he was driving the vehicte in question, met with an accident and
\nsuccumbed to the said injuries. it is further alleged that,_4atV_t-h:l;.;.t_ime
\nof the incident, the deceased was drawing a salary.

3. The principal coitt.e’ntgio–n.  ._urged before the
\nCommission was that,’  vn’o’.v”l’i.cence, as such,<\/p>\n
engaging the ._d.e–cea’s:e_\u00abd ~to__dri.ve.__\u00ab–the vehicle without licence<\/p>\n
amounts tci’vioVlatirdn__Vo_t  ptoir’ision.sVo’tl the Motor Vehicles Act and
\nin view of the ‘same,’prli’ma’i’~3r:::”iiability being on the employet and<\/p>\n
employe_r~haAving” violated theprovisions of the Motor Vehicles Act,<\/p>\n
:’V:.v.\u00a7he’lill\u00e9urer\ufb01s no? liabie\ufb02to pay the compensation. However, the<\/p>\n
said negatived by the Commissioner and the<\/p>\n
9′ “liabilitAy*-..__was~’fi.\u00a7{.edi or’: the insurer intera\/Ia by determining the<\/p>\n
“‘Tlfcompehsativon at F%s.2,t6,9tO\/– with interest. It is against this<\/p>\n
 this appeal has been filed.\n<\/p>\n
 ” 4. Sri_A_l\\\/l.Venkatesh, leamed Counsel for the appellant<\/p>\n
xhsubmitted that, before the Commissioner, on behatf of the insurer,<\/p>\n
:9?\n<\/p>\n
objection statement was filed interalia disputing the deceased
\nhaving licence. in this regard, a notice was aiso issued. to the
\nowner of the vehicle and further, the Police has registe_re,d:–a:c_ase
\nfor violation of Section 3 of the l\\\/iotor Vehicies
\nwhen there is no licence, the Commissloyner was’
\nfixing the liability on the insurer. in this
\ncharge sheet and also ail9Qe’d..:’i~h.at theas’cl.aiVm.ants’A–h.a~rie
\nproduced the iicence nor the ownesrss’:oi._titeg’ ve.hicie,._ha,d produced
\nany licence. Despite this, thest)ommissio’ner.:sghasVerroneously fixed
\nthe liability on the4ih’s.ureri””‘Heiisiltaigigtssoass’:’ei{.ise’dss.on the judgment
\nreported in ‘N  .rie,g i.migrrei of NATIONAL
\nINSURANCE-   ii,~si\u00ab\/5’ nA\/ AND OTHERS and
\nsubmitteda*t.ha’t,”   similar circumstances has held<\/p>\n
that, in case thie._Vve.hicie_  by a person having no licence, the<\/p>\n
.~”i.nsurer’i’s  luiables”‘to.p_ayv compensation. He submitted that, the<\/p>\n
“a.wa.rd”is greguirie-d:”te_be set aside.<\/p>\n

-4….ifi,’\u20aciaimants’submitted that; though before the Commissioner, a<\/p>\n
s_’c_ont_ention was raised as regard to the deceased not having licence<\/p>\n
a ..s_,to-tdrive the vehicle in question, however, when a notice was issued<\/p>\n
as s by the insurer to the owner of the vehicie, the owner has replied to<\/p>\n

the said notice and has stated that the deceased was having
\nlicence and on verification of the licence; he had allowed him to<\/p>\n
drive the vehicte. He also stated that, even on the date of acc\u00e9tdent,<\/p>\n
the deceased had ticence. But, during the course oi;th~e.fac_cide’ri~L<\/p>\n
the said licence has been lost and submitted th_a.t,.E.t:’:irs  a  <\/p>\n
that the deceased was driving the vehicle witghouutg <\/p>\n
judgment of the Apex Court is not.\u00bbap.plicatjl.e’to   it<\/p>\n
6. The only question._thatg..l’s” raisedt._.before”-this: Court is,
\nwhether the insurer is liabte topayVjlrlcompeinsaltion on the ground
\nthat the deceased_.i\\ivas’not hav’inq.\u00ab:Eicen’ceV-to”drive the vehicle.<\/p>\n
7. lnsofarilas-“this.’aspect.is”concerned, from the records it is
\nseen that the ‘insurer  a Eegal notice to the employer as<\/p>\n
per E><.P2. "Eu"t:eViho.xiirn'e.:faappeiared before the Court and had filed<\/p>\n

 respondent No.1 begs to submit reply to
\nnotice as hereunder\u00bb<\/p>\n
_ Late Nagappa @ Nagaraj was an employee with
\n_ this respondent. As on the date of accident, he was
\n having valid driving licence to drive the tractor-trailor.<\/p>\n
On the date of accident he was kept the o’riving
\nlicence with him. After his death, the driving licence
\nwas whereabout not known to this respondent.<\/p>\n

The owner in the said reply has categoricalty stated that, he had<\/p>\n
engaged the deceased after verifying the licence and on tghegdate<\/p>\n
of accident, the deceased had kept the licence with <\/p>\n
the death, it is not known as to what happened  <\/p>\n
From the statement of the owner it  thlat <\/p>\n
taken care to engage a person having licence to driver. the v”eh’icle’g<\/p>\n
and this tact is not disputed by the'”wi:Vtnes_s e$<'anl'l'rieVd  hehalt oi
\nthe insurer. in KUSUM   wherein a person
\ndrives the vehicle without liceVnc'eA._ahd:ithatttlt.etcAtb.I'Vrte'ving been proved
\nand admitted, the 2lE\\t3"\u20acf;'<:i'-.'\\.'V3O.t,:?'."{'  insurer is not liable
\nto pay  driven in violation ot the
\nprovisions but this is not the
\ncase wherethye"vehic.l_e'KAt.i\u00e9A~.rlri"t<en\u00ab by a person without licence. No<\/p>\n
steps are tal+<\/p>\n
contract, it is for the insurer to prove the same. in this case, except
\nthe bare denial, nothing has been done by the insurer. in these
\ncircumstances, i find that there is no error commit_t.ed’-.._oy.._ the<\/p>\n
