        The writ petition is filed seeking the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i)  Call for the records leading to Ext.P1<\/p>\n
to P5.\n<\/p>\n
        ii)     Set   aside  Ext.P5   order   dated<\/p>\n
17\/03\/2009 in E.A No.263\/2008 in E.P No.68\/01 in<\/p>\n
O.S No.367\/94 of the Sub Court, Pala and direct the<\/p>\n
court below to review and reconsider Ext.P3 order<\/p>\n
by also granting the petitioner opportunity to<\/p>\n
adduce evidence.\n<\/p>\n
        iii)   Render such other orders as this<\/p>\n
Hon’ble Court may deem fit and proper in the<\/p>\n
circumstances of the case.\n<\/p>\n

          2.    Petitioner is the decree holder in E.P<\/p>\n
No.68 of 2001 in O.S No.367 of 1994 on the file of<\/p>\n
the Sub Court, Pala.       The decree executed is one<\/p>\n
passed in a suit for specific performance.       In the<\/p>\n
execution proceedings on the application moved by<\/p>\n
the decree holder, an advocate commissioner was<\/p>\n
appointed to measure out and identify the decree<\/p>\n
schedule property.      A report and plan filed by the<\/p>\n
commissioner      previously   was    remitted  on  the<\/p>\n
objections raised by the parties to the proceeding.<\/p>\n
The report and plan prepared by the commissioner<\/p>\n
subsequently was also objected to by the parties,<\/p>\n
both by the decree holder and also the judgment<\/p>\n
debtor.     When the objections raised to the report<\/p>\n
and   plan    were   considered,   the   learned counsel<\/p>\n
appearing for the decree holder made a concession<\/p>\n
that in the property identified for conveyance<\/p>\n
towards    the   decree,  the   decree   holder  has no<\/p>\n
objection in providing a road having a width of<\/p>\n

10 feet for access to the property comprising the<\/p>\n
of   a   building    of  the  judgment   debtor situate<\/p>\n
behind.      Acting upon that concession, the court<\/p>\n
passed    an   order    remitting  the   report by  the<\/p>\n
commissioner to identify and measure out the road<\/p>\n
as conceded. The decree holder thereafter filed a<\/p>\n
petition supported by an affidavit contending that<\/p>\n
no authority had been conferred on his counsel to<\/p>\n
make the concession made before court.        He applied<\/p>\n
for review of the previous order passed by the<\/p>\n
court.     That application was opposed to by the<\/p>\n
judgment debtor.         The learned Sub Judge after<\/p>\n
hearing both sides dismissed the review petition.<\/p>\n
Challenging the propriety and correctness of that<\/p>\n
order, a copy of which is produced as Ext.P5, the<\/p>\n
writ    petition      has  been   filed   invoking  the<\/p>\n
supervisory jurisdiction vested with this court<\/p>\n
under Article 227 of the Constitution of India.<\/p>\n

          2.     I heard the counsel on both sides.<\/p>\n
The learned counsel for the petitioner \/ decree<\/p>\n
holder submitted that the learned Sub Judge went<\/p>\n
wrong in acting upon the concession purported to<\/p>\n
have been made by his counsel without getting such<\/p>\n
concession recorded by the decree holder.        So much<\/p>\n
so, it is submitted, Ext.P5 order which is against<\/p>\n
the mandate as to how a concession of any of the<\/p>\n
parties to the lis has to be dealt with is liable<\/p>\n
to be set aside.        On the other hand, the learned<\/p>\n
counsel    for    the   respondent   \/   judgment  debtor<\/p>\n
contended that the concession given by the counsel<\/p>\n
was    bonafide     and   there   is    no   circumstance<\/p>\n
whatsoever     for    its  review    on  the   subsequent<\/p>\n
retraction made by the decree holder.             Having<\/p>\n
regard to the submissions made and taking note of<\/p>\n
the facts and circumstances presented it has to be<\/p>\n
stated that the court below has not appreciated the<\/p>\n
challenges raised against the previous order sought<\/p>\n

to be reviewed with reference to the provisions of<\/p>\n
law applicable.        Order 23 Rule 3 of the Code of<\/p>\n
Civil Procedure mandates that when a compromise is<\/p>\n
made by the concession of a party, it should be<\/p>\n
recorded in writing        duly signed by the parties.<\/p>\n
The Apex Court having occasion to take note    of the<\/p>\n
mischief emanating from concessions made by the<\/p>\n
counsel    at    the   time  of  hearings,   on  which<\/p>\n
decisions had been rendered by the courts has held<\/p>\n
in “Gurpreef Singh v Chatur Bhuj Goel” (1988(1) SCC<\/p>\n
270) that the procedural mandate covered by Order<\/p>\n
23 Rule 3 has to be scrupulously followed and the<\/p>\n
concession made at the time of hearing has to be<\/p>\n
got recorded in writing. For that solitary reason<\/p>\n
itself in the present case, the order passed by the<\/p>\n
court below acting upon the concession made by the<\/p>\n
counsel of the decree holder is liable to be set<\/p>\n
aside.    Setting aside Ext.P3 and P5 orders passed<\/p>\n
by the court below, I direct the learned Sub Judge<\/p>\n

to consider the merit of the objections raised to<\/p>\n
the commission report afresh and pass appropriate<\/p>\n
orders, and dispose of the execution proceedings as<\/p>\n
