Wadhwa<br \/>\nAnil Kumar Tandale, Adv. for the appellant<br \/>\n O R D E R<br \/>\n     The following order of theCourt was delivered:<br \/>\n     This appeal  by special  leave arises fromthe order of<br \/>\nthe Andhra  Pradesh Administrative  Tribunal,  Hyderabad  in<br \/>\nR.P. No.767\/81, made on\t June 26,  1985. The  Tribunal has<br \/>\nallowedthe representation petition, solely on the ground of<br \/>\ndefaulton  thepart  of the  appellantto filethe counter-<br \/>\naffidavit. Therein  they had  claimed the  benefit of graded<br \/>\nincrements depending  upon the length of service in terms of<br \/>\nG.O.Ms.No.41,Financeand\t Planning (in Wing.PRC-I) dated<br \/>\n4.2.1980.\n<\/p>\n<p>     The admitted  position isthat  the\t respondentswere<br \/>\nworkingin  thepost ofSenior Assistant Grade-II in the pay<br \/>\nscale of Rs. 200-240\/-.They were promoted to Grade-I in the<br \/>\nscale of  Rs. 430-800\/-.  The Government  passed an order in<br \/>\nG.O.Ms.No.  235, dated September 7,  1979, effectivefrom<br \/>\nApril 1,  1978,granting\t the revised  pay scales. As stated<br \/>\nearlier, G.O.Ms.  No. 41,  Fin., dated4.2.1980\tgives the<br \/>\nbenefitas under :\n<\/p>\n<blockquote><p>     &#8220;Weightage for   servicein\t  the<br \/>\n     existing post  or categoryshall be<br \/>\n     asfollows in therevisedscale of<br \/>\n     pay, 1978.\n<\/p><\/blockquote>\n<blockquote><p>     (i) All  employeesin Gr. I to XVII<br \/>\n     shall be  allowed one increment for<br \/>\n     service of three years  and  above<br \/>\n     upto five years, two increments for<br \/>\n     service of five  years  and  above<br \/>\n     upto seven years,three increments<br \/>\n     for service  of service seven years<br \/>\n     and above.&#8221;<\/p><\/blockquote>\n<p>     The question,  therefore, is  : whether the respondents<br \/>\nare entitled tohave their entire previous service as Trade-<br \/>\nII teacher  lagged to  count the advance increments in terms<br \/>\nof G.O.Ms.  No.41,  referred to\t earlier.  Itspecifically<br \/>\nenvisages &#8220;weightage  of service  in the  existing  post  or<br \/>\ncategory&#8221;. It  would indicate  that the weightage  for the<br \/>\nservicerendered\t in the\t existing postor category in which<br \/>\nthey are  working shall be taken  intoaccount in terms of<br \/>\nG.O.Ms.No.  41. In  other words, if Grade-I teacher remains<br \/>\nin Grade-I service evenafter putting in five years service,<br \/>\nhe is  entitledto  oneincrement; after five to seven years<br \/>\nservice, he  entitled to  two increments; and for service of<br \/>\nseven years andabove, he is entitled to there increments as<br \/>\nouter limit.  On his  promotionto  Grade II from Grade-I in<br \/>\nthe scale  of Rs.  430-800\/-, necessarily  on his  rendering<br \/>\nservicein  that post  or category,  namely, Grade-I, on his<br \/>\nputtingin  service ofthree years  tofive  years,  he  is<br \/>\nentitled to oneincrement; for five to seven years&#8217; service,<br \/>\nhe is  entitledto  twoincrements; andfor service of seven<br \/>\nyears and  above, he  is entitled  to three  increments.  He<br \/>\ncannot tag  on the  previous service  in  Grade-II  for the<br \/>\npurposeof  claiming  the  advance  increment  in  terms\t of<br \/>\nG.O.Ms.No. 41,dated February 4, 1980.\n<\/p>\n<p>     The appeal,  therefore, is allowed.
