p>\n<p>                                In the event of arrest or surrender within one month<\/p>\n<p>                      from the date of receipt\/production of a copy of this order in<\/p>\n<p>                      connection with Complaint Case No. 2358 of 2009 above named<\/p>\n<p>                      petitioner shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                      10,000\/- (ten thousand) with two sureties of the like amount each<\/p>\n<p>                      to the satisfaction of C.J.M., East Champaran, Motihari subject to<\/p>\n<p>                      the conditions as laid down under Section 438(2) of Cr.
