Justice R.BASANT\n\n Dated :21\/03\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                              ----------------------\n\n                          Crl.M.C.No.587 of 2007\n\n                        ----------------------------------------\n\n                 Dated this the 21st  day of March 2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      The   petitioners   are   accused   in   C.P.No.61\/06   before   the<\/p>\n<p>learned   Judicial   First   Class   Magistrate   Court   III,   Kozhikode.\n<\/p>\n<p>Cognizance   has  been   taken   on   the   basis   of   a   private   complaint<\/p>\n<p>filed by the complainant that is the first respondent herein.  The<\/p>\n<p>grievance   of   the   petitioners   is   that   cognizance   has   been   taken<\/p>\n<p>and process issued against the petitioners in gross disregard of<\/p>\n<p>the   settled   provisions   of   law.     Active   and   alert   application   of<\/p>\n<p>mind   to   the   relevant   facts   has   not   been   made   by   the   learned<\/p>\n<p>Magistrate.  In these circumstances, it is prayed that cognizance<\/p>\n<p>taken may be set aside.\n<\/p>\n<p>      2.     The   report   of   the   learned   Magistrate   was   called   for.\n<\/p>\n<p>The learned Magistrate fairly submits that cognizance was taken<\/p>\n<p>without   adverting   to   the   final   report   submitted   by   the<\/p>\n<p>investigating officer wherein the investigating officer  had found<\/p>\n<p>that the allegations are not sustainable.  The learned Magistrate<\/p>\n<p>submits   that   cognizance   was   taken   without   adverting   to   the<\/p>\n<p>principles in <a href=\"\/doc\/412866\/\">Vijayalaxmi v. Thomas<\/a> [2002(3)KLT 530]<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.587\/07                         2<\/span><\/p>\n<p>       3.     Notice has been given  to the  learned counsel  for  the<\/p>\n<p>respondent.     The   learned   counsel   for   the   respondent   has   not<\/p>\n<p>entered appearance.   I am, in these circumstances satisfied that<\/p>\n<p>the matter can be disposed of on merits now.\n<\/p>\n<p>4.     In   as   much   as   cognizance   has   been   taken   admittedly<\/p>\n<p>without   properly   adverting   to   the   legal   principles,   I   am   not     in<\/p>\n<p>any   way   intending   to   express   any   opinion   on   merits   about   the<\/p>\n<p>acceptability   of   the   complaint.     I   am   satisfied   that   cognizance<\/p>\n<p>taken   can   be   set   aside   and   the   learned   Magistrate   can   be<\/p>\n<p>directed to consider the matter afresh.   The learned Magistrate<\/p>\n<p>must   consider   the   matter   afresh   uninfluenced   by   the   course<\/p>\n<p>adopted by the learned Magistrate earlier or the course adopted<\/p>\n<p>by this court in setting aside the cognizance taken.  In short, the<\/p>\n<p>matter   will   have   to   be   considered   afresh   and   appropriate<\/p>\n<p>decision  taken on  the   question   whether  cognizance  deserves  to<\/p>\n<p>be   taken.     Needless   to  say,  the   learned   Magistrate   can   call   for<\/p>\n<p>the   refer   report   in   the   case   even   if   it   were   filed   before   some<\/p>\n<p>other court.\n<\/p>\n<p>                                                        (R.BASANT, JUDGE)<\/p>\n<p>jsr<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.587\/07                     3<\/span><\/p>\n<p>      The grievance of the petitioner is that cognizance has been<\/p>\n<p>taken by  the   learned  Magistrate  in   a private  complaint  filed  by<\/p>\n<p>the   respondent\/complainant   without   reference   at   all   to   the<\/p>\n<p>negative   final   report   filed   earlier   before   the   learned   Chief<\/p>\n<p>Judicial Magistrate by the investigating police official.   This, the<\/p>\n<p>counsel   contends,   runs   counter   to   the   dictum   in  Vijayalaxmi   v.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.587\/07                     4<\/span><\/p>\n<p>Thomas   [2002(3)KLT   530].     Call   for   a   report   from   the   learned<\/p>\n<p>Magistrate.     Was   the   final   report   available   before   the   learned<\/p>\n<p>Magistrate when cognizance was taken?
