Petitioner has filed this writ petition for quashing Forest<br \/>\nOrder No. 27 of 2005 dated July 23, 2005 whereby she was<br \/>\nreverted to her parent department to work as Junior Assistant<br \/>\nwith the Director, Department of Social Forestry.\n<\/p>\n<p>2. The case set up by the petitioner in her writ petition is<br \/>\nthat, having been promoted as Senior Assistant and allowed<br \/>\nto work as in-charge Head Clerk with the Director<br \/>\nDepartment of Social Forestry, she had acquired a right to the<br \/>\npromotional post and the order impugned in the writ petition,<br \/>\nreverting the petitioner as Junior Assistant, a post inferior to<br \/>\nthe one which she had held earlier in the borrowing<br \/>\ndepartment, was bad in law.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>3. Justifying the order impugned in the writ petition,<br \/>\nrespondents have submitted that the petitioner had been<br \/>\nallowed to work as in-charge Senior Assistant in a Centrally<br \/>\nsponsored scheme in the erstwhile Social Forestry Project<br \/>\nand on the closure of the project by the Government of India,<br \/>\nthe petitioner was repatriated to her parent department as<br \/>\nJunior Assistant, the substantive post which she was holding<br \/>\nand her working as in-charge senior Assistant in the project,<br \/>\nwould not give her any right to promotion as Senior<br \/>\nAssistant.\n<\/p>\n<p>4. I have considered the submissions of learned for the<br \/>\nparties and perused the documents placed on the records.\n<\/p>\n<p>5. Perusal of the documents on records indicates that<br \/>\npetitioner had not earned any promotion as such as Senior<br \/>\nAssistant, and in that view of the matter she cannot claim any<br \/>\nright against the post of Senior Assistant on her repatriation<br \/>\nto the parent department from the project where she is shown<br \/>\nto have been working as in-charge Head Clerk against<br \/>\navailable post of Senior Assistant.\n<\/p>\n<p>6. Petitioner&#8217;s adjustment as in-charge Head Clerk against<br \/>\nthe post of a Senior Assistant on the strength of the project<br \/>\nduring the period of her posting in the Social Forestry<br \/>\nProject, would not give her any right to the post available in<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nthe cadre of the department where she had held her lien. With<br \/>\nthe closure of the project, the superior position enjoyed by<br \/>\nthe petitioner in the project, too would cease and in that view<br \/>\nof the matter her claim for getting the same position in her<br \/>\nparent department may not be tenable.\n<\/p>\n<p>7. I, therefore, do not find any error in the impugned<br \/>\norder, reverting the petitioner to her parent department<br \/>\nagainst the post of Junior Assistant, which she substantively<br \/>\nholds in the Social Forestry Department.\n<\/p>\n<p>8. The order impugned does not violate any enforceable<br \/>\nright of the petitioner.
