However, the cause title of the order dated 17.09.2010 an<br \/>\ninadvertent error has occurred as a result of which the record of the<br \/>\nCourt shows that Special Civil Application No.2447 of 2009 and Civil<br \/>\nApplication No.3021 of 2010 are also disposed of and that therefore,<br \/>\nthe said order dated 17.09.2010 is required to be appropriately<br \/>\nmodified or clarified.\n<\/p>\n<p>2.\tUpon<br \/>\nexamination of order dated 17.09.2010, it is noticed that in<br \/>\nparagraph Nos.9 and 10 of the order dated 17.09.2010, it is stated<br \/>\nthus;\n<\/p>\n<p>&#8220;9.\tWith<br \/>\nthe aforesaid clarification the petitions are disposed of. The<br \/>\ninterim relief, if any, stands vacated.\n<\/p>\n<p>10.\tIn<br \/>\nview of the order passed in main matter the civil application stand<br \/>\ndisposed of.&#8221;\n<\/p>\n<p>3.\tOn<br \/>\nthe other hand, the cause title of the order makes a reference of<br \/>\nboth writ petitions i.e. Special Civil Application No.883 of 2010 and<br \/>\n Special<br \/>\nCivil Application No.2447 of 2009 and Civil Application No.3021 of<br \/>\n2010 in Special Civil Application No.2447 of 2009.\n<\/p>\n<p>4.\tTherefore,<br \/>\nin view of the observations in paragraph Nos.9 and 10 of the order,<br \/>\nthe Registry appears have construed that Special Civil Application<br \/>\nNo.2447 of 2009 and Civil Application No.3031 of 2010 are also<br \/>\ndisposed of.\n<\/p>\n<p>5.\tMr.D.\n<\/p>\n<p>R. Dave, learned advocate appearing for the petitioner has submitted<br \/>\nthat actually, only Special Civil Application No.883 of 2010 was<br \/>\ndisposed of.\n<\/p>\n<p>6.\tMr.R.\n<\/p>\n<p>K. Mishra, learned advocate appearing for respondent  has supported<br \/>\nthe submissions of the learned advocate for the petitioner.\n<\/p>\n<p>7.\tThus,<br \/>\nhaving regard to the submissions made by Mr.D. R. Dave, learned<br \/>\nadvocate for the petitioner which are supported by learned advocate<br \/>\nfor the respondent, the order dated 17.09.2010 is ordered to be<br \/>\nmodified so as to clarify that by the said order, only Special Civil<br \/>\nApplication No.883 of 2010 stands disposed of whereas  Special Civil<br \/>\nApplication No.2447 of 2009 and Civil Application No.3021 of 2010 in<br \/>\nSpecial Civil Application No.2447 of 2009 are not disposed of and<br \/>\nthey remain pending at the stage at which same were as on 17.09.2010.<br \/>\nOffice  is, therefore, directed to restore the said two cases i.e.<br \/>\nSpecial Civil application No.2447 of 2009 and Civil Application<br \/>\nNo.3021 of 2010 on its original file, if they are shown as disposed<br \/>\nof on the record.\n<\/p>\n<p>8.\tParagraph<br \/>\nNos.9 and 10 of the order dated 17.09.2010 shall be corrected so as<br \/>\nto mention that Special Civil Application No.883 of 2010 is disposed<br \/>\nof.\n<\/p>\n<p>9.\tOrders<br \/>\non the note accordingly.
