Interlocutory Application No. 283 of 2011: &#8211;\n<\/p>\n<blockquote><p>                                       This application under Section 5 of the<br \/>\n                         Limitation Act is filed by the appellant for condonation<br \/>\n                         of delay of 35 days occurred in filing the Letters Patent<br \/>\n                         Appeal.<\/p><\/blockquote>\n<p><span class=\"hidden_text\">               -2-<\/span><\/p>\n<p>             On the facts and in the circumstances of the<br \/>\ncase, the delay is condoned.\n<\/p>\n<p>            Interlocutory Application stands disposed of.<br \/>\nLetters Patent Appeal No. 57 of 2011: &#8211;\n<\/p>\n<p>            The appellant, respondent no.6 in the above<br \/>\nC.W.J.C. No. 12009 of 2010, has preferred this appeal<br \/>\nunder Clause 10 of the Letters Patent against the<br \/>\njudgment and order dated 27th October 2010 passed by<br \/>\nthe learned single Judge.\n<\/p>\n<p>            The respondent no.1-the writ petitioner is the<br \/>\nresident of village-Chorghaur, district-Madhubani. He<br \/>\nbeing a resident of that village was the chairman of<br \/>\nBabubarhi     Prakhand         Sampariwartit   Matsyajivi<br \/>\nSwablambi Samiti Limited (hereinafter referred to as<br \/>\n&#8220;the Samiti&#8221;). The Samiti was awarded a settlement. On<br \/>\na complaint made by the appellant and the others the said<br \/>\nsettlement came to be examined. On such examination<br \/>\nthe District Magistrate, Madhubani found that the name<br \/>\nof the respondent no.1 was also included in the voters&#8217;<br \/>\nlist of village- Chandradih, Block- Khajauli, District-<br \/>\nMadhubani. Thus, he had gained advantage of inclusion<br \/>\nof his name in the voters&#8217; list of two separate assembly<br \/>\nconstituencies. On the said ground the settlement made<br \/>\nin favour of the Samiti was cancelled on 17th June 2010.<br \/>\nThe said order was challenged by the respondent no.6 in<br \/>\nabove C.W.J.C. No. 12009 of 2010. The learned single<br \/>\nJudge has held that though the respondent no.6 was<br \/>\nincluded in the voters&#8217; list of Khajauli block he was not<br \/>\ndemonstrated to be the member of any society of the said<br \/>\nblock. There was no justification for cancelling the<br \/>\n<span class=\"hidden_text\">                 -3-<\/span><\/p>\n<p>settlement made in favour of Babubarhi Prakhand<br \/>\nMatsyajivi      Swablambi        Sahkari     Samiti    Limited,<br \/>\nGhaghour in Babubarhi block. Therefore, the present<br \/>\nappeal.\n<\/p>\n<p>             Learned advocate Mr. Anand K. Ojha has<br \/>\nappeared for the appellant. He has relied upon the<br \/>\nenquiry report made by the Additional District<br \/>\nMagistrate, Madhubani. Admittedly, the writ petitioner&#8217;s<br \/>\nname      was   included    in    two      different   assembly<br \/>\nconstituencies. He could not have formed a society of<br \/>\njalkars in Babubarhi block; nor could such society have<br \/>\nbeen awarded such a settlement.\n<\/p>\n<p>             We see no merit in the submission made by<br \/>\nthe learned advocate. It is not in dispute that the<br \/>\nrespondent no.6 is a resident of village-Chorghaur,<br \/>\nBlock-Babubarhi, district-Madhubani; that he is the<br \/>\nChairman of the aforesaid society; the settlement made<br \/>\nin favour of the society could not have been cancelled for<br \/>\nthe reason that its Chairman was the member of the<br \/>\nelectoral in two constituencies, namely, Babubarhi and<br \/>\nKhajauli. The reason for which the settlement was set<br \/>\naside was not germane. Moreover, the Additional<br \/>\nDistrict Magistrate went further to cancel the formation<br \/>\nof the Samiti, clearly without the authority of law.\n<\/p>\n<p>             The learned single Judge has rightly set aside<br \/>\nthe impugned order of cancellation of the settlement<br \/>\nmade by the District Magistrate, Madhubani on 17th June<br \/>\n2010.\n<\/p>\n<p>             No case for interference is made out. The<br \/>\nAppeal is dismissed in limine.\n<\/p>\n<p><span class=\"hidden_text\">                         -4-<\/span><\/p>\n<p>                     Interlocutory Application Nos. 284 of 2011<br \/>\n          and 968 of 2011 stand disposed of.\n<\/p>\n<p>                              (R.M.
