Justice M.SASIDHARAN NAMBIAR\n\n Dated :31\/08\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.1877 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner, the accused in C.C.No.276\/2009 on<\/p>\n<p>the file of Additional Chief Judicial Magistrate&#8217;s<\/p>\n<p>Court, Thiruvananthapuram, taken cognizance for the<\/p>\n<p>offences under Sections 294(b), 506(i), 427 and 447<\/p>\n<p>read with Section 34 of Indian Penal Code, filed<\/p>\n<p>this petition under Section 482 of Code of Criminal<\/p>\n<p>Procedure, to quash the proceedings contending that<\/p>\n<p>entire disputes with the third respondent, the<\/p>\n<p>defacto complainant, were settled amicably and in<\/p>\n<p>view of the settlement, it is not in the interest<\/p>\n<p>of justice to continue the prosecution.<\/p>\n<p>    2. Prosecution case is that being agitated by<\/p>\n<p>the demand for Rupees Two lakhs made by the third<\/p>\n<p>respondent,  petitioner,  along  with  unidentified<\/p>\n<p>persons, destroyed the flex boards and electric<\/p>\n<p>bulbs in Building No.TC-2\/1994-1 at about 5 p.m. on<\/p>\n<p>22.2.2009 and also destroyed the lights on the hind<\/p>\n<p><span class=\"hidden_text\">CRMC 1877\/10              2<\/span><\/p>\n<p>side of her Santro car and caused damages to its<\/p>\n<p>door and body by rubbing with a stone and she was<\/p>\n<p>also threatened with dire consequences.<\/p>\n<p>    3. Along with the petition, petitioner produced<\/p>\n<p>Annexure-D affidavit of the third respondent to the<\/p>\n<p>effect that entire disputes between the parties<\/p>\n<p>were settled amicably and she has no subsisting<\/p>\n<p>grievance against the petitioner and therefore, she<\/p>\n<p>has  no    objection for  quashing  the  proceedings<\/p>\n<p>against the petitioner.\n<\/p>\n<p>    4. Learned Public Prosecutor, on instructions,<\/p>\n<p>submitted that statement of the third respondent<\/p>\n<p>was recorded by the Investigating Officer and the<\/p>\n<p>statement   shows  that  entire  disputes  with  the<\/p>\n<p>petitioner were settled amicably.\n<\/p>\n<p>    5. Except the offence under Section 294(b) of<\/p>\n<p>Indian Penal Code, all the other offences are<\/p>\n<p>compoundable.   Considering the   fact  that  entire<\/p>\n<p>disputes    were settled  amicably  with  the  third<\/p>\n<p>respondent and the offences alleged are purely<\/p>\n<p><span class=\"hidden_text\">CRMC 1877\/10              3<\/span><\/p>\n<p>personal in nature, it is not in the interest of<\/p>\n<p>justice to continue with the prosecution as held by<\/p>\n<p>the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of<\/p>\n<p>Punjab<\/a> (2008 (3) KLT 19), Manoj Sharma v. State<\/p>\n<p>(2009 (4) KLT 417) and Nikhil Merchant v. Central<\/p>\n<p>Bureau of Investigation (AIR 2009 SC 428).<\/p>\n<p>     Petition is allowed.
