The<br \/>\npetitioner is  branded as   bootlegger .\n<\/p>\n<p>2.\tHeard<br \/>\nthe learned Advocate for the petitioner and learned AGP for the<br \/>\nrespondents. No Affidavit in reply is filed by the respondents<br \/>\ncontroverting the averments made by the petitioner.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner came to be detained as  bootlegger  on his involvement<br \/>\nin the offences of  prohibition.\n<\/p>\n<p>4.\tIt<br \/>\nhas been submitted by the learned Counsel for the petitioner that it<br \/>\nis a settled legal position that on registration of two offences, no<br \/>\norder of detention could have been passed as petitioner   detenu<br \/>\ncannot be branded as  bootlegger . It has been further submitted<br \/>\nthat the activities of the petitioner cannot be said to be injurious<br \/>\nto the public health or public order. It has been further submitted<br \/>\nby the learned Counsel for the petitioner that there is gross delay<br \/>\nin passing the order of detention as well as there is gross delay in<br \/>\nexecuting the order of detention.\n<\/p>\n<p>5.\tI<br \/>\nhave gone through the grounds of detention and considered the<br \/>\narguments advanced by the learned Counsel for the petitioner as well<br \/>\nas the learned A.G.P.\n<\/p>\n<p>6.\tThe<br \/>\nCourt is of the opinion that there is much substance in the arguments<br \/>\nadvanced by learned Counsel for the petitioner. It is seen from the<br \/>\ngrounds that a general statement has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health. In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which are mentioned in the order are in reference to the<br \/>\nsituation of  law and order  and not  public order .<br \/>\nTherefore, on this ground, the subjective satisfaction of the<br \/>\ndetaining authority is vitiated on account of non-application of mind<br \/>\nand the impugned order, therefore, deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>7.\tExcept<br \/>\nthe general statement, there is no material on record which shows<br \/>\nthat the petitioner   detenue is carrying out illegal activities of<br \/>\nselling liquor which is harmful to the health of the public. In the<br \/>\ncase of ASHOKBHAI JIVRAJ @ JIVABHAI SOLANKI v\/s. POLICE COMMISSIONER,<br \/>\nSurat, reported in 2001 (1) GLH 393, having considered the<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of Ram manohar<br \/>\nLohia v\/s. State of Bihar, reported in AIR 1966 SC 740,<br \/>\nthis Court held that the cases wherein the detention order are passed<br \/>\non the basis of the statements of such witness fall under the<br \/>\nmaintenance of  law and order  and not  public Order .\n<\/p>\n<p>8.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention, the detaining authority must come to a definite<br \/>\nfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\nclear that the present case would not fall within the category of<br \/>\nthreat to a public order. In that view of the matter, when the order<br \/>\nof detention has been passed by the detaining authority without<br \/>\nhaving adequate grounds for passing the said order, cannot be<br \/>\nsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>9.\tIn<br \/>\nthe result, this petition is allowed. The impugned order of detention<br \/>\ndated 07.04.2010 passed by the Police Commissioner, Ahmedabad city,<br \/>\nis hereby quashed and set aside. The detenu is ordered to be set at<br \/>\nliberty forthwith, if not required in any other case. Rule is made<br \/>\nabsolute accordingly.
