                            Judgment<\/p>\n
          Faced with the concurrent findings against them,<\/p>\n
the defendants in OS No.874\/03 have come up in appeal.<\/p>\n
The parties and facts are hereinafter referred to as they<\/p>\n
are available before the Trial Court.\n<\/p>\n
          2. The plaintiffs claimed to be in absolute<\/p>\n
possession and enjoyment of the plaint schedule property,<\/p>\n
which they claim to have been obtained under Exts.A1 and<\/p>\n
A6. They were residing away from the property and the<\/p>\n
property was being looked after by their children. It is<\/p>\n
claimed that the property has well laid compound wall on<\/p>\n
all the four sides. According to the plaintiffs, taking<\/p>\n
advantage of the absence of the plaintiffs from the said<\/p>\n
property, the defendants used to pluck tender coconuts<\/p>\n
from the coconut trees in the property. In spite of several<\/p>\n
warnings, they continued the said practice. On 28.05.2003,<\/p>\n

the defendants demolished a portion of the compound wall<\/p>\n
on the western side of the property and tried to trespass<\/p>\n
into the property.     Timely intervention by the plaintiffs<\/p>\n
prevented the trespass by the defendants. Apprehending<\/p>\n
further trespass into the property, the suit was laid.<\/p>\n
           3.    Defendants 1 and 2 resisted the suit.\n<\/p>\n
According to them, the plaintiffs have no manner of right<\/p>\n
over the suit property. They say that the documents relied<\/p>\n
by the plaintiffs are fraudulent and they did not derive any<\/p>\n
right over the suit property. The suit property, according to<\/p>\n
them, is part of 31 cents of land jointly owned by the first<\/p>\n
defendant, her brothers and sisters. The plaintiffs are total<\/p>\n
strangers to the defendants. There was an earlier suit as<\/p>\n
OS No.290\/1969 in respect of 5 cents of land and the said<\/p>\n
suit was dismissed. That suit was laid by the predecessor-<\/p>\n
in-interest of the plaintiffs. Pointing out that the plaintiffs<\/p>\n
have no manner of right over the suit property, they prayed<\/p>\n
for dismissal of the suit.\n<\/p>\n

          4. The Trial Court raised necessary issues for<\/p>\n
consideration. The evidence consists of the testimony of<\/p>\n
PWs 1 and 2 and documents marked as Exts.A1 to A7<\/p>\n
from the side of the plaintiffs. The defendants did not<\/p>\n
examine any witness, but they produced Exts.B1 to B5.<\/p>\n
Exts.C1 and C1(a) were the Commissioner’s report and<\/p>\n
plan and CW1 was examined as court witness.<\/p>\n
          5. The Trial Court, on an evaluation of the<\/p>\n
evidence on record, found that though there was a mis-<\/p>\n
description of the property in the plaint, the Commissioner<\/p>\n
has properly identified the property and there was not much<\/p>\n
dispute regarding the identity of the property. The Trial<\/p>\n
Court also found that the plaintiffs have title and<\/p>\n
possession over the property. It was also found that the<\/p>\n
defendants have no manner of right over the suit property.<\/p>\n
On the basis of these findings, the suit was decreed.<\/p>\n
          6. The matter was carried in appeal by the<\/p>\n
defendants as AS No.392\/06 before the District Court,<\/p>\n
Thiruvananthapuram.         The   District   Court, on  an<\/p>\n

independent consideration of the evidence before it, came<\/p>\n
to the same conclusion as that of the Trial Court and<\/p>\n
dismissed the appeal. Hence the Second Appeal.<\/p>\n
            7. The learned counsel for the appellants<\/p>\n
pointed out before this Court that being a suit for injunction,<\/p>\n
the primary concern is one of possession and the identity<\/p>\n
of the property. It is incumbent on the part of the plaintiffs<\/p>\n
to show that they are in possession of the property<\/p>\n
exclusively and also that they are entitled to the property<\/p>\n
over which they laid their claim. Drawing attention of this<\/p>\n
Court to the description of the plaint schedule property in<\/p>\n
the plaint, it was pointed out that it does not tally with the<\/p>\n
description of property in the Commissioner’s report and<\/p>\n
the property lies elsewhere. It is sufficient to non-suit the<\/p>\n
plaintiff. Unfortunately, the court below omitted to note this<\/p>\n
vital aspect which has resulted in a wrong decision, it is<\/p>\n
contended.\n<\/p>\n
            8. Though the above argument may look<\/p>\n
attractive at the first blush, it can be seen to be without any<\/p>\n

basis whatsoever on a close scrutiny of the evidence on<\/p>\n
record. The Commissioner’s report and evidence was<\/p>\n
made available for perusal. It is true that the plaintiffs have<\/p>\n
sated that their property is situated on the northern side of<\/p>\n
Shanghumugham Road. As per the Commissioner’s report,<\/p>\n
the property lies on the southern extremity on the eastern<\/p>\n
side of Anayara Road. This is taken advantage of by the<\/p>\n
learned counsel for the appellant to show that the property<\/p>\n
has not been properly identified. It is seen that the courts<\/p>\n
below have considered this aspect in considerable detail<\/p>\n
and found that it is not of any significance or consequence.<\/p>\n
The Commissioner pointed out that he had inspected the<\/p>\n
site three times and had identified the property. Both the<\/p>\n
defendants and the plaintiffs were present and they had no<\/p>\n
dispute regarding the identity of the property.<\/p>\n
          9. The lower Appellate Court has found that<\/p>\n
there is no road immediately adjacent on the southern side<\/p>\n
of the plaint schedule property. But the main road from<\/p>\n
which Petta-Anayara Road starts is on the southern side of<\/p>\n

the plaint schedule property a little away and that would<\/p>\n
reach Sanghumugham Road. This slight discrepancy as<\/p>\n
observed by the lower Appellate Court is not sufficient to<\/p>\n
non-suit the plaintiffs. The Commissioner has reported that<\/p>\n
the plaint schedule property has compound wall on all the<\/p>\n
four sides. The courts below were inclined to hold that the<\/p>\n
plaintiffs have proved their title and possession of the<\/p>\n
property. Accordingly, a decree was granted in their favour.<\/p>\n
The findings are essentially based on evidence on record.<\/p>\n
No substantial questions arise for consideration in this<\/p>\n
appeal. It is also not shown that the findings are either<\/p>\n
perverse or unwarranted by the evidence on record. The<\/p>\n
appeal has to fail. However, it is made clear that this being<\/p>\n
a suit for injunction, the issue regarding title will not be<\/p>\n
deemed to have been adjudicated in this proceeding. The<\/p>\n
parties will be free to agitate their claim regarding title in<\/p>\n
independent proceedings.\n<\/p>\n

          The appeal is dismissed subject to the above<\/p>\n
