Therefore, once the judicial order is passed by Labour Court,<br \/>\nit cannot be reviewed subsequently by Labour Court.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr.Gogia has raised contention before this Court that the<br \/>\npursis was filed by opponent   respondent (Page-21) where it was<br \/>\nmade clear by respondent that departmental inquiry which was<br \/>\nconducted against the workman is in accordance with the principles of<br \/>\nnatural justice and there is no defect in the inquiry and the Inquiry<br \/>\nOfficer was appointed and thereafter, it was conducted which is<br \/>\naccording to respondent is legal and valid.\n<\/p>\n<p>4.\tThe<br \/>\npoint is that order was passed on 26.4.2004 in absence of petitioner<br \/>\nand his representative, without giving any reasons and discussing<br \/>\nwhether departmental inquiry is legal and valid or not and<br \/>\nstraightway,  one line order was passed that, &#8216;in light of the pursis<br \/>\ngiven by respondent, departmental inquiry was held to be legal and<br \/>\nvalid on the basis of the documents&#8217;.\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate Mr.Gogia submitted that this order has been passed in<br \/>\nabsence of petitioner and his representative. Thereafter, Labour<br \/>\nCourt has dismissed the reference in default. Thereafter, restoration<br \/>\napplication was made by petitioner which was allowed and reference<br \/>\nhas been restored. Thereafter, fresh application was submitted by<br \/>\npetitioner challenging the legality and validity of departmental<br \/>\ninquiry which was rejected only on the ground that earlier<br \/>\ndepartmental inquiry was held to be valid by Labour Court on the<br \/>\nbasis of documents.\n<\/p>\n<p>6.\tI<br \/>\nhave considered the submissions made by learned advocate Mr.Gogia.<br \/>\nThe question is that whether at this stage this Court can interfere<br \/>\nwith such interim order or not. The legal position is both way<br \/>\ncleared by the Hon&#8217;ble Apex Court in the case of  <a href=\"\/doc\/926132\/\">The Cooper<br \/>\nEngineering Ltd. v. P.P.Mundhe<\/a> reported in AIR 1975 SC 1900. In<br \/>\naforesaid decision, it has been held that  if the legality and<br \/>\nvalidity of the departmental inquiry is challenged by workman and if<br \/>\nit is held by Labour Court against employer to the effect that<br \/>\ninquiry is bad, then challenge by employer to the High Court is not<br \/>\nto be encouraged by the Hon&#8217;ble Apex Court and said petition is not<br \/>\nto be entertained by the High Court. Similarly, in case when<br \/>\ndepartmental inquiry is held to be valid, rightly or wrongly, if it<br \/>\nis challenged by workman, then also not to entertain such petition.<br \/>\nOtherwise both parties in either of case, ultimately delaying the<br \/>\nadjudication which is pending before the Labour Court.\n<\/p>\n<p>7.1\tIn<br \/>\nfacts of this case, if present petition is entertained by this Court,<br \/>\nthen naturally the proceedings of adjudication of reference where<br \/>\ndismissal \/ termination is under challenge remain pending for years<br \/>\ntogether. Therefore, view expressed by the Apex Court in Para.21 and<br \/>\n22 of aforesaid decision are relevant and therefore, same are quoted<br \/>\nas under :\n<\/p>\n<p>\t 21.<br \/>\n\tPropositions (4). (6) and (7) set out above are well-recognised. Is<br \/>\n\tit, however, fair and in accordance with the principles of natural<br \/>\n\tjustice for the Labour Court to withhold its decision on a<br \/>\n\tjurisdictional point at the appropriate stage and visit a party with<br \/>\n\tevil consequences of a default on its part in not asking the Court<br \/>\n\tto give an opportunity to adduce additional evidence at the<br \/>\n\tcommencement of the proceedings or, at any rate in advance of the<br \/>\n\tpronouncement of the order in that behalf ? In our considered<br \/>\n\topinion it will be most unnatural and unpractical to expect a party<br \/>\n\tto take a definite stand when a decision of a jurisdictional fact<br \/>\n\thas first to be reached by the Labour Court prior to embarking upon<br \/>\n\tan enquiry to decide the dispute on its merits. The reference<br \/>\n\tinvolves determination of the larger issue of discharge or dismissal<br \/>\n\tand not merely whether a correct procedure had been followed by the<br \/>\n\tmanagement before passing the order of dismissal. Besides, even if<br \/>\n\tthe order of dismissal is set aside on the ground of defect of<br \/>\n\tenquiry a second enquiry after reinstatement is not ruled out nor in<br \/>\n\tall probability a second reference. Where will this lead to? This is<br \/>\n\tneither going to achieve the paramount object of the Act, namely,<br \/>\n\tindustrial peace, since the award in that case will not lead to a<br \/>\n\tsettlement of the dispute. The dispute, being eclipsed, pro tempore,<br \/>\n\tas a result of such an award, will be revived and industrial peace<br \/>\n\twill again be ruptured. Again another object of expeditious disposal<br \/>\n\tof an industrial dispute (see S. 15) will be clearly defeated<br \/>\n\tresulting in duplication of proceedings. This position has to be<br \/>\n\tavoided in the interest of labour as well as of the employer and in<br \/>\n\tfurtherance of the ultimate aim of the Act to foster industrial<br \/>\n\tpeace.\n<\/p>\n<p>\t22.\tWe<br \/>\n\tare therefore clearly of opinion that when a case of dismissal or<br \/>\n\tdischarge of an employee is referred for industrial adjudication the<br \/>\n\tlabour court should first decide as a preliminary issue whether the<br \/>\n\tdomestic enquiry has violated the principles of natural justice.<br \/>\n\tWhen there is no domestic enquiry or defective enquiry is admitted<br \/>\n\tby the employer there will be no difficulty. But when the matter is<br \/>\n\tin controversy between the parties that question must be decided as<br \/>\n\ta preliminary issue. On that decision being pronounced it will be<br \/>\n\tfor the management to decide whether it will adduce any evidence<br \/>\n\tbefore the Labour Court. If it chooses not to adduce any evidence it<br \/>\n\twill not be thereafter permissible in any proceeding to raise the<br \/>\n\tissue. We should also make it clear that  there will be no<br \/>\n\tjustification for any party to stall the final adjudication of the<br \/>\n\tdispute by the Labour Court by questioning its decision with regard<br \/>\n\tto the preliminary issue when the matter if worthy can be agitated<br \/>\n\teven after the final award. It will be also legitimate for the High<br \/>\n\tCourt to refuse to intervene at this stage. We are making these<br \/>\n\tobservations in our anxiety that there is no undue delay in<br \/>\n\tindustrial adjudication.\n<\/p>\n<p>8.\tIn<br \/>\nview of aforesaid observations made by the Apex Court, according to<br \/>\nmy opinion, this petition, at this stage, challenging interim order,<br \/>\ncannot be entertained by this Court subject to giving liberty to<br \/>\npetitioner to challenge very same orders which are challenged in<br \/>\npresent petition in case if ultimate decision and reference goes<br \/>\nagainst the petitioner.
