Whether the building may be\nregularized if new construction made on passed map at place of open area? If yes, certified\ncopy of rules\/circular\/official order thereof. Provide details of document required for passing\nmap of a building. The Appellant sought certified copy of details with copy of map passed,\nno. of days under which map is accepted or rejected after submitting required documents.\n\nPIO's Reply:\n   1. Applicant does not seek any information as per various provisions RTI Act, 2005.\n   2 to 9. Same as (1).\n\nGrounds for First Appeal:\nInformation was not provided till date.\n\nOrder of the First Appellate Authority:\n\n\n                                                                                   Page 1 of 3\n \"PIO\/SE\/SPZ may review the same. Information pertaining to general policy of sanction of\nbuilding plans. The same may be provided within ten days.\"\n\n\nGrounds for Second Appeal:\nAppellant requested for completed information with documents.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Harish Kumar;\n<\/p>\n<p>Respondent: Mr. N. K. Gupta, Public Information Officer &amp; SE;\n<\/p>\n<p>         The Appellant has framed the queries in a manner where some of the queries would<br \/>\namount to clarifications rather that information. The Appellant&#8217;s contention is that the<br \/>\nsanction of building plan is being done on the basis of the building byelaws of 1983 alongwith<br \/>\nMaster Plan of Delhi-2021 read alongwith various orders issued by Municipal Authorities at<br \/>\ndifferent times. Consequently he states that since most citizens do not have access to the<br \/>\noffice orders issued by these authorities there is lot of arbitrariness in sanctioning the plans.<br \/>\nThe PIO states that all the orders issued by various authorities in connection with Sanction of<br \/>\nBuilding Plans are available with Superintending Engineer Building (HQ) Mr. R. K. Sharma.<br \/>\nThe Commission orders Superintending Engineer Building (HQ) Mr. R. K. Sharma to provide<br \/>\nall the relevant orders\/circulars based on which building plans are sanctioned and regularized.<br \/>\nThe Commission also directs Mr. R. K. Sharma to ensure that all such order\/circulars are<br \/>\nputup on the website of the MCD so that all citizens are aware of these. In case any fresh<br \/>\norders or circulars are issued these should also be updated on the website.\n<\/p>\n<p>The Appellant has also sought the list of properties booked for unauthorized construction<br \/>\nfrom 01\/04\/2007 to 30\/09\/2009. Effectively this means the photocopy of the missal band<br \/>\nregisters for this period. The PIO states that this is in the custody of Executive Engineer (B)<br \/>\nMr. A. K. Singh. The PIO states that he has asked Mr. A. K. Singh to provide the information<br \/>\nbut is unable get Mr. Singh to provide it.\n<\/p>\n<p>The Appellant states that he would like to inspect the records of sanctioned building plan<br \/>\nfiles. The Commission directs the PIO Mr. N. K. Gupta to facilitate an inspection of these file<br \/>\non 15 April 2010 at 10.00AM at the office of the PIO.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>        The Commission directs Mr. R. K. Sharma, Superintending Engineer Building (HQ)<br \/>\nto provide all the relevant orders\/circulars based on which building plans are sanctioned and<br \/>\nregularized to the Appellant before 05 April 2010.\n<\/p>\n<p>The Commission also directs Mr. R. K. Sharma to ensure that all such order\/circulars are<br \/>\nputup on the website of the MCD before 15 April 2010.\n<\/p>\n<p>The Commission directs Executive Engineer (B) and deemed PIO to provide the photocopy of<br \/>\nthe missal band register for the period 01\/04\/2007 to 30\/09\/2009 to the appellant before 05<br \/>\nApril 2010.\n<\/p>\n<p><span class=\"hidden_text\">                                                                                     Page 2 of 3<\/span><\/p>\n<p> The PIO Mr. N. K. Gupta is directed to facilitate an inspection of the records to the Appellant<br \/>\non 15 April 2010 at 10.00AM. The PIO will give photocopies of records which appellant<br \/>\nwants free of cost upto 500 pages.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information<br \/>\nby the deemed PIO Executive Engineer (B) Mr. A. K. Singh within 30 days as required<br \/>\nby the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the deemed PIO is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act.\n<\/p>\n<p>A showcause notice is being issued to him, and he is directed give his reasons to the<br \/>\nCommission to show cause why penalty should not be levied on him.\n<\/p>\n<p>Executive Engineer (B) Mr. A. K. Singh will give his written submissions showing cause why<br \/>\npenalty should not be imposed on him as mandated under Section 20 (1) before 15 April<br \/>\n2010.
