PUBLIC PROSECUTOR for\nAppellant(s) : 1, \nMR SHAKIL S SHAIKH for Opponent(s) :\n1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 23\/08\/2010\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant has preferred this Appeal under Section 378 of the Code of<br \/>\n\tCriminal Procedure, 1973 against the Judgment and Order of acquittal<br \/>\n\tdated 18th September 2002 passed by the learned Judicial<br \/>\n\tMagistrate First Class, Dabhol, in Criminal Case No.2556 of 1988 for<br \/>\n\tthe offences punishable under Sections 409 and 477(A) of the Indian<br \/>\n\tPenal Code, whereby the learned Magistrate has acquitted the<br \/>\n\trespondents-accused of the charges levelled against them.\n<\/p>\n<p>The<br \/>\n\tshort facts of the prosecution case is that the respondent-accused<br \/>\n\twas serving as Clerk in Vadodara Bhagol R.S. Post Office during the<br \/>\n\tperiod from 05th June 1980 to 07th January<br \/>\n\t1983. It is the case of the prosecution that during the aforesaid<br \/>\n\tperiod, the respondent-accused did not credit the amount collected<br \/>\n\tfrom the Savings Bank Account holders, CTD Account and Time Deposit<br \/>\n\tAccount holders in the concerned registers and by forging the<br \/>\n\tsignature of respective account holders, the respondent-accused has<br \/>\n\tmisappropriated an amount of Rs.84,080.70 paisa for his personal use<br \/>\n\tand thereby committed offence under Section 409 and 477(A) of the<br \/>\n\tIndian Penal Code.  When the said facts came to the notice,<br \/>\n\tcomplaint was filed with Dabhol Police Station against the<br \/>\n\trespondent-accused and after investigation, respondent-accused was<br \/>\n\tcharge-sheeted for the said offences.\n<\/p>\n<p>Thereafter<br \/>\n\tthe trial was conducted before the learned Magistrate. To prove the<br \/>\n\tcase of the prosecution, prosecution has produced oral as well as<br \/>\n\tdocumentary evidence. After considering the oral as well as<br \/>\n\tdocumentary evidence, the learned Magistrate has acquitted the<br \/>\n\trespondent-accused from the charges alleged against him by Judgment<br \/>\n\tand Order of acquittal dated 18th September 2002.\n<\/p>\n<p>Being<br \/>\n\taggrieved and dissatisfied with the said Judgment and Order of<br \/>\n\tacquittal dated 18th September 2002 passed by the learned<br \/>\n\tJudicial Magistrate First Class, Dabhol, in Criminal Case No.2556 of<br \/>\n\t1988, the appellant-State of Gujarat, has preferred the above<br \/>\n\tmentioned Criminal Appeal.\n<\/p>\n<p>I<br \/>\n\thave heard Mr.H.L. Jani, learned Additional Public Prosecutor for<br \/>\n\tappellant. I have also gone through the papers and the Judgment and<br \/>\n\tOrder passed by the learned Magistrate.\n<\/p>\n<p>Mr.Jani,<br \/>\n\tlearned Additional Public Prosecutor, has contended that the<br \/>\n\tJudgment and Order of acquittal passed by the learned Magistrate is<br \/>\n\tnot proper, legal and it is erroneous. He has also argued that the<br \/>\n\tlearned Magistrate has not considered the evidence of the<br \/>\n\tcomplainant. He has also contended that the learned Magistrate has<br \/>\n\tpassed the order without appreciating the facts of the case. He has<br \/>\n\tcontended that the learned Magistrate ought to have considered the<br \/>\n\tfact that the respondent-accused has credited the amount in<br \/>\n\tpassbook; however, the same was not entered into the concerned<br \/>\n\tregister. He has further contended that the respondent-accused has<br \/>\n\tforged the signature of the account holders and thereby committed<br \/>\n\tthe offence under Sections 409 and 477(A) of the Indian Penal Code.<br \/>\n\tHe has further contended that the respondent-accused has<br \/>\n\tmisappropriate huge amount of Rs.84,080.70 paisa. Prosecution has<br \/>\n\talso proved beyond reasonable doubt the case against the<br \/>\n\trespondent-accused. He, therefore, contended that the order of<br \/>\n\tacquittal passed by the learned Magistrate is without appreciating<br \/>\n\tthe facts and evidence on record and is required to be quashed and<br \/>\n\tset aside by this Hon&#8217;ble Court.\n<\/p>\n<p>It<br \/>\n\tis a settled legal position that in acquittal appeal, the Appellate<br \/>\n\tCourt is not required to re-write the judgment or to give fresh<br \/>\n\treasonings when the Appellate Court is in agreement with the reasons<br \/>\n\tassigned by the trial Court acquitting the accused. In the instant<br \/>\n\tcase, this Court is in full agreement with the reasons given and<br \/>\n\tfindings recorded by the trial Court while acquitting the<br \/>\n\trespondents-accused and adopting the said reasons and for the<br \/>\n\treasons aforesaid, in my view, the impugned judgment is just, legal<br \/>\n\tand proper and requires no interference by this Court. Hence, this<br \/>\n\tappeal requires to be dismissed.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa Vs. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe Court has reiterated the powers of the High Court in such cases.<br \/>\n\tIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p>\t 16.\tFrom<br \/>\n\tthe aforesaid decisions, it is apparent that while exercising the<br \/>\n\tpowers in appeal against the order of acquittal, the Court of appeal<br \/>\n\twould not ordinarily interfere with the order of acquittal unless<br \/>\n\tthe approach of the lower Court is vitiated by some manifest<br \/>\n\tillegality and the conclusion arrived at would not be arrived at by<br \/>\n\tany reasonable person and, therefore, the decision is to be<br \/>\n\tcharacterized as perverse. Merely because two views are possible,<br \/>\n\tthe Court of appeal would not take the view which would upset the<br \/>\n\tjudgment delivered by the Court below. However, the appellate court<br \/>\n\thas a power to review the evidence if it is of the view that the<br \/>\n\tconclusion arrived at by the Court below is perverse and the Court<br \/>\n\thas committed a manifest error of law and ignored the material on<br \/>\n\trecord. A duty is cast upon the appellate court, in such<br \/>\n\tcircumstances, to re-appreciate the evidence to arrive to a just<br \/>\n\tdecision on the basis of material placed on record to find out<br \/>\n\twhether any of the accused is connected with the commission of the<br \/>\n\tcrime he is charged with.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex Court in the cases of State<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553<br \/>\n\tand in Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\n\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417,<br \/>\n\twherein it is held as under:\n<\/p>\n<p>\t   &#8230;\n<\/p>\n<p>\tThis court has observed in Girija<br \/>\n\tNandini Devi Vs Bigendra Nandini Chaudhary (1967)1 SCR 93 : (AIR<br \/>\n\t1967 SC 1124)<br \/>\n\tthat it is not the duty of the appellate court when it agrees with<br \/>\n\tthe view of the trial court on the evidence to repeat the narration<br \/>\n\tof the evidence or to reiterate the reasons given by the trial court<br \/>\n\texpression of general agreement with the reasons given by the Court<br \/>\n\tthe decision of which is under appeal, will ordinarily suffice.\n<\/p>\n<p>Thus,<br \/>\n\tin case the Appellate Court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p>I<br \/>\n\thave gone through<br \/>\n\tthe order of acquittal passed by the learned Magistrate. I have also<br \/>\n\tperused the oral as well as documentary evidence led before the<br \/>\n\ttrial Court and also considered the submissions made by learned<br \/>\n\tcounsel for the parties.\n<\/p>\n<p>The<br \/>\n\ttrial Court has, after appreciating the oral as well as documentary<br \/>\n\tevidence, found that the prosecution has failed to prove that the<br \/>\n\trespondent-accused was in possession of Passbook, Ledger Card and<br \/>\n\tRegisters. Even prosecution has failed to produce on record any<br \/>\n\tcomplaint of account holder regarding misappropriation of funds of<br \/>\n\this money by the respondent-accused. The trial Court has also<br \/>\n\tobserved that the prosecution has failed to prove that the<br \/>\n\trespondent-accused had misappropriated the amount.  Even, witnesses<br \/>\n\thave also not  supported the case of the prosecution. Thus, the<br \/>\n\tprosecution has failed to prove the case beyond reasonable doubt<br \/>\n\tagainst the respondent-accused. The prosecution has failed to prove<br \/>\n\tingredients of Section 409 and 477(A) of the Indian Penal Code<br \/>\n\tagainst the respondent-accused. The trial Court has observed that<br \/>\n\tthere are serious lacuna in the oral as well as documentary evidence<br \/>\n\tof prosecution. Nothing is produced on record of this appeal to<br \/>\n\trebut the concrete findings of the Trial Court.\n<\/p>\n<p>Thus,<br \/>\n\tthe appellant could not bring home the charges against the<br \/>\n\trespondent-accused in the present appeal. The prosecution has<br \/>\n\tmiserably failed to prove the case against the respondents-accused.<br \/>\n\tThus, from the evidence itself it is established that the<br \/>\n\tprosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor, is not in a position to<br \/>\n\tshow any evidence to take a contrary view in the matter or that the<br \/>\n\tapproach of the trial Court is vitiated by some manifest illegality<br \/>\n\tor that the decision is perverse or that the trial Court has ignored<br \/>\n\tthe material evidence on record.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\ttrial Court was completely justified in acquitting the<br \/>\n\trespondent-accused of the charges levelled against him.\n<\/p>\n<p>I<br \/>\n\tfind that the findings recorded by the trial Court are absolutely<br \/>\n\tjust and proper and in recording the said findings, no illegality or<br \/>\n\tinfirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\ttrial Court and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby dismissed. Record<br \/>\n\tand Proceedings to be sent back to the trial Court, forthwith.  Bail<br \/>\n\tbonds, if any, shall stands cancelled.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
