    Petitioner, the accused in S.T.No.263\/1991, was<\/p>\n
convicted  and  sentenced  for  the  offence  under<\/p>\n
Section 138 of Negotiable Instruments Act by Chief<\/p>\n
Judicial   Magistrate,   Kottayam.       Petitioner<\/p>\n
challenged  the  conviction   and  sentence  before<\/p>\n
Sessions  Court,   Kottaym   in  Crl.A.No.172\/2000.<\/p>\n
Learned   Additional   Sessions   Judge,   on   re-<\/p>\n
appreciation of evidence, confirmed the conviction,<\/p>\n
but modified the sentence to simple imprisonment<\/p>\n
for two months, confirming the fine which was<\/p>\n
directed to be paid as compensation.  This revision<\/p>\n
is filed challenging the conviction and sentence.<\/p>\n
    2. Learned counsel appearing for the petitioner<\/p>\n
was not present.  Learned counsel appearing for the<\/p>\n
second  respondent  was   heard  and   perused  the<\/p>\n
records.\n<\/p>\n
    3.  Second   respondent\/complainant   lodged  a<\/p>\n
complaint before Chief Judicial Magistrate’s Court,<\/p>\n
Kottayam alleging that petitioner issued Exhibit P1<\/p>\n
Crl.R.P.No.1215 of 2003    2<\/span><\/p>\n
cheque drawn in Kottayam Branch of Catholic Syrian<\/p>\n
Bank for Rs.1,30,000\/- and when the cheque was<\/p>\n
presented for encashment, under Exhibit P2, it was<\/p>\n
dishonoured and Exhibit P3 intimation was received<\/p>\n
and Exhibit P4 notice was issued by the second<\/p>\n
respondent demanding the amount covered by Exhibit<\/p>\n
P1 cheque and it was received by the petitioner<\/p>\n
under Exhibit P6 acknowledgement, but he failed to<\/p>\n
pay the amount and thereby committed the offence<\/p>\n
under Section 138 of Negotiable Instruments Act.<\/p>\n
Petitioner pleaded not guilty.\n<\/p>\n
     4. Learned Chief Judicial Magistrate, on the<\/p>\n
evidence    of   second  respondent as PW1 and  the<\/p>\n
Manager of the Bank as PW2 and Exhibits P1 to P7,<\/p>\n
convicted the petitioner, finding that evidence of<\/p>\n
PW1 establishes that Exhibit P1 cheque was issued<\/p>\n
towards discharge of an existing liability.     The<\/p>\n
case of the petitioner that transaction was with<\/p>\n
the husband of the second respondent and in that<\/p>\n
transaction, three cheques were issued and no sales<\/p>\n

tax clearance was obtained and no intimation was<\/p>\n
received and therefore, petitioner is not liable to<\/p>\n
pay the amount covered by the cheque was not<\/p>\n
accepted by the learned Chief Judicial Magistrate.<\/p>\n
In   appeal,     learned    Additional  Sessions   Judge<\/p>\n
confirmed that finding.\n<\/p>\n
     5. The records of the learned Chief Judicial<\/p>\n
Magistrate     show    that  petitioner  was  questioned<\/p>\n
under Section 313 of the Code of Criminal Procedure<\/p>\n
on 22.2.2000 after closing the evidence of the<\/p>\n
second respondent on 14.2.2000. The case was then<\/p>\n
posted for filing witness list by the accused.<\/p>\n
Records show that a witness list was filed and an<\/p>\n
application     was    filed  seeking  summons  to   one<\/p>\n
witness, to produce documents.          The proceedings<\/p>\n
paper   also    shows    that  though  the  witness  was<\/p>\n
present     on    5.4.2000,   as   documents  were   not<\/p>\n
available he was not examined.         On 11.4.2000 the<\/p>\n
evidence    was    closed   and  posted  for  arguments.<\/p>\n
Petitioner     thereafter    filed  an  application   to<\/p>\n
Crl.R.P.No.1215 of 2003      4<\/span><\/p>\n
reopen the case pointing out that he has to examine<\/p>\n
the witness.      It was allowed and summons was issued<\/p>\n
to the witness to produce documents.          Case was<\/p>\n
posted to 26.5.2000.         On 26.5.2000 the learned<\/p>\n
Magistrate recorded that “witness present.      She has<\/p>\n
reported that documents are not available.      She is<\/p>\n
discharged.        Evidence  is  closed.    Hearing  to<\/p>\n
8.6.2000”.      The proceedings show that a petition<\/p>\n
was    thereafter      filed  by  the  petitioner   for<\/p>\n
permitting to examine herself.       It was dismissed.<\/p>\n
It is thus clear that the Chief Judicial Magistrate<\/p>\n
disposed     the    case   without providing   adequate<\/p>\n
opportunity to the petitioner to adduce evidence.<\/p>\n
     6. Though it is not alleged in the complaint,<\/p>\n
as PW1 second respondent deposed that Exhibit P1<\/p>\n
cheque was issued towards the payment          for the<\/p>\n
timber supplied to the petitioner.        When she was<\/p>\n
questioned further she admitted that there are<\/p>\n
records to establish the transaction and she is<\/p>\n
willing    to    produce    those records.  As   second<\/p>\n

respondent      did    not  produce   the   documents,<\/p>\n
petitioner filed an application directing her to<\/p>\n
produce    the    documents.    It  is  seen  that  an<\/p>\n
affidavit was filed by the second respondent that<\/p>\n
those records are not available.       In the light of<\/p>\n
the contentions raised by the parties, for the sole<\/p>\n
reason that a cheque was issued which according to<\/p>\n
the petitioner was not issued towards discharge of<\/p>\n
an existing liability or debt, an offence under<\/p>\n
Section 138 of the Negotiable Instruments Act will<\/p>\n
not be attracted.       When the petitioner has a case<\/p>\n
that    he   has    no  transaction  with  the  second<\/p>\n
respondent and to establish his case a witness list<\/p>\n
was filed including examination of the husband of<\/p>\n
the second respondent, learned Magistrate was not<\/p>\n
justified in closing the evidence, when examination<\/p>\n
of the witnesses was not given up.            In such<\/p>\n
circumstances, interest of justice warrants that<\/p>\n
the case is to be remanded to Chief Judicial<\/p>\n
Magistrate     for    fresh  disposal  after  granting<\/p>\n
Crl.R.P.No.1215 of 2003     6<\/span><\/p>\n
opportunity to the accused to examine the witnesses<\/p>\n
sought for in the witness list.      On such evidence<\/p>\n
being    adduced     it  is  for  the  Chief  Judicial<\/p>\n
Magistrate      to    decide  whether  there   was   a<\/p>\n
transaction     between   the complainant\/accused  and<\/p>\n
whether    Exhibit     P1 cheque  was  issued  towards<\/p>\n
discharge of any such debt or liability.<\/p>\n
     7. Revision is allowed.        Conviction of the<\/p>\n
petitioner for the offence under Section 138 of the<\/p>\n
Negotiable      Instruments   Act  as   confirmed   in<\/p>\n
Crl.A.No.172\/2000 is set aside.       S.T.263\/1991 is<\/p>\n
remanded to Chief Judicial Magistrate for fresh<\/p>\n
disposal in accordance with law, after granting<\/p>\n
opportunity to the petitioner\/accused to examine<\/p>\n
the witnesses shown in the witness list.        It is<\/p>\n
made clear that it is for the petitioner to make<\/p>\n
available the witnesses and to take steps to issue<\/p>\n
summons if their presence could be procured only on<\/p>\n
such summons.       The party shall appear before the<\/p>\n
Chief Judicial Magistrate Court on 6.8.2010 and<\/p>\n
Crl.R.P.No.1215 of 2003     7<\/span><\/p>\n
petitioner      will    take  steps   immediately   on<\/p>\n
appearance and shall not protract the case.      Chief<\/p>\n
Judicial      Magistrate    to   dispose   the    case<\/p>\n
expeditiously.      Sent back  records  to  the  Chief<\/p>\n
