Noorjhan Begum vs Syed Nazar Ali on 10 August, 2010<\/div>\n<pre>                         W.P.No.9937\/2010\n\n  Smt.Noorjhan Begum                         Syed Nazar Ali &amp; another\n\n\n\n\n10.8.2010\n       Shri Jitesh Shrivastava, counsel for petitioner.\n       Shri R.P.Khare, counsel for respondents.<\/pre>\n<p>       This petition is directed against an order dated 8.4.2010<br \/>\npassed by II Additional District Judge, Jabalpur, by which an<br \/>\napplication filed by the petitioner under Order 26 Rule 1 read with<br \/>\nOrder 26 Rule 9 C.P.C., was rejected.\n<\/p>\n<p>       The petitioner prayed before the trial Court that she is a<br \/>\nMuslim pardanasheen lady and as per the custom of                  Muslim<br \/>\ncommunity pardanasheen ladies are not appearing in the Court and<br \/>\nprayed for issuance of commission for her examination. Apart from<br \/>\nthis petitioner is also sick.\n<\/p>\n<p>       The trial Court rejected the application on the ground that<br \/>\npetitioner herself appeared in the office of Sub Registrar, Registration<br \/>\nand executed the sale deed. Her photograph was also taken in the<br \/>\noffice of Sub Registrar.        The application was not supported by an<br \/>\naffidavit, so it was rejected.\n<\/p>\n<p>       Before this Court learned counsel for parties have agreed that<br \/>\nif the statement of petitioner on commission is recorded in the office<br \/>\nof Advocate of either party, the respondents have no objection. The<br \/>\naforesaid contention is made by Shri Khare on the ground that as<br \/>\nthere is serious dispute in the matter and petitioner herein has<br \/>\nalienated the property in favour of respondent no.2, so it would not<br \/>\nbe appropriate if the commission is issued for recording statement of<br \/>\npetitioner at her house.\n<\/p>\n<p>       To this contention, learned counsel for petitioner submitted<br \/>\nthat he has no objection if the statement is recorded in the office of<br \/>\nShri R.P.Khare, Advocate or in his office. Shri Khare has agreed that<br \/>\nif the statement is recorded in the office of Shri Jitesh Shrivastava,<br \/>\nAdvocate, he has no objection.\n<\/p>\n<p>       In view of aforesaid, with the consent of parties, this petition is<br \/>\n                           W.P.No.9937\/2010<\/p>\n<p>     Smt.Noorjhan Begum                      Syed Nazar Ali &amp; another<\/p>\n<p>finally disposed of with following directions :-\n<\/p>\n<p>1.       The trial Court is directed to issue a commission for recording<br \/>\nstatement of petitioner on commission.\n<\/p>\n<p>2.       The aforesaid commission shall be executed in the office of<br \/>\nShri Jitesh Shrivastava, Advocate on the date and time, as may be<br \/>\nfixed by the trial Court.\n<\/p>\n<p>3.
