Civil Judge [S.D.], Panchmahals at Godhra [for short &#8216;the<br \/>\nReference Court&#8217;],  have challenged the legality and correctness of<br \/>\nthe impugned judgment and award rendered on 01\/05\/2005. The<br \/>\nrespondents are original claimants in the aforesaid land  reference<br \/>\ncase.\n<\/p>\n<p>2.\t\tCertain<br \/>\nagricultural lands of the respondents situated in the outskirts of<br \/>\nvillage Tadiya, Taluka  Halol, District  Panchmahals came to be<br \/>\nacquired for the public purpose of &#8220;Kadana Project&#8221;.<br \/>\nThe  notification under section 4 of the Land Acquisition Act [for<br \/>\nshort &#8216;the Act&#8217;] was published on 7\/5\/1984 and the notification under<br \/>\nsection 6 of the Act was published on 6\/2\/1985. The Special Land<br \/>\nAcquisition Officer conducted inquiry  to determine just and fair<br \/>\namount of compensation and delivered his award under section 11 of<br \/>\nthe Act on 27\/2\/1986 and offered the compensation @ Rs.00-70 ps., per<br \/>\nsq.mtr., to the claimants.  The claimants felt that the amount<br \/>\noffered by way of  compensation to them was  grossly inadequate and<br \/>\ninsufficient and, therefore,<br \/>\nthey applied for reference   and their  reference was numbered and<br \/>\nregistered as Land Acquisition Reference Case Nos. 215 of 1999.\n<\/p>\n<p>3.\t\tBefore<br \/>\nthe Reference Court, both the parties adduced their oral and<br \/>\ndocumentary evidence. The Reference Court, took into consideration<br \/>\none previous award passed in L.A.R. Case NO. 25\/1988 wherein the land<br \/>\nof the same village i.e. Tadiya was acquired and in said case, the<br \/>\nnotification under section 4 of the Act was published on 7\/6\/1984 and<br \/>\nin the said case, the Reference Court had awarded additional<br \/>\ncompensation @ Rs.7\/- per sq.mtr. The Reference Court, therefore,<br \/>\npartly allowed the reference case and awarded additional compensation<br \/>\n@ Rs.7\/- per sq.mtr. The Reference Court also awarded statutory<br \/>\nincreases, namely 12% p.a interest as contemplated under section 23<br \/>\n[1-A] of the Act and the solatium as contemplated under section 23<br \/>\n[2] of the Act. The Reference Court granted running interest as<br \/>\nprovided under section 28 of the<br \/>\nAct. The appellants &#8211; Special Land Acquisition Officer and the<br \/>\nExecutive Engineer, who were original opponents in the said reference<br \/>\ncase  felt that the amount awarded by way of compensation was on<br \/>\nhigher side and, therefore, preferred this appeal.\n<\/p>\n<p>4.\t\tMs. Shachi Mathur, Ld.\n<\/p>\n<p>AGP for the appellants &#8211; original opponents submitted that the<br \/>\nimpugned judgment and award rendered by the Reference Court is<br \/>\ncontrary to law and facts on record. It is submitted that the<br \/>\nreference  was  presented beyond the prescribed period of limitation<br \/>\nand was time barred. It is also submitted that the Reference Court<br \/>\nerred in relying upon the previous award exh. 13 and mechanically<br \/>\nawarded the compensation as it was awarded in the previous award. The<br \/>\nReference Court did not appreciate in true perspective the evidence<br \/>\nadduced by the claimants and the opponents as to whether the land<br \/>\nacquired in the previous award was identically similar to the lands<br \/>\nof the claimants or not. That such mechanical approach on the part of<br \/>\nthe Reference Court resulted into the exorbitant and inflated award.<br \/>\nThe Special Land Acquisition Officer had offered the compensation<br \/>\nafter taking into consideration all the relevant material and the<br \/>\nfactors. Therefore, it is submitted that the appeal may be allowed.\n<\/p>\n<p>5.\t\tPer contra, Mr. VN<br \/>\nRaval, Ld. Advocate for the respondents &#8211; claimants fully<br \/>\nsupported the impugned judgment and award rendered by the Reference<br \/>\nCourt.  It is submitted that the Reference Court took into<br \/>\nconsideration the previous award which was in connection with earlier<br \/>\nacquisition of the land of the same village, namely Tadiya. That the<br \/>\nReference Court also considered the oral evidence of claimant<br \/>\nrecorded at exh. 14 regarding the potentiality and fertility of the<br \/>\nlands under acquisition. It is submitted that plea of limitation was<br \/>\nnot raised by the appellants &#8211; opponents before the Reference<br \/>\nCourt nor issue to that effect was framed. Hence, it is submitted<br \/>\nthat the appeal may be dismissed.\n<\/p>\n<p>6.\t\tConsidering the impugned<br \/>\njudgment and award rendered by the Reference Court, it transpires<br \/>\nthat the Reference Court relied upon earlier award, copy whereof was<br \/>\nproduced at exh. 13 and considered said previous award as comparable<br \/>\naward. The previous award exh. 13 was passed in Reference Case No.<br \/>\n25\/1988, which was passed on 31\/3\/1993. In the said case, the<br \/>\nnotification under section 4 of the Act was published on 7\/6\/1984;<br \/>\nwhereas in the instant case, the notification under section 4 of the<br \/>\nAct was published on 7\/5\/1984. Thus, the time gap is very negligible<br \/>\ni.e. one month. Over and above this, the previous award was passed<br \/>\npertaining to the acquisition of land of the same village Tadiya.<br \/>\nWhile appreciating the comparable award exh. 13 and the similarity of<br \/>\nlands of the claimants and the land acquired in the earlier award,<br \/>\nthe Reference Court took into consideration the oral evidence adduced<br \/>\nby the claimant. The Reference Court in the above view of the matter,<br \/>\nultimately came to the conclusion that in the instant case  the<br \/>\nclaimants were entitled to recover compensation at the same rate to<br \/>\nwhich the claimants of L.A.R. Case No. 25\/1988 received. Ultimately,<br \/>\nthe Reference Court came to the conclusion that the claimants were<br \/>\nentitled to get additional compensation @ Rs.7\/- per sq.mtr. It is<br \/>\ntrue that in the judgment and award, at one place Reference Court<br \/>\nobserved that if the land was acquired @ Rs.8-20 ps., per sq.mtr.,<br \/>\nthat could have been more reasonable, proper and just. However, that<br \/>\ndoes not mean that the Reference Court fixed the market rate of the<br \/>\nacquired land at Rs.8-20 ps., per sq.mtr.\n<\/p>\n<p>7.\t\tIn the memo of appeal as<br \/>\nwell as during arguments on behalf of the appellants, a contention is<br \/>\nraised about the limitation. The impugned judgment and award, if<br \/>\nminutely read, nothing transpires that any such contention regarding<br \/>\nthe limitation was raised by the appellants &#8211; opponents before<br \/>\nthe Reference Court. Therefore, it appears that no issue came to be<br \/>\nframed by the Reference Court pertaining to the limitation. If at all<br \/>\nthe appellants &#8211; opponents had raised such dispute before the<br \/>\nReference Court, the Reference Court would have framed issue<br \/>\nregarding limitation or else the appellants &#8211; opponents would<br \/>\nhave requested the Reference Court to frame the issue regarding the<br \/>\nlimitation. Perusing the impugned judgment and award, nothing<br \/>\nwhatsoever was done by the opponents.\n<\/p>\n<p>8.\t\tIn the above view of the<br \/>\nmatter, this Court is of the opinion that the Reference Court did not<br \/>\nerr in relying upon the comparable award exh. 13 rendered by the<br \/>\nReference Court earlier in point of time in L.A.R. Case No. 25\/1988.<br \/>\nNothing is either contended in the memo of appeal nor it is contended<br \/>\non behalf of the appellants at the time of the arguments that the<br \/>\nprevious award exh. 13 passed on 31\/5\/1993 in L.A.R. Case No. 25\/1988<br \/>\nhas not attained finality. Under such circumstances, the previous<br \/>\naward relied upon by the Reference Court cannot be said to be a<br \/>\nmistake or error.\n<\/p>\n<p>9.\t\tIn the above view of the<br \/>\nmatter, this Court has not found any ground to interfere with the<br \/>\nimpugned judgment and award rendered by the Reference Court and the<br \/>\nappeal deserve dismissal.\n<\/p>\n<p>10.\t\tFor the foregoing<br \/>\nreasons, the appeal stands dismissed.
