SHAH\n\t\t\n\t\n\n \n\nDate\n: 22\/06\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent First Appeal under Section 173 of the Motor Vehicles Act has<br \/>\nbeen preferred by the appellant herein &#8211; original claimant<br \/>\nchallenging the impugned judgement and award dated 31\/08\/2010 passed<br \/>\nby learned Motor<br \/>\nAccident Claims Tribunal  (Aux.), Mehsana in Motor<br \/>\nAccident Claim Petition No.1594 of 1995, by which, the<br \/>\nlearned Tribunal has dismissed the said Motor<br \/>\nAccident Claim Petition No.1594 of 1995 preferred by<br \/>\nthe appellant herein &#8211; original claimant.\n<\/p>\n<p>2.\t\tThe<br \/>\nappellant herein &#8211; original claimant had preferred Motor<br \/>\nAccident Claim Petition No.1594 of 1995 before Motor<br \/>\nAccident Claims Tribunal (Aux.), Mehsana claiming<br \/>\ncompensation of Rs.1 Lac alleging inter alia that he had sustained<br \/>\ninjury in vehicular accident, which took place on 23\/10\/1995 and<br \/>\nalleging inter alia that when he was standing on the side of the road<br \/>\nwith his daughter, one Jeep No.GJ-2-9268 driven by Opponent No.1<br \/>\nrashly, negligently and with full speed came and dashed with him and<br \/>\nas a result of which, he had sustained serious injuries.\n<\/p>\n<p>3.\t\tOn<br \/>\nappreciation of evidence and even considering the cross-examination<br \/>\nof the claimant &#8211; Prajapati Rameshbhai Nagardas, examined at Exh.22,<br \/>\nin which, he has admitted that the aforesaid jeep was not involved in<br \/>\nthe accident but he had intentionally joined the said jeep. The<br \/>\nlearned Tribunal by impugned judgment and award dismissed the<br \/>\naforesaid claim petition by holding that it was doubt regarding the<br \/>\ninvolvement of the aforesaid jeep and that the claimant has failed to<br \/>\nprove involvement of Jeep No.GJ-2-9268. Being aggrieved by and<br \/>\ndissatisfied with the impugned judgement and award passed by the<br \/>\nlearned Tribunal in dismissing the aforesaid claim petition, the<br \/>\nappellant &#8211; original claimant preferred the present First<br \/>\nAppeal.\n<\/p>\n<p>4.\t\tHeard<br \/>\nMr.Jayesh Barot, learned advocate appearing on behalf of the<br \/>\nappellant. Mr.Jayesh Barot, learned advocate appearing on behalf of<br \/>\nthe appellant is not in a position to point out any evidence contrary<br \/>\nto the evidence discussed by the learned Tribunal. He is not in a<br \/>\nposition to dispute the findings of the learned Tribunal, which has<br \/>\nbeen given on appreciation of deposition of claimant &#8211; Prajapati<br \/>\nRameshbhai Nagardas, examined at Exh.22. He is also not in a<br \/>\nposition to point out any contrary evidence. Under the circumstances<br \/>\nwhen the appellant &#8211; original claimant has failed to prove the<br \/>\ninvolvement of Jeep No.GJ-2-9268 and in fact claimant has<br \/>\nspecifically admitted in the cross-examination that the aforesaid<br \/>\njeep was not involved in the said accident but he had intentionally<br \/>\njoined the said jeep, it cannot be said that the learned<br \/>\nTribunal has committed any error and\/or illegality in dismissing the<br \/>\naforesaid claim petition. It is to be noted that the complaint was<br \/>\nfiled after a period of three days.
