Justice P.N.RAVINDRAN\n\n Dated :28\/07\/2010\n\n O R D E R\n        J.CHELAMESWAR, C.J. &amp; P.N.RAVINDRAN, J.\n\n                    -------------------------------\n\n    W.A.No.1261 of 2010 &amp; C.M.Appln.No.621 of 2010\n\n                    -------------------------------\n\n             Dated this the 28th day of July, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>J.Chelameswar, CJ.\n<\/p>\n<\/p>\n<p>           C.M.Appln.No.621 of 2010 is filed with a prayer to<\/p>\n<p>condone the delay of 682 days in filing the appeal against the<\/p>\n<p>judgment, dated 20.6.2008, in W.P.(C) No.18053 of 2005. The<\/p>\n<p>substance of the explanation given in the affidavit filed in support<\/p>\n<p>of the petition is that State lost two years in consulting various<\/p>\n<p>persons as to whether appeal should be preferred in the matter<\/p>\n<p>or not. At paragraph 5 of the affidavit, it is stated as follows:-<\/p>\n<blockquote><p>                 &#8220;5.   It is submitted that the delay in filing<br \/>\n           the appeal      was due to the time taken for<br \/>\n           consultation with District Collector, Alappuzha,<br \/>\n           Taxes    Department,       Law    Department     and<br \/>\n           Additional Advocate General regarding scope for<br \/>\n           appeal.     It has not come to the notice of<br \/>\n           Government that the appeal time was over by<br \/>\n           this time. It is also submitted that the delay in<br \/>\n           filing the appeal was not due to any wilful<br \/>\n           negligence or laches on the part of the<br \/>\n           petitioner.&#8221;\n<\/p><\/blockquote>\n<p>W.A.No.1261 of 2010 &amp; C.M.Appln.No.621 of 2010<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>            2. The most interesting part of the narration is that<\/p>\n<p>the    Under    Secretary     to       the    Government  of  Kerala,<\/p>\n<p>Mr.R.P.Raheem, who is the deponent of this affidavit made it<\/p>\n<p>bold to put on record that &#8220;it has not come to the notice of<\/p>\n<p>Government that the appeal time was over by this time&#8221;.<\/p>\n<p>            3. The period of limitation to file a writ appeal is 30<\/p>\n<p>days from the relevant date.\n<\/p>\n<p>            4. The certified copy of the judgment which is sought<\/p>\n<p>to be appealed against was admittedly               received by the<\/p>\n<p>Government on 8.8.2008. On the face of such fact, we simply<\/p>\n<p>fail to understand as to how the deponent believes or states that<\/p>\n<p>the Government has not noticed of the fact that the period of<\/p>\n<p>limitation for preferring the appeal is over. The above extracted<\/p>\n<p>sentence to our view only demonstrates                  the absolute<\/p>\n<p>carelessness in filing the affidavit apart from utter lack of respect<\/p>\n<p>for the Rule of Law on the part of the deponent of the affidavit.<\/p>\n<p>He also believes that the delay is not due to any willful<\/p>\n<p>negligence or laches. If the various offices of the State consume<\/p>\n<p>a period of two years on the question whether an appeal should<\/p>\n<p>W.A.No.1261 of 2010 &amp; C.M.Appln.No.621 of 2010<\/p>\n<p><span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>be preferred in the given case or not, where the period of<\/p>\n<p>limitation is 30 days, it is hard to accept that there is neither<\/p>\n<p>negligence nor laches on the part of various functionaries<\/p>\n<p>involved.   Lastly, we &#8220;admire&#8221; the temerity of the deponent in<\/p>\n<p>stating   that &#8220;it is only just and proper that this Honourable<\/p>\n<p>Court may be pleased to condone the delay of 682 days in filing<\/p>\n<p>the above appeal&#8221;.          Such a statement, in one view, is also<\/p>\n<p>capable of being construed as a statement dictating the course of<\/p>\n<p>action to this Court.\n<\/p>\n<p>              In the circumstances, C.M.Appln.No.621 of 2010 is<\/p>\n<p>dismissed with a cost of Rs.5000\/- to the Kerala State Legal<\/p>\n<p>Services Committee.
