No.M-34450 of 2008<\/p>\n<p>            Notice of motion.\n<\/p>\n<p>            On the asking of the Court, Mr.S.S.Mor, learned Senior<br \/>\nDeputy Advocate General, Haryana accepts notice on behalf of the<br \/>\nrespondents.\n<\/p>\n<p>            The petitioner is undergoing life imprisonment following his<br \/>\nconviction by the learned Trial Judge on 5.11.2001 in case FIR No. 558<br \/>\ndated 15.7.1996 registered at Police Station Sadar, Hisar under Sections<br \/>\n302, 307, 148, 149 IPC.\n<\/p>\n<p>            In view of the averment made in the course of the petition,<br \/>\nlearned State counsel states that the competent authority shall dispose of<br \/>\nthe premature release plea of the petitioner-prisoner in the light of the Apex<br \/>\nCourt judgment in State of Haryana Vs. Mahender Singh and others<br \/>\n2007 (4) RCR (Criminal) 909 and a Division Bench judgment of this Court<br \/>\nin Crl. Misc. No.12868-M of 2003 (Jiya Lal Vs. State of Haryana and<br \/>\nothers) within two months from today.\n<\/p>\n<p>            There is no controversy otherwise that a review plea filed by<br \/>\nthe State of Haryana       in Mahender Singh&#8217;s case (supra) has been<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No.M-34450 of 2008                          -2-<\/span><\/p>\n<p>                                ****<\/p>\n<p>dismissed by the Apex Court.\n<\/p>\n<p>            In Mahender Singh&#8217;s case, the Apex Court had held that the<br \/>\npolicy in currency on the date of conviction of a prisoner would govern<br \/>\nconsideration of a premature release plea. The petitioner before this Court<br \/>\nhaving been convicted on 5.11.2001, his case has to be governed by the<br \/>\npolicy which was in force on the date of the conviction.\n<\/p>\n<p>            On ascertainment of the correctness of the averment made by<br \/>\nthe petitioner qua the period of actual sentence undergone by him, the<br \/>\nSuperintendent of the Jail concerned (where the petitioner is presently<br \/>\nlodged), shall unconditionally release him forthwith. This order shall be<br \/>\nFAXED to the Superintendent Jail concerned.\n<\/p>\n<p>            In order to avoid any ambiguity, it is made clear that the<br \/>\npetitioner shall be unconditionally released only if the Superintendent of Jail<br \/>\nconcerned finds that the petitioner-prisoner has indeed undergone the<br \/>\nactual period of sentence which he was required to undergo under the<br \/>\npolicy in currency on the date of the conviction.\n<\/p>\n<p>            The petition shall stand disposed of accordingly.             The<br \/>\ncompetent authority is directed to dispose of the premature release plea of<br \/>\nthe petitioner-prisoner in the light of the Apex Court judgment in State of<br \/>\nHaryana Vs. Mahender Singh and others 2007 (4) RCR (Criminal) 909<br \/>\nand a Division Bench judgment of this Court in Crl. Misc. No.12868-M of<br \/>\n2003 (Jiya Lal Vs. State of Haryana and others) within two months from<br \/>\ntoday. It will be for the State counsel to communicate the order to the<br \/>\ncompetent authority.\n<\/p>\n<p>            Copy of the order be given to the learned State counsel under<br \/>\nthe signatures of the Court Secretary.\n<\/p>\n<p>            Copy of this order be given dasti to the learned counsel for the<br \/>\npetitioner on payment of usual charges.\n<\/p>\n<pre>December 24, 2008                                    (S.D.
