JOSEPH, JJ.\n                        --------------------------------------\n                          W.A.No.1445 of 2007\n                        -------------------------------------\n                       Dated 5th December, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>           Respondent\/petitioner joined the Department of Health<\/p>\n<p>Services as Assistant Surgeon on 26.7.1982.                She was sanctioned leave<\/p>\n<p>without allowances for pursuing post graduate studies.                  The whole<\/p>\n<p>question is whether the leave period sanctioned for pursuing post<\/p>\n<p>graduate studies can be counted for granting higher grade. Learned<\/p>\n<p>single Judge allowed the writ petition mainly relying on Ext.P2 order.<\/p>\n<p>This writ appeal is filed by the State.                It is the contention of the<\/p>\n<p>appellants that Ext.P2 is not strictly applicable in the petitioner&#8217;s case.<\/p>\n<p>The question regarding similarly placed persons was considered by a<\/p>\n<p>Division Bench of this court in which one of us (J.B.Koshy, J) was a party<\/p>\n<p>in W.A.No.1978 of 2006 by judgment dated 30th September, 2008. After<\/p>\n<p>considering various contentions of the parties in detail and also<\/p>\n<p>considering the Government Order dated 28.12.2000 the Division Bench<\/p>\n<p>have held that the officers in the Health Department are entitled to get<\/p>\n<p>the above benefit. Clause 3 of the above Government Order reads as<\/p>\n<p>follows:\n<\/p>\n<p><span class=\"hidden_text\">W.1445\/2007                       2<\/span><\/p>\n<blockquote><p>        &#8220;3. Government have examined the matter in<br \/>\n            detail and are pleased to extend the benefit of<br \/>\n            the government order read above to the<br \/>\n            medical officers of the health services who<br \/>\n            went on leave for P.G.Degree\/Diploma after<br \/>\n            the introduction of Rule 91.A Part I. Kerala<br \/>\n            Service Rules as a special case subject to the<br \/>\n            following conditions;\n<\/p><\/blockquote>\n<blockquote><p>            I. The benefit will not be admissible to those<br \/>\n            who have already quit the service.<br \/>\n            II. Grant of increment would be notional.<br \/>\n            III. Cases of time bound higher grade already<br \/>\n            sanctioned will not be re-opened and<br \/>\n            IV. Grant of increment would be subject to the<br \/>\n            production of proof of successful completion of<br \/>\n            the course and award of degree\/diploma.&#8221;\n<\/p><\/blockquote>\n<p>It is contended by the Government Pleader that time bound higher<\/p>\n<p>grade already sanctioned will not be re-determined. So, it cannot be<\/p>\n<p>reopened. But, respondent was not granted higher grade taking into<\/p>\n<p>account the period of study leave availed by him for obtaining post<\/p>\n<p>graduate degree. The above clause was intended for granting higher<\/p>\n<p>grade to medical officers who went on leave for higher grade after<\/p>\n<p>the introduction of Rule 91.A Part I of Kerala Service Rules. With<\/p>\n<p>regard to granting of higher grade, conditions 1 and 2 are satisfied.<\/p>\n<p>Petitioner was not given higher grade taking into account the period<\/p>\n<p>she was sanctioned leave for pursuing higher studies. According to<\/p>\n<p>the Government Order, the above benefit was given as it will benefit<\/p>\n<p>the health department as department will get services of qualified<\/p>\n<p>doctors.   Division Bench in    W.A.No. 1978 of 2006      held that<\/p>\n<p><span class=\"hidden_text\">W.1445\/2007                       3<\/span><\/p>\n<p>benefit given to the doctors in the Medical College was extended by<\/p>\n<p>the above Government Order and held that members of the health<\/p>\n<p>services are also entitled to increments during the period of such<\/p>\n<p>leave sanctioned by the Government. In view of Ext.P2 Government<\/p>\n<p>Order, we are of the opinion that no interference is required in the<\/p>\n<p>impugned judgment.\n<\/p>\n<p>           The appeal is dismissed.\n<\/p>\n<\/p>\n<p>                                                 J.B.KOSHY<br \/>\n                                                    JUDGE<\/p>\n<p>                                            THOMAS P.
